Beyond Consultation: First Nations and the Governance of Shale Gas in British Columbia

As the province of British Columbia seeks to rapidly develop an extensive natural gas industry, it faces a number of challenges. One of these is that of ensuring that development does not disproportionately impact some of the province’s most marginalized communities: the First Nations on whose land extraction will take place. This is particularly crucial given that environmental problems are often caused by unjust and inequitable social conditions that must be rectified before sustainable development can be advanced. This research investigates how the BC Oil and Gas Commission’s consultation process addresses, and could be improved to better address Treaty 8 First Nations’ concerns regarding shale gas development within their traditional territories. Interviews were conducted with four Treaty 8 First Nations, the Treaty 8 Tribal Association, and provincial government and industry staff. Additionally, participant observation was conducted with the Fort Nelson First Nation Lands and Resources Department. Findings indicate that like many other resource consultation processes in British Columbia, the oil and gas consultation process is unable to meaningfully address First Nations’ concerns and values due to fundamental procedural problems, including the permit-by-permit approach and the exclusion of First Nations from the point of decision-making. Considering the government’s failure to regulate the shale gas industry in a way that protects ecological, social and cultural resilience, we argue that new governance mechanisms are needed that reallocate authority to First Nations and incorporate proposals for early engagement, long-term planning and cumulative impact assessment and monitoring. Additionally, considering the exceptional power differential between government, industry and First Nations, we argue that challenging industry’s social license to operate is an important strategy for First Nations working to gain greater influence over development within their territories, and ensure a more sustainable shale gas industry. / Graduate / 0768 / 0615 / kgarvie@uvic.ca

The people left out of Treaty 8

The story of how and why the Canadian government negotiated Treaty 8 with First Nations living in north-western Canada, and its attitude toward the people whom it casually left out of treaty, provide an excellent example of how the Canadian government approached treaty negotiations in the late nineteenth and early twentieth centuries. Treaty 8 is both typical of the other numbered treaties negotiated with First Nations in the late nineteenth century in western Canada as well as different, in that it was the first of the "northern" numbered treaties negotiated with First Nations.<p> This thesis looks at Treaty 8 in both ways: how it illustrates a common approach to treaty making on the part of the Canadian government, and how it differs from other treaties and other treaty negotiation processes. The thesis also tells the story of the people left out of Treaty 8 negotiations in northern Alberta and north-western Saskatchewan, as well as their struggles to obtain justice for this governmental oversight.<p> This thesis looks at a number of issues related to Treaty 8 which earlier historians have either not focused on or overlooked. The first is that the territory covered by Treaty 8 is greater than the area into which treaty commissioners were sent in 1899 and 1900. The second related point is that the government policy of the time that treaties should be negotiated at as little expense and cost to the government as possible meant that people were left out of treaty negotiations.

When consultation becomes a checkbox, what’s the fracking point?: Colonial constraints on social learning processes in Northeast BC and the Fort Nelson First Nation’s New Approach to resource governance

This Master’s thesis seeks to develop a better understanding of how Indigenous voices can be included in water governance. As a starting point, social learning theory, collaborative governance and Indigenous and Canadian relations were carefully studied. Despite the large body of research on collaborative governance with First Nations and on social learning in water governance, little is known specifically about social learning processes in colonial contexts. Using grounded theory and Indigenous methodologies, this research investigates how the current approach to implementing the Province’s legal constitutional, “duty to consult” affects social learning processes and the inclusion of Indigenous people in water governance. Findings indicate that the laws and policies that have been created based on the Crown’s interpretation of Treaty 8, an agreement signed between the Fort Nelson First Nation and Canada in 1899. This duty to consult constrains social learning, as it does not allow for the flexibility needed for a reframing process that might bring the actors to a common understanding of Treaty 8, the treaty relationship and its application as such today, as a basis for future collaboration. Without reframing processes, the consultation process is perceived by the Fort Nelson First Nation, a Treaty 8 nation, to lack legitimacy and neutral facilitation. Subsequently, consultation is seen as a checkbox that must be completed, but fails to include First Nations’ knowledge, interests and concerns about impacts from development and appropriate accommodation. This research also investigates a new governance arrangement emerging in northeast BC, which changes the way Fort Nelson First Nation voices are included in decision-making. Processes of nation building and capacity building contribute to Fort Nelson First Nation’s New Approach to governance. The New Approach sees changes to the sites of authority, revenue and norms and beliefs, resulting in a governance innovation that circumvents the provincial government’s role in governance by creating a closer working relationship between industry and the Fort Nelson First Nation. The results are development planning and decisions that better reflect the Fort Nelson First Nation’s concerns and interests in the near future. / Graduate

Disruption in place attachment: Insights of young Aboriginal adults on the social and cultural impacts of industrial development in northern Alberta

People living in the north have been and will continue to be affected by increasing exploration and exploitation of the region's natural resources. To understand the human impacts a qualitative approach and sense of place, place attachment, and disruption in place theories were used to analyze the experiences of young Aboriginal adults in a Dene Tha' community in northwestern Alberta. The major finding of this study was that the young people developed deep attachments to their place; however, environmental, social, and cultural changes have altered life here and as a consequence many of the young people no longer want to remain living in their community. The results suggest that the Dene Tha' are being gradually displaced and their homeland is becoming increasingly unable to sustain them or their culture. The findings also indicate that gradual environmental deterioration can lead to profound social and cultural changes that should be considered before land use decisions are made. / Rural Sociology
