1 The purpose of this thesis is to discuss the main aspects of the Czech legal regulation of the arbitration proceeding under the view of the particular Western European national and international legal orders. By doing so, the author strives for critical review of the arbitration proceeding as per the Czech legal order under the worldwide perspectives and with the prism of modern Western European and world legal theory of the arbitration proceeding. The intention of such research is to determine if the contemporary Czech legal regulation of the arbitration proceeding is in conformity with the modern theory and practice of the arbitration proceeding. This thesis also aims to answer a question whether the Czech courts shall have the right to review the application of law by the arbitrators. The author is seeking to answer this question by comparing the the Czech, or rather Continental system of law with the law of England and Wales.

Arbitral Reaction to Alexander v. Gardner-Denver Co.: An Analysis of Arbitrators' Awards, April, 1974-1980Owens, Stephen D. (Stephen Dennis) 08 1900 (has links)
The purposes of this study were: (1) to present data resulting from an analysis of the ninety-seven published grievance-arbitration awards involving issues of racial discrimination occurring between April 1, 1974, and December 31, 1980? and (2) to determine from the data how labor arbitrators have reacted to Alexander v. Gardner-Denver Co., 415 U.S. 36 (1974) . The Supreme Court held that labor arbitration was a "comparatively inappropriate" forum for the resolution of employment discrimination disputes. However, the Court said that an arbitral award could be "accorded great weight" by a lower court when certain relevant factors are present in an award. The cases were analyzed to determine the extent to which arbitrators responded to the factors set forth in the Gardner-Denver decision.

This article present a way to analyze the motivation for arbitration awards and how it should be evaluated by the judges of the Judiciary at the time of the annulment proceedings. The objective is give elements such as the state of the normative question, the factual situation of the case and the structure argued for the definition in order to analyzing, from the simplest level, whether an award is motivated or not. / El presente artículo busca presentar una forma de poder analizar la debida motivación dentro de los laudos arbitrales y cómo debería ser evaluada por los jueces del Poder Judicial al momento de que se presenten los recursos de anulación. Se busca plantear elementos como el estado de la cuestión normativa, la situación fáctica del caso y la estructura argumentaba a fin de analizar, desde el plano más simple, si es que un laudo se encuentra motivado o no.

El arbitraje es un mecanismo alternativo de solución de controversias que, en principio, resuelve conflictos en una sola instancia. Sin embargo, el Decreto Legislativo 1071 regula el recurso de anulación de laudo que da lugar a la revisión judicial de las actuaciones arbitrales. Sobre esto, cabe resaltar que esta revisión solo se hace respecto de cuestiones de forma. En ese sentido, la revisión no recae sobre aspectos del fondo de la controversia, es decir, sobre la decisión, la interpretación y, en general, los criterios utilizados por el tribunal arbitral para dirimir una controversia.
Sin embargo, de la jurisprudencia reciente, se advierte la existencia de casos en los que los jueces, al conocer un recurso de anulación de laudo, no solo realizan una revisión formal de la controversia, sino que entran a revisar los aspectos de fondo del conflicto y, en muchos casos, llegan a anular laudos arbitrales como consecuencia de esta revisión.
Ante esta problemática, en el presente trabajo se ha optado por definir los parámetros de la motivación arbitral, considerándolo como una obligación del árbitro, en virtud de lo mencionado por el artículo 56 del Decreto Legislativo 1071.
Asimismo, se ha realizado un análisis legal respecto de la vinculación del artículo 56 y del artículo 63.1.c del Decreto Legislativo 1071.
Finalmente, consideramos preciso indicar que estos actos jurisdiccionales vulneran la autonomía del instituto arbitral. / Arbitration is an alternative dispute resolution mechanism that, in principle, resolves conflicts in a single instance. However, Legislative Decree 1071° regulates the appeal for annulment of the award that gives rise to judicial review of the arbitral proceedings. In this regard, it should be noted that this review is only done with respect to matters of form. In that sense, the review does not fall on the substance of the dispute, that is, on the decision, the interpretation and, in general, the criteria used by the arbitral tribunal to settle a dispute.
However, recent case law shows that when judges hear an appeal for annulment of an award, they not only conduct a formal review of the dispute, but also enter into a review of the substantive aspects of the conflict and, in many cases, go so far as to annul the arbitration awards as a result of this review.
In view of this problem, in the present work we have chosen to define the parameters of the arbitral motivation, considering it as an obligation of the arbitrator, by virtue of what is mentioned in article 56 of Legislative Decree 1071°.
Likewise, a legal analysis has been made regarding the linkage of article 56 and article 63.1.c of Legislative Decree 1071°.
Finally, we consider it necessary to indicate that these jurisdictional acts violate the autonomy of the arbitral institute. / Trabajo de investigación
