Exheredace - platná úprava a historický kontext / Disinheritance - current legal regulation and historical context

This diploma thesis deals with the legal regulation of disinheritance, with regard to historical context. The thesis focuses primarily on the analysis of the grounds for disinheritance. Disinheritance is an institute that serves as a counterbalance to the legal protection of forced heirs, subsisting in their right to a forced share. If a deceased decides to deprive a forced heir of the protection guaranteed by the heir's right to inherit, i.e., to exclude the forced heir from his or her right to a forced share or restrict the forced heir in his or her right, the deceased may do so exclusively on the grounds defined by law. The current law provides for six disinheritance grounds: failure to provide necessary assistance in need, failure to show real interest, conviction for a crime, permanent unrestrained life, incapacity to inherit, and indebtedness or prodigality. The purpose of this diploma thesis is to provide a comprehensive explanation of the institute of disinheritance while emphasising in particular the legal provisions concerning each of the grounds for disinheritance, and through such explanation, to assess the current law and propose amendments, if any, de lege ferenda. Reasons for termination of employment Abstract The topic of the diploma thesis concerns the reasons for the termination of the employment relationship. The aim of the thesis is to analyse thoroughly the reasons for termination in the light of legal regulation as well as the case law, but the aim of the thesis is also to reveal possible legal deficiencies and possible proposals for its de lege ferenda solutions. The actual text of the work outside of the introduction and the conclusion is divided into 4 chapters. The first chapter defines the basic concepts of labour law, its function and its position within the system of law, especially its relation to civil law. The second chapter deals with general employment and termination of employment. At the beginning there is a brief discussion about the employment relationship and its origin, including its subjects, and a list of all ways of terminating the employment relationship and more precisely characterized selected ways of termination of employment, including the termination of employment contract, the probationary period, the immediate cancellation of the employment relationship and, last but not least, the collective redundancies. Teoretické část práce se zaměřujeme na důvody oceňování podniků a jeho částí, které souvisí či nesouvisí se změnou vlastnictví podniku, na přístupy k oceňovaní podniku. Pozornost se soustředí hlavně na hlediska hodnocení podniku, od strategické analýzy přes finanční analýzu až k finančnímu plánu. Poslední kapitola teoretické části se věnuje objasnění jednotlivých metod pro ocenění. Největší pozornost je věnována výnosovým metodám. Praktická část představuje vlastní ocenění zvoleného podniku. Ocenění bylo provedeno čtyřmi metodami, a to metodou účetní hodnoty, kapitalizací zisku, DCF ve variantě FCFF a metodou založenou na ukazateli EVA. Při jejich použití se vycházelo z předpokladu trvalého fungování podniku, a že podnik disponuje pouze provozně nutnými aktivy. Nebyly také prováděny korekce provozního HV. Pro konečné stanovení ceny podniku byla zvolena jedna z výnosových metod

Title: Comparison of legal regulation of notice of termination in the Czech Republic and Poland The aim of this master thesis is the comparison of legal regulation of notice of termination of employment relationship in the Czech Republic and Poland. This paper provides an overview of the legislation of notice of termination in these two states and in the end contains the comparison and evaluation of legal regulations concerned. The work consists of eight chapters, introduction and conclusion. The first chapter outlines the international and European legislation related to labour law with emphasis on termination of employment. The chapter contains a number of international conventions adopted in particular within the ILO as well as European legislation which deals with this issue. The second chapter contains treatise on termination of employment relationship in general, where the basic sources of national labour law in each country and a brief description of all forms of termination of employment relationship are stated. The question of what leads clients to onset of the WHITE LIGHT I therapeutic community was the main reason for this research. It may seem that the main motive is the drug addiction of clients, but I rather wonder what the last drop is, that they come to make a decision to do something about themselves. In my experience, it is the consequences of drug use rather than addiction itself. I wanted to examine those reasons. The aim of the research is to find out and explain the reasons for clients entering the Therapeutic community WHITE LIGHT I. The thesis is based on qualitative research. The methods used to obtain data are clients' biographies, questions on admission, records of the therapeutic groups and semistructured interview. I conducted the research on eight WHITE LIGHT I community clients who agreed to participate in the research. For data processing, I used the thematic analysis as a method, which is the most appropriate for a given need. The research revealed eight reasons for getting treatment. It is a loss of housing, a desire for a normal life without drugs, loss of employment, problems with the law, family pressure, health problems, client in the position of victim (crime, violence, etc.) and loss of life expectancy. Testamentary capacity and disinheritance Abstract Disinheritance is an institute of law, which gives the testator opportunity to shorten, or not to leave the forced share to the forced heir for which he is entitled by law. The testator can act in this way only if grounds for disinheritance are met. Grounds for disinheritance are defined by law. However, the legislator does not explicitly state who has this legal capacity. We infer this fact logically. The purpose of diploma thesis is the institute of disinheritance, its overall analysis and demonstration on examples from case law. Also, to evaluate the institute of testamentary incapacity, or the incapacity to make disposition of property upon death, and the institute of disinheritance and put them into context. At the same time, to point out whether legal definition of the testamentary incapacity could have been defined in a different way in the law. Methods: A survey sent to 42 judo trainers and 21 children helped to find out the reasons why children terminate their sport activity at competitions at the age 14 - 18. Results: We have found out that the main reasons are feeling of anxiety before the match, lack of time and demanding studies at high school and university out of the hometown. The Community Trade Mark in Comparison with the National Trade Mark - Focused on the Unitary Character of the Community Trade Mark and the Absolute Grounds of Refusal Abstract The Community Trade Mark system has existed since 1994 when the Community Trade Mark Regulation No. 40/94/EC was adopted. Even though the European system is younger than the national trade mark systems, one cannot say that it is a less successful system - particularly according to the number of registered Community Trademarks. The regulation of trademarks is very complex and for this reason I have decided to focus only on one part of the regulation, namely the unitary character, which represents a special characteristic of a Community Trade Mark - and further on the absolute grounds of refusal and their comparison in European and Czech trade mark law. The two systems for the registration of trademarks show considerable resemblance; however, one shall find differences, e.g. an integration of bad faith as one of the absolute grounds of refusal appearing only in the national system. 1 Abstract This diploma thesis deals with motivation in teaching profession. It is devided into two parts. The teoratical part summarizes issues and motivation of teaching profession. The aim of the empirical part is research analysis focused on the view of the respondents' issues, their experiences and opinions. The results show that due to the respondents there are a lot of unsatisfactory factors, which are not long-term resolvable while these respondents speak about positive factors just sporadically. It is understood for them that some teachers were left the teaching profession.
