Efectos de las medidas políticas y jurídicas comerciales de la relación entre Perú y la Unión Europea respecto a las agroexportaciones no tradicionales entre los años 2006 y 2016: El caso de los “Novel Foods” y las Medidas Sanitarias y Fitosanitarias

La presente investigación tiene como objetivo analizar los efectos de las medidas políticas y jurídicas comerciales y cómo estas han incidido en las agroexportaciones no tradicionales de Perú a la Unión Europea (UE) durante los años 2006 al 2016; considerando además el sector privado agroexportador y el caso de los “Novel Foods” y las Medidas Sanitarias y Fitosanitarias (MSF). En ese sentido, se analizó en materia política comercial, el apoyo de cooperación de la UE, así como, el incentivo de los programas gubernamentales al sector agroexportador. Mientras que, en materia jurídica comercial, se analizó el efecto de los acuerdos comerciales con la finalidad de evaluar el impacto en las agroexportaciones no tradicionales. Asimismo, se determinó la influencia del sector privado en las agroexportaciones. Por otro lado, se ha de considerar como barreras invisibles para el comercio multilateral, las MSF y el reglamento de los denominados “Novel Foods”, ya que en algunos casos restringe el ingreso de mercancías por la justificación arbitraria de la existencia de estas medidas no arancelarias, que al final no presentan fundamento científico que las avalen. Para ello, se acopió información a través de diversas herramientas metodológicas tales como: datos estadísticos del portal de Adex Data Trade y SUNAT, información pública trascendental y entrevistas a expertos en temas relacionados al sector agroexportador, el caso de los “Novel Foods” y las MSF. / The main objective of this research is to analyze the effects of commercial policy and legal measures and how these have affected non-traditional agro-exports from Peru to the European Union (EU) during the years 2006 to 2016, so as the agro-export private sector and the case of the "Novel Foods" and the Sanitary and Phytosanitary Measures (SPS). In this context, the UE cooperation support was analyzed on trade policy matters, as well as the incentive of government programs to the agro-export sector. While, in commercial legal terms, the effect of commercial agreements was analyzed in order to assess the impact on non-traditional agro-exports. Furthermore, the influence of the agro-export private sector was arranged. On the other hand, SPS measures and the regulation of the so-called "Novel Foods", were considered as a “glass ceiling” to multilateral trade, since in certain cases, it restricts the entry of merchandise by the arbitrary argument of the existence of these non-tariff measures, without having a scientific basis to support them. / Tesis

This retaliatory language, which dates back to Article 40 of China’s Old Regulations, makes China special since there is no other country’s anti-dumping regulation making such an explicit retaliatory message.
