Non-material damage in health injury and decision making in adhesive (criminal) proceedings Abstract The diploma thesis focuses on current legislature, issues and questions regarding compensation of non-material damage (non- property harm), specifically health injuries in adhesive proceedings. The topic presented hereby is a relatively young field of interest in the Czech law system, moreover it has gone through relatively dynamic development recently. The topic of the diploma thesis is effectively linking criminal, civil and health (medical / health care) law. The diploma thesis presents an outlook on the concept of non-material damages from the point of view of civil law and outlines the concepts of injured party and adhesive proceedings belonging to the criminal law field. The diploma theses presents an insight into the terms of liability and criminal liability and it also briefly concerns the criminal liability in health care. The diploma thesis presents some of the selected criminal offences (crimes) against human life and health. Current issues of collateral proceedings This thesis deals with one of the current issues of the so-called collateral proceedings, namely the compensation for non-material damage in the case of bodily harm and compensation for non-material damage in the case of killing or particularly serious bodily harm in these proceedings. This issue is very topical mainly due to a fundamental change in the legal regulation of the compensation for non-material damage in question brought by the Civil Code in 2014. This topic is also very specific as criminal, civil and medical law intertwine in it. The thesis contains chapters occupying on criminal law institutes of the injured party and collateral proceedings, which are topics closely related to the focus of this work and their explanation should be included in the thesis for the purpose of understanding of the selected topic. However, main part of the work focuses on the private law regulation of the compensation for non- material damage in the case of bodily harm and compensation for non-material damage in the case of killing or particularly serious bodily harm according to sec. 2958 and sec. 2959 of the Civil Code. An injured party in criminal proceedings and his/her protection The diploma thesis deals with the position of the injured party and his protection during the entire criminal proceedings and a description of the rights at his disposal in its individual phases. It draws information from legislation, literature, case law and electronic resources. The diploma thesis is divided into five chapters. The first includes the definition of the term injured party, both its positive and negative definitions. It also describes the differences between the terms 'injured party' and 'victim of a crime'. The second chapter focuses on the description of the rights that belong to all injured, as well as those that belong only to the injured, who have the status of a subject in adhesion proceedings under § 43, paragraph 3 of the Criminal Procedure Code. The most important of these rights are characterized in more detail. It is also describing the possibility of injured party to waiver his procedural rights and analyzing the problem of partial waiver. Presented master's thesis is focused on the experimental research of the sanding parameters in order to improve adhesion in the contact between wheel and rail. Sanding is the application of the sanding material directly in the wheel/rail contact. It is still common, most effective and traditional way how to deal with low adhesion problem, which is mainly caused by environmental contaminants. Research is important for the better understanding of the sanding process and also provides data, which are necessary for it's optimization and efficiency improvement. Newly developed twin-disc machine was used to carry out the presented experimental research. The influence of common contaminants on the adhesion is investigated, considering various operating parameters. Different amount of the applied sand is used to increase adhesion in the contaminated contact at various slip and rolling speed. Results show, that there is the amount of the sand, from which no significant adhesion increase occur. Obtained findings and the results presented in this thesis will be used to optimize sanding system, which will contribute to reduce cost associated with sanding and low adhesion.

Current issues of adhesive proceedings This thesis deals with current issues of adhesive proceedings. The thesis is divided into four chapters. The first chapter introduces the basic concepts essential for the definition of adhesive proceedings and related terms. These are primarily the definition of entities and parties to criminal proceedings, including the introduction of the institutes of harm as an overarching term, which includes damage, non-material damages and unjust enrichment. The first chapter also introduces the institute of bodily harm. The second chapter is devoted to the injured party, including a list of procedural rights and obligations that the injured party confers the Criminal Procedure Code and the injured party recognizes the law on victims of crime, if the injured party is also a victim under this law. Introduction: Adhesive technology represents a significant advancement among different treatment options of dental caries. Its advantages involve not only highly aesthetic reconstructions, but also ability to preserve hard dental tissues compared to more traditional filling materials such as amalgam, where the material retention was achieved through undercuts. A potential of adhesive technology to arrest progression of an incipient caries has triggered its wider use in dental caries management, potentiated by an ongoing development of new adhesive systems and composite materials that assure an acceptable long-term stability of adhesive reconstructions. Adhesive bonds of dental reconstructions are in the oral cavity constantly challenged by various mechanical, chemical and biological factors. One of the chemical agents with detrimental potential is peroxide bleaching gel used for teeth brightening. Currently bleaching belongs to the most frequent cosmetic dental procedures. The active ingredient of bleaching gels is hydrogen peroxide or its precursors. Introduction: An adhesive bond between hard dental tissues and composite reconstructions is exposed to mechanical load, water, bacteria, enzymes and different chemical compounds. These factors could impair durability and resistance of composite reconstructions. In contrast with extensive research of negative influence of water on degradation of adhesive bonds, the influence of chemical substances on adhesive bond has not been investigated to a greater extent. Aim: The aim of the experimental part of the thesis was to evaluate the influence of hydrogen peroxide containing tooth-whitening products and mouth rinses containing chlorhexidine and fluoride on a long-term stability of class V composite restorations created using four contemporary adhesive systems by a microleakage method. Materials and methods: The following adhesive systems were investigated: total-etch Gluma Comfort Bond (GLU), and self-etch adhesives Clearfil SE Bond (CLF), Adper Prompt (ADP) and iBond (IBO). Standardized class V cavities were prepared in 192 extracted human teeth (one cervical margin in the cementum and one in the enamel). The second part focuses on the process of concluding a distance contract with a consumer and it discusses the different phases of the process of concluding agreements and the practice of deviation from standard procedures foreseen by law on a practical example of an e-shop. This diploma thesis is dedicated to the development of mobile resonance-adhesion tester TriTec. The aim of this thesis is to improve the parameters of the tester in comparison to the previous version of tester, especially to minimize the vibrations of the tester while running without load, and to the make long-distance transportation of tester easier. The first part of thesis was aimed on history of development of TriTec tester, causes of it´s problems and on analysis of vibration minimization possibilities. As a best solution is considered a rotational balance mechanism, which was designed in next part of thesis. After that a new front wheel drive and an user interface conception were designed. The modified tester reaches all the deserved parameters and is able to compete static resonance-adhesion testers by it´s lower price and high mobility.
