Por silenciamento, compreende-se um conjunto de estratégias para silenciar homens e mulheres negros, reconhecidos e que se reconhecem como intelectuais da população negra no Brasil. Por intelectualidade negra, entende-se um grupo social formado por uma classe subalterna com a intenção de torná-lo o seu especialista e organizador. A intelectualidade negra também se refere a uma unidade discursiva cuja evidência revela um domínio de enunciados efetivamente falados ou escritos. Com a intenção de elucidar essas questões, examino a trajetória intelectual de Maria Beatriz Nascimento cuja contribuição pode ser colocada em termos de enunciado de interpretação de Brasil. Por enunciado, concebe-se qualquer série de signos, de figuras, grafismos ou traços. A enunciação ocorre sempre que um conjunto de enunciados for emitido sob as condições reais da sua enunciação. / This research approaches the silencing of Brazilian black intelligentsia, considering silencing as a set of strategies to repress black men and women, which are recognized and recognize themselves as intellectuals of the black population in Brazil. Black intellectuals is reffered here as a social group formed by a subordinate class with the intention of making themselves experts and organizers of the black people. The black intelligentsia also refers to a discursive unit whose evidence reveals an expertise in spoken or written utterances. In order to elucidate these issues, the intellectual trajectory of Maria Beatriz Nascimento is analysed, whose contribution can be expressed in terms of utterance of an interpretation of Brazil. Utterance means any series of signs, figures, graphics or features. The utterance occurs whenever a set of statements is expressed under the real conditions of their enunciation. / La recherche porte sur la mise au silence de l’intellectualité noire brésilienne. Par mise au silence, on comprend l’ensemble de stratégies qui réduisent au silence des hommes et des femmes noirs reconnus et qui se reconnaissent comme intellectuels de la population noire au Brésil. Par intellectualité noire, on comprend un groupe social constitué par une classe subalterne ayant l’intention de devenir son propre spécialiste et organisateur. L’intellectualité noire se réfère également à une unité discursive dont l’évidence montre un champ d’énoncés effectivement parlés ou écrits. Avec l’objectif d’élucider ces questions, j’examine la trajectoire intellectuelle de Maria Beatriz Nascimento, dont la contribution peut être considérée en terme d’énoncé d’interprétation de Brésil. Par énoncé on entend une série de signes, d’images, graphismes ou traits. L’énonciation a toujours lieu quand un ensemble d’énoncés sont émis dans les conditions réelles de son énonciation.

This theses is focused on ethical dilemmas, which can appear during the work with people with disabilities. This work is divided into five main parts. In the first part I describe specifics of the target group and the negative impacts of disabilities which can appear. The second part is focused on social work with this target group. The third part deals with ethics and ethical dilemmas. Here I describe ethics in general view and also in the context of social work. Then I define ethical dilemmas and I describe possible solution, all based on literature. The fourth part is about ethical dilemmas in practice. Namely dilemmas, which were mentioned during research probe under which I have conducted interviews with social workers. The last part concerns the analysis of the ethical dilemma according to three ethical theories.

The introduced diploma thesis deals with the application of ethics in social work in Open door youth club Cross in Strakonice, where the Roma are the target group of clients. The diploma thesis is divided into three parts. The first chapter deals with the everyday problems of Romany people, from the history to social situation of Romany ethnic group of nowadays. The question of education of the Roma in Czech school system is also included there. The aim of the second chapter is to introduce the Open door youth club Cross, to present the role of this organisation, its principles, aims and its target group of clients who are very often considered to be in unfavourable life and social situations. The third chapter is the fundamental part of the diploma thesis. The main focus is on moral acting of social workers and on the sense, necessity and application of ethic rules in social work, especially while working with Roma clients in Open door youth club Cross.

This Diploma Thesis deals with the description of the ethical dilemmas faced by personnel attached to the foster family. The first part is devoted to the family, because that is the target group with which the attached person supervising the worker works. The second part deals with foster care, in particular, its legislative definition. This definition determines the boundaries within which the worker moves. Next, I explain, what is the legislation of our country, related to foster care, based on. The third chapter describes what should the attached personnel be like and what is included in their work performance. The next chapter presents dilemmas for workers, which I found, on the basis of qualitative research using interviews with staff. The final, fifth chapter is devoted to the analysis of selected ethical dilemma from the perspective of ethics I. Kant and utilitarianism.

The diploma thesis refers to the applicability of ethical theories in solving the dilemmas of social workers in homes for the elderly. The thesis is divided into four parts. In the first part there is defined a residential social service in the form of a home for seniors and characterized the nature of social work in this facility. The second part defines eleven dilemmas social workers encounter in their practice and also the reasons why social workers avoid them. The third part describes the essence of ethical theory in social work practice. It is focused on the description of three selected theories which include deontology, utilitarianism and the ethics of care. The last part concerns the application of these theories to the two ethical dilemmas of social workers: to contact or not to contact client's family, to solve or not to solve client's problems.

The objective of this thesis is to analyze the cooperation of social workers involved in social work applied to Roma families in the socially excluded location "Fišlovka" in Tábor, and to outline the possibility of discussed cooperation in addressing ethical dilemmas related to social work with the target group. The subject of this analysis is an attempt to identify the main reservations and barriers of this cooperation and the possibilities of improving it. The thesis also explores the ethical dilemmas that social workers working with Roma families encounter, and the strategies that they most often use to deal with these dilemmas. The thesis consists of a theoretical and practical part. The theoretical part explains the basic concepts that govern the work topic. The practical part offers an interpretation of data obtained through qualitative research that involved nine respondents among social service workers working with the discussed target group.

Etika a kultura v interakci s obtížnými klienty / Ethics and culture in interaction with difficult clients

In my thesis, I focused on the ethical and cultural dimension of social work, application of ethical principles and choice of attitude by a helping professional when working with a client. Subsequently, I followed changes in application of these ethical principles and changes of attitude in high-strain situations in the contact with a so-called difficult client. Further, I focused on the defence mechanisms which a helping professional chooses to cope with high-strain situations and manage his job well. In the individual chapters of the theoretical parte, by the analysis of scientific literature I described theoretical bases of the professional relationship between a social/health social worker and a klient and I focused on the realization of this relationship and on what it brings the worker in high-strain situations when working with the so-called difficult client. In the empirical part, I set one main goal to find out how social workers react on the ethical level in high-strain situations while interacting with difficult clients. Partial goals were designed to find out what ethical principles social workers apply, what attitudes they choose, which clients they consider difficult and what defence mechanisms they develop to cope with high-strain situations. To reflect these goals, I set one main research question and four partial ones. For the collection of data, I opted for the method of quantitative research and I used the questioning method in the form of a half-structured interview. I chose the set of respondents for my research by the method of simple random sampling. To process the research data, I chose the method of case study. Processing the interviews and analysing them, I found out that social workers in high-strain situations do not change their application of ethical principles. Further, I found out that the choice of attitude in high-strain situations changes and that social workers choose, instead of a partner attitude based on equality, a more or less directive stance. All of the respondents met a difficult client at work and dealing with high-strain situations causes them certain indisposition they have to cope with. The answer to the main research question is thus that on ethical level social workers react in high-strain situation by a shift in the choice of their attitude and solving ethical dilemmas. It was a hostile client that the social workers listed most frequently in the typology of clients. It became evident during the interviews what kind of defence mechanisms social workers choose to be able to cope with high-strain situations. The thesis may provide information to the general public and experts.

A presente tese se propõe a avaliar os avanços e recuos do denominado Regime Internacional para Atrocidades (RIA), focando-se sobremaneira no seu principal desdobramento normativo e institucional: o Tribunal Penal Internacional (TPI). Tais avanços e recuos não podem ser analisados somente a partir de qualificações políticas pragmáticas ou de princípios morais cosmopolitas reconhecidos pelo Tribunal, mas sim a partir da existência de um conflito de valores exposto na construção e consolidação do regime em questão: justiça versus paz, bem como da necessidade de superá-lo. É esse conflito entre a justiça internacional, interpretada de modo cosmopolita, e também pelo viés restrito do paradigma jurídico de enforcement dos direitos humanos, e a paz, interpretada como a ausência de conflito direto, bem como a consequente necessidade de arbitrá-lo, que nos permitirá fazer recomendações sobre o que se deve fazer para implementar um RIA realmente efetivo no sentido de livrar a humanidade das violações de direitos humanos que se qualificam como atrocidades, considerando as particularidades de contextos transicionais e ampliando a prestação de contas. A estratégia recomendada pela tese é a da combinação de uma justiça judicializada, que se traduz no TPI, com outros mecanismos de justiça transicional. Ademais, uma atuação do TPI sensível às vítimas e às atividades de peacebuilding é parte fundamental dessa estratégia. Os casos sob a investigação do TPI serão trazidos à tona na presente tese no sentido de ilustrar alguns aspectos do argumento principal nela estruturado. / This thesis aims to evaluate advances and shortcomings concerning the so-called International Atrocities Regime (IAR), focusing on its main normative and institutional achievement: the International Criminal Court (ICC). Such advances and shortcomings cannot be analised either exclusively through pragmatic political qualifications or through cosmopolitan moral principles embraced by the Court. Instead, we initially sustain the existence of a conflict of values apparent in the building up and consolidation of the above mentioned regime: the justice versus peace dilemma and the necessity of overcoming it. It is this dilemma between international justice, interpreted according to both a cosmopolitan perspective and a judicial paradigm of human rights enforcement, and peace, interpreted as the absence of direct conflict, and simultaneously the urgent need of managing this conflitct of value that will allow us to make some normative recommendations about what is to be done in order to implemente an effective IAR. By effectiveness, we mean both the prevention of humanity from suffering gross human rights violations qualified as atrocities, considering the particularities involved in transitional contexts, and the promotion of accountability. The strategy recommended by the thesis is the combination of a judicialized justice, translated into ICC practices, with other transitional justice mechanisms. In addition, an ICC performance sensible to victims and peacebuilding activities is a fundamental aspect of such a strategy. In this sense, the cases under ICC investigation will be mobilized in order to illustrate some aspects of the main argument structured in the thesis.
