Poškozený a jeho ochrana v trestním řízení / The injured party and his/her protection in criminal procedure

This dissertation considers the issue of the injured party and his protection in criminal proceedings. The aim of the paper is not only to provide a comprehensive summary of the position of the injured party in criminal proceedings, but to make reference to shortcomings in the existing legal regulation of this institute and propose changes for the future. The methods used in the paper are primarily interpretative, analytical-synthetic and comparative. The author made use of information ascertained by studying primary and secondary sources. The paper is divided into four main chapters, in addition to the introduction and conclusion, and these are themselves divided into sub-chapters. The first chapter looks at defining certain fundamental terms directly linked to the issue of the injured party and his protection in criminal proceedings. Here we find an explanation of the term "the injured party" itself, both at a general level and in terms of individual specifics, and the separation of injured parties into two groups. This chapter also includes a definition of the term victim and of ancillary proceedings. The topic of the submitted diploma thesis is "Domestic violence and its prevention". Domestic violence is a societal problem accompanying the society since time immemorial. For a long time this phenomenon has been understood by society only as a private matter and government should intervene only in extreme cases. This state has been changing for the last two decades. Both professional and general public has begun to accept the opinion that domestic violence is a public issue that requires a state intervention. Domestic violence must be perceived interdisciplinary because it is a very complex problem. In the introductory part there is presented a definition of domestic violence and some other terms related to it. The following criminological part describes domestic violence itself, its dynamics, principles and specifics that make it different from other forms of violence. In this chapter, various aspects of this phenomenon are analysed, such as private nature, repetition and longevity, clearly defined constant roles, etc. Further, domestic violence is divided according to its types and forms that are specified in details. The topic of the thesis is domestic violence and its prevention. Domestic violence has been present in society from time immemorial, however only recently it has become a topic of public discussions. Domestic violence is not only a private matter of a particular family but it is a problem of the whole society. The first chapter introduces the issue of domestic violence. It aims at providing definition of domestic violence and it describes its key features (domestic violence is not an one-time act; violence escalates in relationship; everything happens in private; fixed roles are typical). Domestic violence tends to be cyclical when the periods of calm, tension and violence alternate. Victims may be exposed to physical violence, psychological violence, emotional violence, social violence, economic violence and sexual violence. The first chapter also deals with the causes of domestic violence and focuses on the myths associated with domestic violence. The second chapter characterizes and describes a profile of an offender. Cizojazyčné resumé The theme of this diploma thesis is the methodology of the investigation of sexual crimes and its selected issues. Given the large of this topic, I decided to focus only on methods of rape investigation, as a typical represenstative of this group of sexual crimes. The main objective is to identify the problems in the procedure of understanding and investigation. It focuses on the selected specifics which I attent to analyze and evaluate the current legal regulations. To clarify such a large topic, the thesis is divided into seven chapters. The introductory chapter deals with the current legislation of the rape and its historical evolution since the feudal period. This charter compares the Czech legal systém with foreign legal systems. The second chapter provides the statistical data and the typical criminalistics ways of committing this crime which is divided according to committting by adults and committing against children and adolescents. The topic of my thesis is Legal Status of a Victim of Domestic Violence. It is devoted to domestic violence as a contemporary phenomenon and to the legal status of its victim. The purpose of the thesis is to analyse relevant Czech legislation and compare it with the real needs of a victim of such treatment. It attempts to give to the reader a comprehensive overview of this topic and also to suggest some amends aiming at better protection of the victim of domestic violence. The thesis consists of five chapters each of them dealing with different aspects of domestic violence and position of its victim. Chapter one is called The concept of a domestic violence: explanation and is subdivided into five parts. The first part deals with the definition of the concept and its elements. Part two lists kinds and forms of violent conduct. I decided to write about this topic especially because of severity of the consequences caused by this crime to the victim and because of the dangerousness of the offender. Chapter One is subdivided into six parts and it contains the introduction to the topic, in particular the outline of the historical development in this area and analysis of the current legislation with focus on terms which could be difficult to interpret. This chapter ends with presentation of static data regarding to the crime of rape and their graphical representation. I find this topic very interesting. In the past, people concerned only with perpetrators of crimes. The victims were ignored. The situation is better now, nevertheless the position of the victims is not as good as it should be. It is necessary to make some changes, mainly to prevent secondary victimization because it is a big problem the victims must deal with. The injured party in criminal procedure and his/her protection The purpose of my thesis is to analyse position of the injured party and his/her rights in Czech criminal procedure and to highlight changes which will be brought to rights of injured party by The Victim of Crime Act. This thesis is divided into five chapters. The first chapter briefly introduces the historical evolution of legal regulation of the injured party position in criminal procedure in the territory of the current Czech Republic. Next chapter is concerned with the term "injured party" in the current legal regulation.
