The impact of public policy on competing interests : a case study of the taxi recapitalization programme.

This study is an investigation of the impact of public policy on competing interests in the case of the South African Taxi Recapitalization Programme. I explore this through a theoretical framework of implementation theory which includes the concept of broader public participation in policy formulation and implementation processes and the significance of a bottom-up approach in decision-making. I employ a qualitative methodology comprising fieldwork interviews, surveys and focus groups. The findings of this study show that for the recapitalisation programme to achieve its objectives of regulating the mini-bus taxi industry, conditions that enable interests to access, bargain and influence decision-making must be redefined. Broader representation has to be encouraged in order for diverse interests to be reflected in policy outcomes and for implementation to be effective. This includes the recognition of other taxi organisations, the integration of the taxi industry into the legal frameworks of the Department of Labour, a structural and functional transformation of the Transportation Board and the application of an innovative violence reduction framework which includes an effective route-regulation and route-based operating-license system. This also requires the introduction of a taxi industry-specific minibus fleet, a comprehensive taxi driver-training programme and, possibly, subsidising the taxi industry. If the TRP does not become the framework through which the taxi industry is comprehensively regulated, violence is curbed and road accidents that include mini-bus taxis are drastically decreased, many more lives will be lost, thus contradicting the principal objective of commuter safety. / Thesis (M.A.)-University of KwaZulu-Natal, Durban, 2009.

Towards an outcomes-based policy evaluation framework in South Africa.

This is a qualitative research study undertaken to explore the extent to which Evidence based and Results based management approaches are being applied in SA in the area of public policy, with the aim of improving policy performance feedback. The orientation of this study was influenced by the problem statement which is stated in Chapter 1 as the general absence of reliable and appropriate performance information that is required to evaluate policy performance and gauge the impact of government‘s policy decisions. Reviewed literature, in Chapter 2, shows that generation and utilisation of reliable performance information, to a large extent, depend on the effectiveness of an evaluation system that is outcomes-based and embedded in a functional evidence-based system. Thus chapter 2 attempts to explain processes (mechanisms and practices) that lead to the availability and utilisation of reliable and credible performance information. Chapter 2 assists the researcher to answer the secondary research question of this study; which is, does embedding a monitoring and evaluation system in an evidence-based system contribute to an outcomes-based and accountable government? This study, though critical of the emerging policy evaluation framework in SA, acknowledges efforts made in the policy arena since 1994 (which is discussed in chapters 3). Thus, in identifying challenges, this study seeks to take a prospective approach that would outline the issues which government must grapple with in order to successfully institutionalise an outcomes based policy evaluation system. In this study institutionalisation of an outcomes-based policy evaluation system refers to the creation of a monitoring and evaluation (M&E) system which produces monitoring information and evaluation findings which are judged valuable by key stakeholders, and are used in the pursuit of evidence-based decision making (Mackay 2006:5). Based upon the findings of this study, the researcher concludes that the government has adopted a technocratic approach to monitoring and evaluation, paying little attention to the broader institutional and systemic issues. At the core of the matter is an under-emphasis of the political influence on the effectiveness of the evaluation systems. This study further argues that even the recent public reforms, driven through the newly established Performance Monitoring and Evaluation Ministry, continue to advocate for this technocratic approach with little or no consideration of the political environment within which evaluations are supposed to be executed. Therefore the researcher recommends that in order to institutionalise the Outcomes-Based policy evaluation system, interventions should be made at different levels; that is, political and administrative levels. Political interventions would entail reforming the current electoral system, and strengthening the role and capacity of parliamentary organs. On the other hand, administrative interventions would entail accelerating differentiated evaluation support programmes, strengthening financial accountability and budget allocation mechanisms. This study found that, despite government‘s much publicised intentions of implementing an outcomes-based approach through the GWM&ES, most government departments are far from implementing outcomes-based policy evaluation systems. Evaluation culture is weak and, if done, evaluations only occasionally inform strategic directions of the departments. This in turn discourages departments from conducting evaluations. The extent to which departments have applied the GWM&ES is the subject of this research. The development of the informal economy as a livelihood strategy amongst resident students at Howard College campus.

The marginalization of black people from the formal economy has led them to the informal economy. This is due to the country’s macroeconomic policies which have made the country’s economy develop unevenly. The uneven development draws black people who lack skills and are unable to find employment, to engage in informal economic activities. Engaging in informal economic activities enables those marginalised by the formal economy to generate a livelihood from the informal economy. As a result, parents and guardians of the youth struggle to pay tertiary fees and provide a sustainable livelihood for their sons and daughters. In turn, these sons and daughters begin to engage in informal economic activities by selling goods and providing services to other students in their rooms at residence. The selling of goods and providing services is a means to generate a livelihood in order to survive at tertiary, subsequently students become businessmen and businesswomen who own their own small businesses irrespective of the scale of the business. From the government’s perspective, there have been many initiatives, strategies and frameworks to promote small businesses and youth entrepreneurship amongst the youth. Inclusive education policy and practice : investigating the educational rights and needs of learners and students with visual impairments in South Africa

Focus This thesis investigates inclusive education policy and practice in South Africa. In this context, particular focus is given to the rights and needs of visually impaired learners and students. Background Due to the dual segregated education system, as at 2001, approximately 280 000 disabled children did not have access to education at school. The special schools system fostered inequality and discrimination of disabled learners from an early age. This stood in tension with the South African Constitution and was not in line with international trends. This ‘normative tension’ and lack of alignment with evolving international practice led to a shift towards an inclusive education system as a policy preference. Policy In 1996 the Constitution and the South African Schools Act prescribed that everyone had the right to basic education and should not be discriminated against on any grounds. Mainstream schools catered for able-bodied learners, and existing legislation did not automatically equip schools and teachers with resources and training to accommodate disabled learners. To enable directives to obtain these objectives, Education White Paper 6 was passed in 2001. This policy documented Government’s intent to implement an inclusive education system by 2021. Investigation The educational needs of visually impaired learners were identified and discussed. An analysis of White Paper 6, highlighting its strengths and limitations in light of the identified specialised educational needs, was conducted. Research was undertaken in mainstream schools, special schools and universities to assess the progress of the implementation process. Challenges impeding the process including untrained educators, insufficient funding, and no established provisioning norms were identified. Inclusive education has its foundations within social rights theory. Education, like other basic social rights is a justiciable right which the State must uphold. However, like all normative wish lists of rights, limited resources, competing claimants and policy trade-offs are inevitable, more especially in a developing country. As a result budgets, utilisation of funds and accountability of the Department of Education were also investigated. An examination of the extent of, and public participation in, public policy decision-making : the case of the name changing of St. Lucia Wetland Park to Isimangaliso Wetland Park.

This is a study of public participation which is located within context of the current policy processes that are occurring across South Africa whereby local municipalities are re-naming streets and buildings to more broadly reflect the heritage of South Africa and its people. The process has suffered drawbacks across the country and commentators point to poor public participation, consultation and public engagement. The process of name-changing proves a need to pose some critical questions about the nature of policy implementation in a democratic South Africa. I look at this through the theoretical framework of public policy implementation. In this study I examine the process of public participation in the changing of the name St. Lucia Wetland Park to Isimangaliso Wetland Park. I adopt a qualitative research approach comprising of semi-structured interviews and surveys. I explore four key questions. First, what was the public policy decision-making process that was followed in the renaming of St. Lucia Wetland Park as Isimangaliso Wetland Park? Second, did the re-naming of St. Lucia Wetland Park as Isimangaliso Wetland Park include participation and consultation in the decision-making processes by the public who reside and work in the area? If so, what type of consultation did this include and what was the extent of the participation? Third, to what extent is this new name accepted or rejected by the public who live and work in the area? Is the acceptance or rejection of the name dependent upon levels of consultation, dependent upon the historical significance of the new name, or on something else altogether? Fourth, what implications does the acceptance or rejection of the new name have for processes of public participation in public policy decision-making in the future and for theories of implementation? I find that, despite no proper process of consultation, the community who live and work in the area accept the new name of the park. They do so for three reasons. First, the community do not treat the park as theirs. Second, they have never been participants in previous decision-making processes. Third, the new name represents a history and heritage that they claim as their own. Public participation in local government in South Africa : a case study on decision making in street naming in KwaMashu township of the eThekwini Municipality.

This research is aimed at investigating public participation in street naming in the KwaMashu Township of the eThekwini municipality in South Africa. Public participation in policy decision-making in post-apartheid South Africa has been characterised by conflict and contestation. Authentic public participation in local governance has been the subject of considerable research and the concept is often regarded as an ideal because of the numerous challenges associated with the practical implementation of authentic public participation in post-apartheid South Africa. Decision making in local governance is meant to be grounded on public participation. However, the realisation of authentic public participation in decision-making in local governance remains a challenge for local government in South Africa. In this study, I examine the process of public participation in street naming in the KwaMashu Township. I employed public participation as my theoretical framework. I adopted a qualitative research methodology which comprises of semi-structured interviews and documents analysis. Four key questions are explored in the study are as follows: firstly, what is the contextualization and understanding of public participation in the eThekwini municipality? Secondly, what is the extent of public participation in street naming, in the KwaMashu Township of the eThekwini municipality? Thirdly, how does public participation in street naming in the KwaMashu Township, influence decision making within the eThekwini municipality? Fourthly, how does political party affiliation impact on public participation in KwaMashu Township? Results of the research study indicate that community members in the KwaMashu Township do not share common perceptions of the extent of their participation in the street naming process. The study further reveals that community participation in issues of local governance in KwaMashu, are influenced by political affiliation of community members. A critical assessment of the impact of involuntary resettlement on the lives of Basotho people : the case study of Lesotho Highlands Water Project, Lesotho.

The aim of this research project is to explore the socio-economic and environmental effects experienced by the relocated population at Lesotho Highlands Water Project (LHWP). Large dams are constructed for irrigation, generation of hydroelectricity, consumption and so forth. In the case of Lesotho, the LHWP was constructed with the purpose of selling water to South Africa to earn royalties and generate hydroelectricity. Despite the fact that a number of factors are advanced to justify the construction of large dams, phenomenal experience has shown that the consequences emanating from their construction are sometimes irreversible and painful, for instance resettlement. This research study therefore sought to investigate the socio-economic and environmental impacts experienced by the affected community emanating from LHWP resettlement programme at Ha Thetsane and Ha Makhalanyane; whether the standard of living of resettlees as measured in terms of access to services has improved or not; the extent of their participation in the resettlement programme; their perception on their standard of living; the extent to which the people have adapted to their forced removal from their homelands; investigate the compensation process; and make tailored recommendations concerning the environmental impacts of involuntary resettlement on the lives of the Basotho people. Qualitative approach was used to collect both primary and secondary data. Literature review was undertaken to provide background information to the problem statement, the methodology design, the theories and other factors used to justify the construction of large dams. The existing literature led to a deeper understanding of the impacts of larger dams, reaction towards construction of large dams and Lesotho’s experience regarding the construction of large dams. Interviews were also conducted. The data collected were written into descriptive analysis form. The resettlement programme at Ha Thetsane and Ha Makhalanyane has resulted in both positive and negative impacts. The study has concluded that there is a need to engage all the stakeholders affected by involuntary resettlement through a transparent public participation process; consider more sustainable means of livelihoods; furnish resettlees with information on the options to enable them to make informed decisions; fulfil promises in order to build trust with the resettlees. / Thesis (M.Soc.Sc.)-University of KwaZulu-Natal, Durban, 2011.

Policy networks and environment policy making and implementation : the case of the Pietermaritzburg Chamber of Business (Msunduzi Municipality)

Public policies are not designed and implemented in a vacuum. Instead, policy design and implementation are processes which require that all relevant stakeholders be involved in all stages of a policy process. It is for these reasons that this study was undertaken. Environmental policy implementation has proved to be a challenge for most municipalities in South Africa. The municipality which was chosen by this study as a case study is Msunduzi Municipality. Faced with different challenges which are attributed to a lack of resources and appropriate forms of organisation which are required for environmental policy implementation, this Municipality has struggled to meet its responsibilities. Street traders, regulation and development in the eThekwini Unicity : an assessment of the new informal economy policy.

This research paper looks at the issues that arise when implementing the regulatory regime governing street trading in the city of Durban. It does three things. First, it provides a comprehensive overview of the context of the street trading policy environment, in an attempt to set out the various discourses surrounding street trading regulation in the eThekwini municipal area from colonial times till the present. Second, the paper looks at the institutional profile of street trading and related issues within the operations of the city bureaucracy as part of the argument that its structural location determines, the attention and support that the sector gets. Consideration of related institutional variables such as location, budgeting, management strategy, and human resources revealed that the paradigm shift proposed by informal economy policy has occurred to some extent. However there are views that the organizational logic and culture of the municipality undermines speedy problem-solving mechanisms. Third, the paper explores issues that have to do with the impact of the changing regulation and institutional environment on the operations and livelihoods of street traders. Regulation is operationalised as registration, spatial allocation, enforcement and system capacity. The engagement of women in the student government of the University of KwaZulu-Natal with the organizational mandate so as to transform the politics in terms of policy.

Although the political participation and representation of women has been increasing in South Africa, in other political sectors, this is debatable. In other words, the transformed nature of South African government institutions suggests that in politics, gender transformation has been achieved. While this may be true of the national government, the same is the contested terrain in as far as other levels of political activism are concerned. For example, a look at student politics raises questions on the idea that there is gender equality in South Africa political sphere. Furthermore, there is an assumption that when women are in governance, they use their positions to influence policies to be responsive to issues that affect women. Even this is a highly contested debate, particularly in the context of student politics. In the context of South African institutions of higher learning, Student Representative Council (SRC) is a body through which students are represented in governance of such institutions. In most institutions of higher learning, SRCs have been dominated by male students. However, there has been development which has seen more women getting into SRCs, and this development is credited to policies of individual institutions as well as that of the student political movements which provide for gender transformation. The genesis of gender transformation in student politics has been on the question of presence. In other words, the focus has been on ensuring that women are part of the composition of the SRCs (descriptive representation). And when descriptive representation has been achieved, the focus will extend to the notion of substantive representation. It was therefore important for this study to use a specific institution, University of Kwa Zulu Natal (UKZN) and explore the composition of its SRC with the aim establishing whether the representation of women is descriptive or substantive in nature or even both. The point of entry was to acknowledge the presence of women in the SRC. In exploring the nature of their representation, the researcher focused on how they engage their political movements and the mandates thereof in order to advocate for the feminization of policies. The findings of this study firstly reveal that the SRC of UKZN has not achieved the descriptive representation of women, let alone the substantive one. This needs to be elucidated on. While there are some women in the SRC, their number is too small which is 10 out of 60 and that equals to 16.6%. Politics being the game of numbers, this would naturally make it hard for women to exert a lot of influence. Furthermore, this is a lot less than the target of the vanguard political movements. Secondly, of all the women that are in the SRC, only a small number of women indicated to be contributing a lot of substance in promoting the gender transformation agenda. What separates these women from others is political experience and will power which may translate into capacity.
