This thesis deals with marketing of the serious Czech newspapers (HN, LN, MF DNES and Právo) with a focus on possible models of their brand valuation. The main goal of this work is a marketing analysis of the four subjects using the electronic data sources. The analysis includes basic information about the publishers, their property relations and economic results for the period from 2005 to 2009. After that follows the introduction of the studied newspapers, including their content description, readers profile and new technologies. The aim of the practical part is also to choose appropriate method for evaluating the brands of the dailies. It was performed an external, financial and SWOT analysis to ensure correct application of the approach. Valuation results showed that the highest financial value has the brand Mladá Fronta DNES, the second is Právo, followed by Hospodářské noviny and Lidové noviny.

This article analyzes the trade name function as a distinctive sign of the economic agents, and the use of it, having in consideration the problems with the confusion between legal entity name, label or business sign, and service mark. Furthermore, it discusses the origin of the exclusive right to a trade name, the proof of its use, and the effects when use of the sign ceases. / Este artículo analiza la función del nombre comercial como signo distintivo del agente económico y su uso, teniendo en cuenta el marco regulatorio actual y los problemas generados por la confusión con el nombre de la persona jurídica, el rótulo de establecimiento o la marca de servicio. Además, se analiza el surgimiento del derecho sobre el referido signo, la acreditación del uso y los efectos de la falta del mismo.

This paper analyzes the evolution of the regulation of trade names in the Andean Community and Peru, specifically in regard to its scope of protection from the provisions of article 8 of the Paris Convention (CUP). Also from certain rulings by IndecopI and the Court of Justice of the Andean Community, this paper contains a proposal of amendment to Decision 486 of the Andean Community and the legislative decree 1075 to update the regulation of trade names to modern times and ensure that the settlement of disputes involving said legal figure provide predictability and legal certainty. / El artículo analiza la evolución de la regulación del nombre comercial en la Comunidad Andina y en el Perú, específicamente en lo que respecta a su ámbito de protección a partir de lo establecido en el artículo 8 del Convenio de la Unión de París para la Protección de la Propiedad Industrial (CUP). Asimismo, tomando como referencia ciertos fallos emitidos por el Instituto Nacional de Defensa de la Competencia y de la Protección de la Propiedad Intelectual (IndecopI) y el Tribunal de Justicia de la Comunidad Andina, se propone una modificación a la Decisión 486 de la Comunidad Andina y al decreto legislativo 1075 a fin de actualizar la regulación del nombre comercial a los tiempos modernos y asegurar que la solución de controversias que involucren dicha figura jurídica proporcionen predictibilidad y seguridad jurídica.
