Due to length and time constraints, this dissertation will briefly examine and provide an overview of the current method that courts have adopted in bringing a class action in Southern Africa and internationally. Specific focus will be on the Unites States of America, Australia and the Canadian province of Ontario. Challenges of bringing a class action will also be discussed, with a view of ascertaining the most appropriate or well-suited method of bringing a class action under the Consumer Protection Act 68 of 2008. The main issue that will be analysed will be the certification process. The key question to be answered is which approach or procedure, in dealing with the certification requirements under various jurisdictions, should South Africa adopt or incorporate into, class action procedure legislation? In chapter one I will introduce the concept of a class action as it is a relatively new concept found in South African consumer legislation. Different definitions of a class action will be discussed in context of particular statutes. I will define and highlight the purposes of a class action in South Africa and show why there is firstly, a need for such a procedure and secondly why there is a need for such procedure to be codified into legislation. In chapter two I will discuss certain important aspects of class actions. The purpose of this is to identify the main features of a class action. Ultimately, the purpose will be to discuss whether or not these features should be included in South African class actions. Chapter three will commence with the comparative perspective portion of this paper. The legislation adopted by the United States, will be discussed in chapter three followed by a discussion of the Ontario legislation in chapter four and the Australian legislation in chapter 5. The approaches that these jurisdictions have taken in respect of a class action procedure serve as a basis upon which a class action procedure for South Africa will be recommended. Chapter six will provide conclusions that have been drawn through analysis of the foreign jurisdictions’ class action procedures which will reflect the best and worst elements of a class action procedure. This is significant in determining what type of class action procedure would be best suited to South Africa. Chapter seven will highlight the current South African approach to class actions through an examination of case law and a Report by the South African Law Commission. This chapter will also analyse the short-comings in the South African approach through a critique of case law. In chapter eight of this paper I will propose an approach that South Africa should adopt with regard to a class action procedure that is best suited to South Africa’s social climate. Legitimidade ativa individual do direito processual coletivo: o problema de sua ampliação como canal de participação popular e conseqüente efetivação do estado democrático de direito

Trabalho científico elaborado no intuito de demonstrar a importância de conceder ao indivíduo legitimação ativa para mover ações coletivas, abordando temas que inserem o leitor na análise crítica do Direito Processual Coletivo, ao mesmo tempo em que permite eficazes compreensões conceituais, como natureza jurídica, princípios, efetividade e instrumentalidade processual, legitimidade ativa nas ações coletivas, Direito Processual Coletivo como instrumento da Soberania Popular e ampliação do rol dos legitimados ativos como forma de fomento à cidadania. No primeiro capítulo estuda-se o conceito de Direito Processual Coletivo, sua natureza jurídica, evolução histórica, bases constitucionais e princípios peculiares. No segundo capítulo, o Direito Processual Coletivo é visto sob o olhar da teoria geral do direito e do processo; estuda-se também a nova classificação do direito positivo e as espécies de direito objeto de tutela. No terceiro capítulo, abordam-se aspectos processuais peculiares do Direito Processual Coletivo, como o regime da coisa julgada e legitimidade ativa; finalizando traremos argumentos favoráveis à ampliação do rol dos legitimados ativos para englobar a legitimidade dos indivíduos e suas conseqüências positivas. No quarto capítulo será feita análise das teorias compreensivas sobre o fato do pluralismo nas sociedades contemporâneas; no capítulo será feita abordagem da concretização das políticas públicas pelo Poder Judiciário e como o Direito Processual Coletivo, via participação popular, pode ser útil a este fim. A pesquisa foi realizada com base em livros, artigos especializados e jurisprudência. Considering the New Brazilian Code of Civil Procedure, a parallel is drawn between the introduced trial technique system of so called “mass litigation procedures” and its effects on class actions. At first sight, it seems the prevailing “mass litigation procedures” system withdrawal the class actions legal system. However, the research concludes that “mass litigation procedures” system introduced by the New Brazilian Code of Civil Procedure, whether individual or not, doesn’t replace nor run against class actions legal system, but represents a modern technique to equate demands, strengthen precedents and improve the access and effectiveness of judicial remedies / Diante dos direitos fundamentais assentados na “fraternidade”, de índole essencialmente transindividual, empreende-se por metodologia comparativa e indutiva, com pesquisa à legislação, doutrina e jurisprudência, análise do atual grau de efetividade dos processos coletivos. Nesse contexto, com o advento do Código de Processo Civil de 2015, foi instituído o sistema de julgamento de casos repetitivos, cujos efeitos podem afetar o processamento das ações coletivas, dando a aparente ideia de esvaziamento do microssistema a estas relativo. Todavia, chega-se a conclusão de que os instrumentos introduzidos no sistema de julgamento de casos repetitivos, sejam eles individuais ou não, constituem técnica moderna de equacionamento de demandas, que não substituem ou concorrem com as ações coletivas, buscando em contrapartida o fortalecimento de precedentes, com caráter supletivo e complementar em prol do maior acesso e da efetividade da prestação jurisdicional

The use of medical devices and drugs is constantly increasing in the United States. New techniques are developed, pharmaceutical companies manufactured thousands drugs and medical devices each year, these products are put on the market immediately; therefore, the consequences can be terrible. / In the US, thousands even millions of people suffer from personal injuries because they use a defective medical product; this is referred as a mass tort. The class action procedure is often used in order to repair these personal injuries. Plaintiffs always ask for the use of this procedure, but the federal American courts always refuse the certification of the class because the conditions of Rule 23(b)(3) are not fulfilled. This is what is called "the new trend of American courts". / The non application of the class action procedure leads to terrible results; victims of a defective medical product cannot receive compensation for the injury they are suffering from. These victims choose the class action procedure because of its advantages, if the class action is not certified they won't sue individually. If the real problem was the non respect of Rule 23(b)(3)'s conditions, a modification or a reform of the Rule would have been done. Unfortunately the laxity of the federal judges tends to influence the American Congress who ignores the need for a reform of this rule. This makes us wonder what the real justifications motivating this refusal of certification are.
