Os grupos tripartites parit??rios e a democracia deliberativa

First the origins of the tripartite dynamics is established in the conseils de prud??hommes of XVIII century France, providing a model of workers and employers interaction that would influence the unionization of workers and their movement to obtain international laws regulating work conditions and the creation of a corresponding organization, which came to be the International Labour Organization (ILO). The unique tripartite method of composition and decision chosen by the ILO was integrated on their international conventions, and became one of their principles and international work basic rights. The development of tripartism in Brazil is registered since the creation of the Labour Justice until the recent adoption of tripartite consultations regarding the regulation of work conditions. Then the deliberative democracy theory of J??rgen Habermas is briefly and synthetically exposed, in a framework that shows its basic characteristics as a procedural dynamic centred on the rationality of discourse, which does not substitute institutionalized deliberation, but influences its decisions. Some interpretations of Habermas?? work are listed, and it is presented a synthesized list of it??s main elements. Based on these elements the regulatory process of the tripartite groups in Brazil is investigated thoroughly, and each of the items that characterize the habermasian theory is confronted with the corresponding tripartite dynamics procedure. The conclusion of the work is that the regulatory process of work conditions in Brazil can be considered a habermasian deliberative practice, despite specific discrepancies. / O processo tripartite brasileiro, no qual representantes do governo deliberam com representantes dos empregadores e trabalhadores para revisar e elaborar regulamenta????es das condi????es de trabalho, ?? analisado neste estudo por meio da moldura da teoria da democracia deliberativa de J??rgen Habermas. Em primeiro lugar as origens da din??mica tripartite s??o estabelecidas nos conseils de prud??hommes da Fran??a do S??culo XVIII, proporcionando um modelo de intera????o entre empregadores e trabalhadores que influenciaria a sindicaliza????o de trabalhadores e sua movimenta????o para obterem leis internacionais regulando as condi????es de trabalho e a cria????o de uma organiza????o correspondente, que veio a ser a Organiza????o Internacional do Trabalho (OIT). O singular m??todo tripartite de composi????o e decis??o escolhido pela OIT foi integrado em suas conven????es internacionais, e se tornou um de seus princ??pios e direitos b??sicos internacionais do trabalho. O desenvolvimento do tripartismo no Brasil ?? registrado desde a cria????o da Justi??a do Trabalho at?? a recente ado????o das consultas tripartites tratando da regula????o das condi????es de trabalho. Em segundo lugar, a teoria da democracia deliberativa de J??rgen Habermas ?? breve e sinteticamente exposta, em uma moldura que evidencia suas caracter??sticas b??sicas como uma din??mica procedimental centrada na racionalidade do discurso, que n??o substitui a delibera????o institucional, mas influencia suas decis??es. Algumas interpreta????es do trabalho de Habermas s??o listadas, e ?? apresentada uma listagem sint??tica de seus principais elementos. Em terceiro lugar, baseado nesses elementos, o processo regulat??rio dos grupos tripartites no Brasil ?? investigado detidamente, e cada um dos itens que caracterizam a teoria habermasiana ?? confrontado com o correspondente procedimento da din??mica tripartite. A conclus??o do trabalho ?? a de que o processo regulat??rio das condi????es de trabalho no Brasil pode ser considerado uma pr??tica deliberativa habermasiana, a despeito de discrep??ncias espec??ficas.
