En el presente trabajo se evaluó la medida consistente en la prohibición de ingreso a locales comerciales a no vacunados contra el Covid-19 a la luz de la normativa peruana de protección al consumidor a iniciativa de los proveedores, con el fin de determinar si esta incurría o no en un supuesto de discriminación. En ese sentido, se tomó en consideración si esta medida se encontraría o no justificada por un motivo razonable y objetivo, conforme lo requiere nuestro Código de Protección y Defensa del Consumidor. Así pues, se evalúa que nos encontramos atravesando una pandemia global que, como país nos afecta en diversos ámbitos, teniendo una especial incidencia en el ejercicio del derecho a la salud de las personas, siendo que el Estado Peruano se encuentra en la obligación de garantizarlo en concordancia con los compromisos internacionales asumidos y su normativa nacional. Dado el nivel de afectación que tiene la enfermedad del Covid-19 es necesario que se adopten todas las medidas posibles para procurar controlarlo y/o combatirlo, siendo que los privados también pueden contribuir desde su ámbito de control. Ahora bien, en tanto que la vacuna contra el Covid-19 tiene estudios que demuestran que, a la fecha, es el mejor método que como sociedad tenemos para reducir el contagio e, incluso, evitar que aquellos que enfermen lo hagan gravemente, se vuelve evidente que la medida se encuentra justificada. / In the present investigation, the main topic is evaluate the prohibition of entering to business premises for those who are not vaccinated against Covid-19. This measure was studied from the perspective of Peruvian consumer protection regulations, in order to determine if this was incurred or not in a case of discrimination. In this sense, it was taken into consideration whether or not this measure would be justified for a reasonable and objective reason, as required by our Consumer Protection and Defense Code. Thus, it is appreciated that we are going through a global pandemic that, as a country affects us in various areas, having a special impact on the exercise of the right to health of people, being that the Peruvian State is under the obligation to guarantee it in accordance with the international commitments assumed and their national regulations. In this sense, given the level of affectation that the Covid-19 disease has, it is necessary that all possible measures be adopted to try to control and combat it, since private parties can also contribute from their scope of control. Now, while the Covid-19 vaccine has studies that show that, to date, it is the best method that we as a society have to reduce contagion and even prevent those who become seriously ill from doing so, it becomes obviously the measure is justified.
