In a first moment, we treated of the shorten historical, for us to understand and to captain the other indicators of the concept. The origins of the family and of the marriage are interlaced in the old period, in that the illustration of the patriarch resembles to the one of the religious master. With the most perfect civilizations, as the Greek and the Roman, we found structured juridical systems even, that relate the position of the family and your formation. The research demonstrates the structure of the barbaric kingdoms and the rich detail and advanced forms of the medieval Arab civilization. In second moment, we discoursed on the legislation homeland and foreigner about the variation of juridical values and of the concept of the family and your transformations in the century XX, until we arrive to the Federal Constitution of 1988 and the Civil Code of 2002, inaugurating the final analysis of the research. The situation of the period historical, previous, for the traditional family comes across the social and legislative evolutions arriving to the period that we called powders - modern with the affectivity being the motor in the formation of the family for the own analysis of existent entail, initial formation, not for the formal of the norm, but for the information of the affection that precedes the norm, becoming new north of study of the relationships intra and between family / O presente trabalho trata do histórico do conceito de família, desde seus primórdios até a idade hodierna. No estudo de seu desenvolvimento, tanto jurídico quanto social, utilizou-se de métodos de pesquisa bibliográfica e compilação de dados colhidos em diversas fontes escritas, que formaram o supedâneo da pesquisa científica. Em um primeiro momento, tratamos do escorço histórico, para podermos entender e capitanear os demais indicadores do conceito. As origens da família e do casamento entrelaçam-se no período antigo, em que a figura do patriarca se assemelha à do mestre religioso. Com as civilizações mais aprimoradas, como a grega e a romana, encontramos até sistemas jurídicos estruturados , que relacionam a posição da família e sua formação. A pesquisa demonstra a estrutura dos reinos bárbaros e o rico detalhismo e formas avançadas da civilização árabe medieval . Chegando ao período português, desde sua origem, pois é gênese do nascimento do direito pátrio, fundamental para o conhecimento da situação atual, além da própria análise da influência do cristianismo e da igreja nesses períodos. Em segundo momento, discorremos sobre a legislação pátria e estrangeira sobre a variação de valores jurídicos e do conceito da família e suas transformações no século XX, até chegarmos à Constituição Federal de 1988 e ao Código Civil de 2002, inaugurando a análise final da pesquisa. A situação do período histórico, anterior, iconizada pela família tradicional se depara com as evoluções sociais e legislativas chegando ao período que chamamos de pós- moderno com a afetividade sendo a propulsora na formação da família pela própria análise de vínculo existente, formador inicial, não pelo formal da norma, mas pela informalidade do afeto que precede a norma, tornando-se novo norte de estudo das relações intra e inter familiares
