State supervision of financial activities The topic of this dissertation thesis is the state supervision of financial activities. The topic is really wide, so the author can take into account all of the financial relationships related to this area. This thesis focused on theoretical issues, on the legal relationships in this area, and specifically on the selected areas, in which was a drafted question later on in detail analyzed. In the theoretical area are considered terms such as regulation, supervision and control. The aim was to define these concepts theoretically, to chart their frequency and semantic nature in the area of financial activities. The aim of this thesis was also to investigate, whether it is possible to set out the terms that are used both in everyday and in professional life in an identical meaning, and define specifically for the area of financial law. It has been found that it is very difficult, if not impossible task, as any definition cannot cover the diversity, frequency and a steady increase in the financial legal relations. Higher attention is paid to external control exercised by the Supreme Audit Office. Laboratório remoto para controle e supervisão de processos industriais em planta didática multitarefa / Remote laboratory for control and supervision of industrial processes in multitask didactic plant

Esta dissertação aborda o desenvolvimento e a implementação de um laboratório remoto para a disciplina \"SEL0431 - Laboratório de Controle de Processos Industriais\", a qual visa proporcionar aos alunos o contato direto com sistemas de controle e supervisão de processos industriais através de projetos desenvolvidos em uma planta didática industrial. O laboratório foi implementado em 2017 e é constituído por uma planta de escala reduzida, que contém instrumentos de campo, controladores lógicos programáveis, redes de comunicação digitais e um servidor, que conecta a rede local do laboratório à rede da Universidade. Os estudantes acessam este servidor através de aplicações de protocolo remoto RDP sobre VPN com portais online e ferramentas adicionais de suporte para que realizem seus experimentos à distância com a planta. Além de atuar como gateway entre a planta e as máquinas dos alunos, o servidor autentica seus usuários, gerencia acessos simultâneos e permite que os alunos visualizem e obtenham os dados da planta mais facilmente. Ao final de cada projeto, o autor deste trabalho conduziu um questionário para registrar a impressão dos estudantes sobre o uso do laboratório remoto e comparou os resultados apresentados pelos alunos da turma de 2016 e os da turma de 2017 desta disciplina. Esta análise indicou que a adição de um laboratório remoto apresentou um impacto positivo no desempenho acadêmico dos estudantes nesta disciplina: eles atingiram resultados mais completos, exploraram mais a fundo os recursos da planta e avaliaram positivamente o uso da ferramenta. Ademais, esta solução técnica adotada para desenvolver o laboratório remoto é replicável a outras disciplinas e possui a vantagem de permitir o controle total da planta pelos alunos sem abdicar da segurança durante os experimentos. / This thesis addresses the development and implementation of a remote laboratory for the discipline \"SEL0431 – Industrial Processes Control Laboratory\", which aims to provide students with direct contact with control and supervision systems of industrial processes through projects developed in a didactic plant. The laboratory was first implemented in 2017 and consists of a reduced scale plant, which contains field instruments, programmable logic controllers, digital communication networks and a server that connects the laboratory\'s local network to the University Wide Area Network (WAN). Students access the server through RDP applications over VPN and they are supported by online portals and additional tools to perform their remote experiments with the plant. In addition to serving as a gateway between the plant and the students\' machines, the server authenticates its users, manages simultaneous access and enables students to view and obtain plant data more easily. At the end of each project, the author of this paper conducted a survey to record the students\' impression of the use of the remote laboratory and compared the results presented by the students of 2016 classes and those of 2017 classes of this discipline. The analysis revealed the remote laboratory positively impacted on the academic performance of students in this discipline: they achieved more complete results, explored more deeply the plant resources and positively evaluated the use of such tool as a support for teaching industrial processes control and supervision. Furthermore, the technical solution is replicable to other practical courses and presents the advantage of enabling students to totally control the plant without forgoing the security during their experiments.

The Pension Funds are overseen by Previc and should have enough internal controls and governance to avoid actuarial deficit in the benefit plans that manage. The lack of control can lead to civil and administrative liability for entities, its officers, sponsors and other entities in the market who advise Pension Funds on the implementation of the investment process. The ascertainment of liability of the entities and its officers, within the Previc, begins with an administrative process that clears irregularities. After administrative level, who feel harmed can start a lawsuit. Despite the strong accountability framework of guilty, which should pursue is effective compensation of benefit plans arising from damage caused by mismanagement of resources that will complement the future income of the worker at the time that their workforces are reduced. The employee, who expects to receive his supplemental retirement, is the keystone of the closed private pension market. / O presente estudo pretende avaliar o controle e fiscalização do processo de aplicação dos recursos previdenciários por parte dos Fundos de Pensão cuja finalidade deve ser garantir o pagamento futuro do benefício contratado pelos participantes. Os Fundos de Pensão são fiscalizados pela Previc e devem possuir controles internos e governança suficiente para evitar déficit atuarial nos planos de benefício que administram. A falta desse controle pode acarretar responsabilidade civil e administrativa às entidades, seus dirigentes, patrocinadores e demais entes do mercado que assessoram os Fundos de Pensão no processo de aplicação dos investimentos. A apuração de responsabilidade em relação às entidades e dirigentes, no âmbito da Previc, tem início com um processo administrativo que apura irregularidades cometidas. Encerrada a esfera administrativa, aquele que se sentir prejudicado pode iniciar um processo judicial. Não obstante a forte estrutura de responsabilização de culpados, o que se deve perseguir é o efetivo ressarcimento dos planos de benefício decorrentes dos prejuízos causados pela má gestão dos recursos que servirão de complemento de renda futura do trabalhador no momento em que suas forças laborais estiverem reduzidas. O trabalhador, que espera receber sua complementação de aposentadoria, é a peça fundamental do mercado de previdência complementar fechada.

Évaluation par simulation de la sûreté de fonctionnement de systèmes en contexte dynamique hybride / Evaluation by simulation of the dependability of systems in hybrid dynamic context

La recherche de solutions analytiques pour l’évaluation de la fiabilité en contexte dynamique n’est pas résolue dans le cas général. Un état de l’art présenté dans le chapitre 1 montre que des approches partielles relatives à des hypothèses particulières existent. La simulation de Monte Carlo serait le seul recours, mais il n’existait pas d’outils performants permettant la simulation simultanée de l’évolution discrète du système et de son évolution continue prenant en compte les aspects probabilistes. Dans ce contexte, dans le chapitre 2, nous introduisons le concept d’automate stochastique hybride capable de prendre en compte tous les problèmes posés par la fiabilité dynamique et d’accéder à l’évaluation des grandeurs de la sûreté de fonctionnement par une simulation de Monte Carlo implémentée dans l’environnement Scilab-Scicos. Dans le chapitre 3, nous montrons l’efficacité de notre approche de simulation pour l’évaluation de la sûreté de fonctionnement en contexte dynamique sur deux cas test dont un est un benchmark de la communauté de la Sûreté de Fonctionnement. Notre approche permet de répondre aux problèmes posés, notamment celui de la prise en compte de l’influence de l’état discret, de l’état continu et de leur interaction dans l’évaluation probabiliste des performances d’un système dans lequel en outre, les caractéristiques fiabilistes des composants dépendent eux-mêmes des états continu et discret. Dans le chapitre 4, nous donnons une idée de l’intérêt du contrôle par supervision comme moyen de la sûreté de fonctionnement. Les concepts d’automate observateur et de contrôleur ont été introduits et illustrés sur notre cas test afin de montrer leur potentialité / The research of analytical solutions for reliability assessment in dynamic context is not solved in the general case. A state of the art presented in chapter 1 shows that partial approaches exist in the case of particular hypothesis. The Monte Carlo simulation would be the only recourse, but there were no tools allowing the simultaneous simulation of the discrete evolution of the system and its continuous evolution taking into account the probabilistic aspects. In this context, in chapter 2, we introduce the concept of hybrid stochastic automaton capable of taking into account all the problems posed by dynamic reliability and to accede to the assessment of dependability parameters by a Monte Carlo simulation implemented in Scicos-Scilab environment. In chapter 3, we show the effectiveness of our approach of simulation for dependability assessment in dynamic context through two test cases of which case one is a benchmark of dependability community. Our approach responds to the posed problems, notably the consideration of the influence of the discrete state, of the continuous state and their interaction, in the probabilistic assessment of the performances of a system in which besides, the reliability characteristics of components depend themselves of the continuous and discrete states. In chapter 4, we give an idea of the interest of control by supervision as a means of dependability.
