v anglickém jazyce Criminal aspects of domestic violence The subject-matter of this thesis are criminal law aspects of domestic violence that is why the focal point of my work is in an analysis of criminal law regulation of domestic violence and criminal offences committed in connection with it. Beside that I have tried to provide a general review of a phenomenon called domestic violence, of its character, basic attributes, types, effects and controversial issues. One chapter is about the regulation of criminal procedure, particularly about a victim's right of disposition and the new Victims of criminal offences Act. In the last chapter I have tried to analyse a few cases and show the most important criminal aspects of this issue.

(Aj) Domestic violence and its prevention This diploma thesis handles comprehensivly topic of domestic violence and its prevention. It is a very serious social problem. Home of victims of domestic violence turns into a place full of abuse and fear. Violence against close persons is committed since time immemorial but in the interest of the professional public was given only a few decades ago. The aim of this thesis is to describe crimiological aspects of domestic violence and to introduce legal regulation system related to this phenomen. Unfortunately domestic violence occurs often with high latency and everyone could be a victim. To eliminate this type of violence it is especially important to know this phenomenon well and to put these findings into awareness of society because in the society number of myths regarding domestic violence still remains, which makes preventing such violence more difficult and causes secondary victimization. The first part of this thesis shows how dangerous phenomen domestic violence is. It defines domestic violence, describes its characters, categories, forms of used violence and causes of this kind of violence. Criminal aspects of domestic violence SUMMARY Domestic violence is a serious social concern with high level of latency. The domestic violence victims protection is ensured by legal standarts of Civil, Administrative and Criminal Law and other legal standarts. Criminal Law is one of the important instruments for tackling of serious forms of domestic violence. However Criminal Law is an instrument "ultima ratio" which needs claiming of subsidiarity principal of the crime repression. The purpose of my thesis is to bring a summary of the legal standarts of Criminal Substantive Law and Criminal Procedure, that are dedicated to protect the victims of domestic violence. It also provides the brief analyses of the legal standards with respect to this serious phenomenon. The emphasis is put particularly on the criminal offences maltreatment of a person living in common domestic matters, maltreatment of a person in a guardianship and stalking. From procedural point of view the thesis addresses the issue of the consent of the victim to the criminal prosecution, institute of detention and the status of victims in criminal proceedings. Domestic violence and its prevention The thesis is concerned with the problematics of domestic violence and its prevention. The aim of the thesis is to analyze the legal institutes that are provided by the Czech legislation for protection against domestic violence. The thesis is divided into six chapters each of which adresses special aspects of the problematics. The first chapter introduces the phenomenon of domestic violence. It tries to define the notion of domestic violence, describe its features and forms so that these pieces of information can be used in further parts of the thesis. Subsequently, it deals with theories that try to explain the causes of domestic violence. The second chapter is concerned general characteristics and personal traits of the perpetrator. Attention is also dedicated to gender aspects. The third chapter concentrates on general characteristics of the victim and adresses the process of victimization, i.e. the transformation of a potential victim into a real one. Presented thesis is focused on a comprehensive analysis of domestic violence and its prevention. Domestic violence can be described as a deeply rooted socially pathological phenomenon about which the society dares to talk more and more openly over the last few decades. Its unique characteristic does not lay in the form of violence the victim has to endure but in the place in which the violence occurs. It is a private family environment which is hidden from the sight of the public. Due to this aspect domestic violence is not only a serious problem but also a problem that is very difficult to detect and repress. Because of this it is vital to access domestic violence with great care, consistency and expertise. In the first part the thesis focuses on theoretical description of domestic violence, presents possible definitions of the concept, states the characteristics of domestic violence and refutes certain myths which trivialise this social problem. Further in this part an overview of typology of domestic violence and forms of violent conduct is included. Legal protection of the victims of domestic violence In my thesis I focused on such a sensitive and very actual topic as domestic violence, especially from the perspective of existing legislation on protection of victims and also from the perspective of possible approaches to the possible solutions of this phenomenon. Despite the development of the legislation in recent decades the occurrence of domestic violence is still a major problem of modern society, mainly because of the fact that it usually takes place in private situations between the offender and the victim in a domestic environment "behind the closed doors" and the concerned persons are usually in close relationship. In my thesis I tried to focus on the phenomenon of domestic violence mainly from the perspective of the victims and their legal protection. I tried to define domestic violence by defining the necessary concepts, and also from the perspective of existing legislation of this phenomenon, including a description of previous development. Možnosti ochrany před domácím násilím / Protective options against domestic violence

Diploma thesis "Protective options against domestic violence" deals with one of the serious problems of the current populations, which is domestic violence. The work is focused on one slice of the problem, namely to address the protection of victims of domestic violence. In this work are described and analyzed the possibility that victims of domestic violence can use to protect themselves. There are also mentioned institutions, which provide protection to victims. The options of protection of the victims of domestic violence were compared with each other and then with the means of protection in neighboring states. The comparison showed that the most effective mean of protection against domestic violence in the Czech Republic is expulsion and that in the Czech Republic, the institute used much less frequently than in neighboring states. The paper also verified the hypothesis that there are links between the numbers of cases of domestic violence, unemployment figures and the number of violent crimes. Comparison showed that these phenomena are closely related. Finally, the proposal was stated to be better protection of victims of domestic violence, namely strengthening the authority of victims of domestic violence in divorce cases.

- Criminal-law protection of victim of domestic violence The aim of the thesis is to summarize and evaluate the issue of legal protection of domestic violence victims in the Czech Republic, especially what concerns criminal law. In the first part of the thesis, the author deals with the definition of domestic violence and issues associated with it. Attention is paid to the features which must be present so that violent behaviour may be considered domestic violence. The work also mentions the types and causes of domestic violence, as well as myths that are rooted about it in society. In addition, this chapter also focuses on the characterization of the perpetrators and victims of domestic violence. The second chapter discusses the development of the society's attitude towards solutions of domestic violence. It focuses on the breaking point when society realized the need for changing its attitudes towards domestic violence. Объектом исследования являются психологические особенности женщин, подвергшихся насилию. Предметом исследования являются личностные особенности женщин-жертв насилия со стороны партнеров. Магистерская диссертация состоит из введения, двух глав, заключения, списка литературы (68 источников, 6 из них на иностранном языке) и приложения, включающего в себя бланки применявшихся методик. Объем магистерской диссертации 68 страниц, на которых размещены 14 рисунков. Во введении раскрывается актуальность проблемы исследования, разработанность проблематики, ставятся цель и задачи исследования, определяются объект и предмет исследования, формулируются гипотезы, указываются методы и эмпирическая база, а также этапы проведения исследования, научная новизна, теоретическая и практическая значимость работы. Первая глава включает в себя обзор иностранной и отечественной литературы по теме домашнего насилия. Представлены разделы, посвященные исследованию насилия как психологического феномена, проблем его появления во взаимоотношениях партнеров, а также психологических предикторов женщин, ставших жертвами домашнего насилия. Выводы по первой главе представляют собой итоги по изучению теоретического материала. Вторая глава посвящена эмпирической части исследования. The subject of the study is the personal characteristics of women victims of partner violence. The master's thesis consists of an introduction, two chapters, a conclusion, a list of references (68 sources, 6 of them in a foreign language) and an appendix that includes forms of the methods used. The volume of the master's thesis is 68 pages, which contain 14 figures. The introduction reveals the relevance of the research problem, the development of the problematics, the purpose and objectives of the research are set, the object and the subject of research are determined, the basic and additional hypotheses are formulated, the methods and the empirical base are specified, as well as the stages of the research, the scientific novelty, the theoretical and practical significance of the work. The first chapter includes an overview of the domestic and foreign literature on the subject of domestic violence. Sections are presented devoted to the study of violence as a psychological phenomenon, the problems of its appearance in the relationship of partners, as well as psychological predictors of women who have become victims of domestic violence. Conclusions on the first chapter are the results of the study of theoretical material. The second chapter is devoted to the empirical part of the study. It provides a description of the organization and methods of the study and the results obtained using all the methods used: methodology "Level of subjective control (LSC)" (E.F. Bazhin, E.A. Golynkina, A.M. Etkind, 1984); methodology for assessing the propensity for victim behavior (O.O. Andronnikova, 2005); the Rosenberg self-esteem scale (M. In conclusion, brief results of the theoretical and empirical parts of the work are presented, as well as conclusions on the hypotheses. Problematika domácího násilí v souvislosti s působením zákona č. 135/2006 / The Issue of Domestic Violence in connection with the act (number ) 135/2006

Domestic violence has been an urgent problem also in the Czech Republic. The necessity to solve its complexity upon level of the state, not only through non governmental, non-profit-making institutions, is especially expressed by adopting Act No.135/2006 Collection of Laws, by which some acts in scope of domestic violence protection are amended. This Act allows the Police of the Czech Republic to banish an offender committing domestic violence from mutual residence for a period of 10 days and the Act has established a new social service the so called ``Intervention Centre{\crq}q, i.e. a specialized facility that provides help with people who are endangered by domestic violence. The objective was to find out the level of public awareness, knowledge of the Intervention Centres in the Moravia-Silesian and Pilsen Regions. Within the first year of that Act operating, there were the least banished offenders v. s. number of inhabitants, just in the Pilsen Region and there were the most ones in the Moravia-Silesian Region. The theoretical work part describes forms of violence in the family, historical relationship of violent actions with women, possibilities how to prevent them or advised help measures to victims of domestic violence. Further, it is focussed on a legislative solution of that problem area in the Czech Republic and some of European countries or the USA as well. The practical work part involves results of a quantity research that was aimed to discovery of public awareness of the Intervention Centres. The research was performed by method of questioning in a way of a questionnaire. The research was focussed on consciousness of general public relating to domestic violence, whether the research respondents have ever met that phenomenon or what is their opinion on information effectiveness of the problem area. The research demonstrated low awareness of the Intervention Centres of inhabitants in both regions. However, most respondents know what domestic violence is. Nearly one third of interviewees have got certain experience with domestic violence. Majority of respondents consider the information on the Intervention Centres and domestic violence as generally useful. This work may be used to increase public awareness of the Intervention Centres or on the other side to provide the Intervention Centres employees with general public{\crq}s reflection as to availability and activity of the Intervention Centres.
