International Protection of Civil Aviation Safety. This analysis is based on the idea that the obligation of states to protect civil aviation against acts of unlawful interference, especially terrorist attacks, has certain limits. These limits find its source in international treaties. States are not only subjects of treaties, which protect civil aviation, but also subjects of treaties, which protect individuals and there human rights. Both kind of obligation should be respected. These days we can see, that states do not respect obligations and principles set by international human rights treaties and justify their invasive interference with human rights by stating that they are fighting against terrorism. Its mostly visible by interference with the human dignity, right to privacy, data protection. But there are also other right which can be affected - for example right to free movement or health protection. In my paper I try to analyse impacts of some measures adopted by states on human rightst and show that they sometimes do not respect requirements, which are set for limitations of these rights. The most important documents I am working with are the International Covenant on Civil and Political Rights and the European Treaty on Human Rights. International protection of civil aviation safety(in particular against acts endangering the safety of aviation). This work deals with issues of the current scope of the international means of protection of civil aviation safety against acts which immediately threaten the safety of air transport. The work is based on the thesis that, through the available international instruments, the safety of civil aviation cannot be ensured. It seems that in practice the appropriate permission takes over UN Security Council, which its resolutions shall establish appropriate sanctions against States that support terrorism are guilty. The UN Security Council by its resolutions No. 731, 748 and 883 and 1192 created a precedent for the avoidance of any negotiations with terrorists, as provided for in the Montreal Convention. Through article 24 of the Charter of the United Nations is entitled to accept the UN Security Council resolution, which opposed the established multilateral antiterrorism Convention in the background. International protection of the safety of civil aviation is fragmented and does not meet the conditions of civil aviation in the atmosphere of 21 st. century. Comprising many airplanes, airports, aircrew, and employees, aviation industry is a large sector that is very vulnerable to attacks, whether it is from terrorists or criminals. Aviation history is fraught with examples of airport bombings, hijackings, and sabotage terrorist attacks. The most destructive of which is the tragedy of September 11, 2001, the cornerstone of today's aviation security policies. This study uses risk assessment tools to determine the dimensions of danger and threats against the aviation industry and addresses how vulnerable the aviation sector is. After vulnerabilities and threats are examined, possible impacts of attacks against the aviation security are discussed. This study also explores the pre and post September 11 policies that governments and policy makers develop to reduce risks in aviation sector. In addition, it discusses weaknesses and strengths of these policies which surfaced during the implementations. Finally, this study proposes some recommendations based on vulnerabilities and threats of aviation security.
