Soukromoprávní úprava převodu a vlastnictví nemovitostí / Private law treatment of transfer and property ownership

Presented diploma thesis discusses private law treatment of transfer and property ownership. The thesis is divided into several chapters corresponding to the legal issues of property ownership and transfer with a special focus on apartments and commercial space. Legal standards related to real estate are very numerous and extensive. Therefore I chose only legal aspects that are relevant to the theme of the thesis. In the introduction I characterize the most important legal concepts of real estate law, using the case law of The Supreme Court in the Czech Republic such as ownership rights, real estate, land, building, residential and commercial space, law accessories, and other things. The second part of my diploma thesis is composed of topics concerning the institute of property ownership, creation and content of the ownership rights with a special focus on residential and commercial premises including the issue of flats in housing co-operatives. The third part of this thesis is dedicated to the transfer of the real estates based on purchase and donation contract. The following chapter I deal with the ownership transfer of residential and commercial premises as units in the house. Rethinking the property rights of spouses on civil marriage breakdown in Nigeria : inspiration from other countries

This thesis establishes that the redistribution of “matrimonial property” upon civil marriage breakdown is alien to Nigerian Family Law. A complete separation of property system operates in Nigeria. Comparatively, the thesis determines the suitability of some legal precepts existing in Australia, England and South Africa and how they could be employed in Nigeria. While Australia, England and South Africa have progressed with the tides and dynamism of the society, Nigerian law has remained unresponsive to the plight of spouses (especially female spouses) who are mostly financially disadvantaged on marriage breakdown. A default matrimonial property system, which is akin to the accrual system in South Africa, is proposed. The proposed matrimonial property system will preserve the independence and equality of spouses during marriage and upon its breakdown. A case is made for the recognition and enforcement of marital property agreements which will aid spouses in deciding how the financial and property aspects of their marriage will be regulated. The thesis, however, supports the recognition of the redistribution power of the courts, notwithstanding the matrimonial property system in operation. The courts’ discretion, in this regard, must be exercised sparingly, only when the justice of each case demands it. The need to give sufficient weight and valuable considerations to the indirect contributions of a homemaker and caregiver vis-à-vis the contributions of the breadwinner is advanced. The thesis takes the standpoint that concepts of equity and trust could play a vital role in the determination of the property rights of spouses on civil marriage breakdown. The Master´s thesis is focused on optimizing the procedure for the transfer of ownership of agricultural land, which will also form the aim of this work. The theoretical part consists of information on the acquisition of property rights to agricultural land. They also described the basic concepts related to the issue. The practical part is formed at the beginning of the analysis of the situation on the market of agricultural land type arable land species in the selected area. It is followed by the creation of objective work, which is creating the optimal procedure for the transfer of ownership of agricultural land. Conclusion the Master´s thesis contains a description of differences in the transfer of ownership of practice and also a summary of the law legislation in the Czech and Slovak Republics

1 Abstract Transfer of ownership of flats from the cooperatives to its members The aim of this thesis is to analyze the legislative regulation of transfers of ownership of flats from housing cooperatives to their members. This is a hot topic, since there are still many members who have not yet settled legal claims against the housing cooperatives. Attention is paid to the legislation contained in the Act on ownership of flats. In addition, legal regulation in the Transformation Act is mentioned, which introduced legislation on transfer of ownership from housing cooperative to its members. Individual provisions of the Commercial Code, which relates to housing cooperatives legislation, are also being analyzed. The thesis consists of four chapters. The first chapter discusses the formation and development of housing cooperatives, explains its basic principles and mainly characterizes concepts of former housing cooperatives. This introductory chapter also defines the basic terms of the housing cooperatives, such as a cooperative housing and cooperative apartment. The second chapter is interpretation of the contemporary legislation on transfer of ownership of cooperative units. A Model for Optimal Interspousal Transfers in Estate Planning

The problem with which this study is concerned is that of determining the optimal transfer of property from a decedent to his surviving spouse. A secondary problem addressed is whether equity between common law states and community property states in the application of the estate tax provisions has been achieved through the allowance of the marital deduction. From this analysis decision criteria were developed to aid taxpayers and their advisors in determining optimal property transfers to a surviving spouse. Conclusions of the study were the following: (1) The primary concern when formulating an estate plan should be to determine whether any property should be transferred to the surviving spouse. The literature has stressed qualifying transfers for the marital deduction while giving minimal consideration to the wisdom of doing so. This study indicates that in a majority of estates optimal results are obtained by making no transfers to the surviving spouse. (2) Relative after-tax rates of return of the surviving spouse and other beneficiaries are the most important factors in determining optimal transfers to the spouse. This again conflicts with the literature which has emphasized relative estate sizes as the dominant factor. (3) Rates of inflation have minimal influence in determining the size of the optimal transfer. (4) Citizens of common law states are generally favored as opposed to citizens of community property states in the application of the estate tax laws. Citizens of these states have more flexibility in. planning transfers to beneficiaries and may generally do so at a lower tax cost through use of the marital deduction.

Abrégé Cette mémoire est consacrée à la problématique des effets du contrat de vente. Son but est de décrire la législation tchèque et française et de souligner les différences les plus importantes entre elles. La mémoire est divisé en 5 chapitres qui sont encore divisés en souschapitres. Dans l'introduction il est évalué le rôle du phénomène mondiale qui est imputable au contrat de vente. Il est aussi souligné la nécessité de sa réglementation dans les systèmes juridiques différents. En plus, il y a la question de l'intérêt a la comparaison de ces deux législations. Dans le premier chapitre on peut trouver la déscription du premier effet du contrat qui a été mentionné dans cette mémoire - le transfert de propriété. D'abord il faut s'y concentrer a la réglementation du transfert dans la loi et puis aux aménagements des parties dans le contrat qui peuvent modifier ou exclure la réglementation légale du transfert de propriété. Le deuxième chapitre est dédié au transfert des risques sur la chose et son relation avec le transfert de propriété. Dans le troisième chapitre il y a le débat sur l'obligation du vendeur de délivrer la chose qui est l'objet du contrat. The content of this thesis is a comprehensive review of taxes relating to real estate in our country, their detailed analysis and subsequent comparison with the situation of selected countries.
