El pago del tercero y los mecanismos de recuperación de la pérdida patrimonial sufrida por el pago de la obligación ajena en el Código Civil peruano

De acuerdo con el artículo 1222 del Código Civil puede hacer el pago cualquier persona, con o sin interés en el cumplimiento, con o sin el asentimiento del deudor, salvo las limitaciones establecidas legalmente. La justificación de la regla general de la admisibilidad del pago por un tercero radica en la idea del cumplimiento entendido como satisfacción del interés del acreedor. Si el acreedor se negara a recibir el pago del tercero, por ser precisamente una persona ajena a la relación obligatoria, sería una negativa injustificada y, por tanto, incurriría en mora del acreedor. In accordance with Article 1222 of the Civil Code, any person, with or without interest in its compliance, with or without the consent of the debtor, except for the limitations established by law, can make such payment. The rationale for the general rule of payment admissibility by a third-party is based on the idea of compliance, understood as to creditor’s satisfaction. If the creditor refuses to receive payment from said third-party, based on the fact of being precisely an outsider to the debtor relationship, it would be an unjustified denial and therefore incur in the creditor’s default.
