Perceived Threats, the Black Sheep Effect, and Sexual Prejudice Against Gay Men

Recently theorists have argued that in-group members might respond more harshly to deviant members of their own group in comparison to deviant members of the out-group. Previous research has provided extensive support for this “black sheep effect”; however, no prior studies have examined how it affects individuals’ attitudes towards sexual minorities, or those perceived as deviating from the heterosexual norm. Numerous factors have been found to be linked to negative attitudes towards sexual minorities, including religious fundamentalism and the traditional male role norm of anti-femininity, and several studies have suggested that intergroup threat theory may serve as a possible explanation for sexual prejudice. The present study examines the association between several known correlates of sexual prejudice and intergroup threat theory, and examines the possible mediating effect of sexual prejudice on the association between anti-femininity, religious fundamentalism, and the “black sheep effect”.

The effect of racial prejudice on perceptions of Black slurs used by Black individuals toward White individuals

Saucier / The current research examined whether participants’ levels of racial prejudice impact their perceptions of a Black racial slur (“nigga”) used by a Black individual toward a White individual. The “racism justification hypothesis” predicts racial prejudice will be negatively related to perceptions of offensiveness due to motivations to trivialize racial slurs which allows for increased use of the slur by individuals higher in prejudice. The “hierarchy defense hypothesis” predicts racial prejudice will be positively related to more negative perceptions of the slur due to White individuals seeking to resist affiliation with Black individuals and perceiving affiliative attempts as threatening. Consistent with the hierarchy defense hypothesis, the results showed racial prejudice predicted greater offensive and negatively expressive perceptions, and lower positively expressive perceptions following “nigga” being used by a Black individual toward a White individual (Study 1). In Study 2, the current research examined whether motivations to trivialize racial slurs (i.e., racism justification) versus participants’ experiences of threat (i.e., hierarchy defense) mediated the relationships between racial prejudice and perceptions of “nigga” used by a Black individual toward a White individual. Consistent with the hierarchy defense hypothesis, racial prejudice, through status hierarchy threat, predicted greater offensive and negatively expressive perceptions, and lower positively expressive perceptions. The racism justification hypothesis was also supported. Participants’ levels of racial prejudice, through racism trivialization, were generally related to lower perceptions of the slur as offensive and greater perceptions of the slur as positively expressive. The current research then examined participants’ perceptions of “nigga” reciprocated by the White individual toward the Black individual. Interestingly, racial prejudice, through status hierarchy threat, predicted greater offensive and negatively expressive perceptions and lower positively expressive perceptions. Racial prejudice, through racism trivialization, predicted generally lower offensive perceptions and greater positively expressive perceptions. Thus, participants may have used their experiences of threat as justification for explicit prejudice toward the Black individual (i.e., perceiving the slur as more offensive and negative), while individuals who experienced trivialization motivations attempted to decrease their experiences of suppression factors by perceiving the slur as less offensive, allowing for increased use of the slur. Implications for these findings are discussed.

Constitutional Court: Negative Legislator? Abstract This diploma thesis deals with the question whether the Constitutional Court of the Czech Republic can be considered as a mere negative legislator in connection with deciding on proposals for annulment of laws or their individual parts according to Art. 87 par. a) of the Constitution or whether the Constitutional Court departs from this position and how. The diploma thesis is divided into theoretical and practical part, while the author seeks to rely mainly on the actual decision-making practice of the Constitutional Court. In the theoretical part, the thesis deals with the concept of the negative legislator and its origin in the ideas of Hans Kelsen. Kelsen's concept of constitutional justice as a negative legislator is presented. In the following subchapters, the theoretical part is devoted to acquainting the reader with the decision-making of the Constitutional Court on petitions to annul laws or their individual parts. The thesis also describes the binding of judges in decision- making and their binding for other subjects. A critical analysis of the non-derogable rights in a state of emergency under the African system : the case of Ethiopia and Mozambique

"Astoundingly, the African Charter on Human and Peoples' Rights (ACHPR) does not contain [a] derogation clause. Furthermore, it has been established by the African Commission on Human and Peoples' Rights (the Commission) in the case of Commission Nationale des Droits de l'Homme et des Libertes v Chad (Commission Nationale case) that a member state of teh ACHPR cannot derogate human rights in case of emergencies. Hence, the Commission's view may lead to a conclusion that all rights under the ACHPR are non-derogable. This raises the issue of whether it is tenable to conclude that a state facing a situation that endangers the nation, should not at all derogate from the provisions of the ACHPR. Emergency clauses, which permit derogation of human rights in times of emergencies, are also found in most domestic legal instruments. Most African states also encompass this clause in their constitutions. Although the levels of compliance by states are questionable, some of these constitutions also include a list of non-derogable rights. The constitutions of Ethiopia and Mozambique also provide for a derogation clause and a list of non-derogable rights. The aim of the study is to make a critical analysis of the African derogation system. Firstly, the study will analyse the concept of derogation and non-derogable rights in general. Secondly, the jurisprudence and the law of the African system with regard to derogation and non-derogable rights will be examined. In analysing the jurisprudence of the Commission effort will be made to critically study the cases that have been examined by the Commission in relation to derogation and non-derogable rights. Questionando a imperatividade do jus cogens no direito internacional

O objetivo desta tese é questionar o discurso da imperatividade das normas de jus cogens no direito internacional, verificando se ele se é compatível com uma sociedade internacional de caráter horizontal, descentralizado e baseada fundamentalmente no consentimento dos Estados. Para isso, a primeira parte deste trabalho examinará se a configuração normativa do jus cogens apoia a imperatividade a ele conferida, começando pelo estudo do desenvolvimento e afirmação histórica do conceito, buscando identificar tanto suas raízes remotas quanto o conteúdo desenvolvido pela Comissão de Direito Internacional das Nações Unidas, que culminou com a positivação do jus cogens na Convenção de Viena de 1969 sobre o Direito dos Tratados. O segundo capítulo da primeira parte tentará esclarecer o conteúdo normativo do jus cogens, abordando sua fundamentação teórica e buscando identificar sua fonte, examinando características inerentes a tais normas, como a não-derrogabilidade e a possibilidade de modificação para, ainda, abordar a questão da identificação das normas de jus cogens. Na segunda parte, a aplicabilidade das normas de jus cogens no direito internacional será verificada, questionando se é possível que tais normas operem os efeitos que lhe são atribuídos. For this purpose, the first part of this paper will examine whether the normative configuration of jus cogens supports the imperativeness attributed to such norms, beginning with the study of the historical development and affirmation of the concept, seeking to identify both its remote roots as well as the content developed by the International Law Commission of the United Nations, which culminated with the provision on jus cogens in the 1969 Vienna Convention on the Law of Treaties. The second chapter of the first part attempts to clarify the normative content of jus cogens, approaching its theoretical foundation and seeking to identify its source, examining the characteristics inherent to these norms, such as non-derogation and the possibility of modification, also addressing the issue of identification of jus cogens norms. In the second part, the applicability of jus cogens norms in international law will be verified, questioning whether it is possible for these norms to operate the effects attributed to them. The first chapter of this part will examine the "consolidated" areas, in which there is some kind of regulation regarding the consequences of peremptory norms, v.g. the law of treaties and the international responsibility of the state. Then, the second chapter will address the effects attributed to jus cogens in the so-called unconsolidated fields, which lack legal provision, but which are the subject of great doctrinal and jurisprudential production, such as the possible exercise of jurisdiction due to violations of peremptory norms, as well as the creation of a hierarchy in the international law order, to finally draw conclusions on the subject. An exploratory study of derogation in Quebec : the case of three students

This qualitative study investigates the consequences of advancing three preschoolers into kindergarten in the province of Quebec, where the derogation exemption enables younger children to start school before they reach the age of admission of five years by September 30th. The rationale for this study came from an interest to discover the perspectives of the students, their teachers, and their parents on the topic of derogation. This study examines how these students, one in grade 4 and two in grade 6, feel about being the youngest in the class, and how teachers and parents perceive them as learners and socializers. The research design is based on an exploratory qualitative case study approach. The methods used to collect the data consist of interviews conducted with the three selected students, their homeroom teachers, and two parents; observations of the students in their school settings, and the analysis of documents such as field notes and journal entries. The interviews are analyzed within a socio-cultural interpretive framework in order to examine the way that derogation has affected the social and emotional lives of the three selected children. Vygotsky's zone of proximal development is explored. This concept presents the idea that children develop their learning potential in a setting where they can learn with more capable peers and adults who provide guidance and support. When these younger children are advanced into a kindergarten class, they are placed in a setting with older peers and adult teachers. One of the issues addressed in this study is how the social milieu encourages derogated children to develop their cognitive approach to problem solving and learning. The themes that emerged from this study include the importance of parental support, peer acceptance, and self-esteem. The thesis deals with temporal effects of decisions of the Constitutional Court, by which a statute is repealed due to its unconcstitutionality. Since the relevant provisions are not sufficiently comprehensive, various problems and doubts arise in legal reality. The thesis summarizes the relevant theoretical premises, which should allow for finding answers to questions related to the topic of the thesis. The relevant case-law is also summerized and subjected to partial criticism. The paper also deals with specifics of criminal law and civil law, including horizontal effect. It also specifically addresses the issue concrete constitutional review a and the phenonmenon of so called resurrection of law when a derogational statute is derogated.
