Surmounting Trade Barriers: American Protectionism and the Canada-United States Free Trade Agreement

This thesis examines US protectionism in the 1980s from Canadian and American perspectives, and its role in Canada’s pursuit of the historic 1988 Canada-US Free Trade Agreement. It analyzes the perceived “threat” of protectionism and evaluates the agreement’s provisions against Canada’s goal of securing access to the US market. It contends that US protectionism was crucial in the Mulroney government’s decision to negotiate a bilateral agreement and was a contentious issue for the agreement’s critics. US sources, unexamined in existing historiography, confirm the increased threat of American protectionism, but emphasize a distinction between the threat and implementation of protectionist trade law. Although the agreement did not shield Canada from US trade remedies, Canada gained important presence in the trade dispute process. These conclusions are drawn from Canadian and American media and government documents, 1980s academic and think-tank commentary, legal documents, the memoirs and diaries of major players, and select archival sources.

The topic of this final thesis is EU-China relations since 2000. EU and China are both relatively new actors in the international relations. EU and PRC both have certain potential for the future. EU is an organization of 27 member states, which together make the biggest world economy. China is under Chinese Communist Party leadership; it has the biggest world population and large and fast growing economy. Diplomatic relations were established in 1975 and since then, EU and China have been cooperating in political, economic and other areas. Since 2003 there has been a strategic partnership, which now includes more than 50 sectorial dialogues. On the other hand, there are some problems and drawbacks in the bilateral relations: human rights, Tibet, Taiwan, arms embargo and trade disputes. In this thesis it is examined, whether economic cooperation or European values (human rights, democracy and rule of law) are more important in mutual relations.

LEGAL FRAMEWORK OF INTERNATIONAL TRADE DISPUTES RESOLUTION IN THE CZECH REPUBLIC AND IN FRANCE Comparative study of legal regulation in the Czech Republic and in France with emphasis on point of view of extent and limits of parties' autonomous will within dispute resolution ABSTRACT In relation to an important and continuously increasing growth of international trade and economic cooperation, a logic and proportionally increasing fact occurs, namely the existence and necessity of resolution of disputes arising out of such cooperation and business relationships. This dissertation focuses on specific area of such relations - on solution of property disputes in international trade and business relations arising out on private law basis between entrepreneurs and which affect in any manner the territories, more precisely the jurisdictions and the legal orders of two particular states, and that of France and the Czech Republic. The aim of the dissertation is to examine the extent of autonomous will, which the parties may assert within various methods of disputes resolution and to notify of its limits set by the respective legal regulation.
