The Analysis of The Disputes in Construction Contact

The properties of Construction Engineering include: (1) high building cost, (2) unpredictability of construction risk because of the fact that the period of executing the contract is long and the external environment is easy to change, (3) the phenomena that disputes and conflicts happen easily since a construction project normally requires a large number of constructing units, each of which owns their complicated construction technology and expertise. As the process of the construction project involves various risks, the awareness of these risks and the method of diversifying the risks become important. This dissertation focuses on study of the legal aspects of the construction contact; It first tries to analyze the properties of the construction contract, its related properties which cause higher risks than contract with consideration, and different types of disputes and conflicts in common dispute decision and arbitration judgment in construction projects. Then it studies the commitment resulting from the disputes, and the comments on disputes of same kind in the real cases. Further it makes a basic proposition to the comments. Finally it examines the feasibility of the proposition through interviewing with some experts (adopting the method of Delphi). Meanwhile it modifies the proposition and adds more comments onto it proposition, in the hope that both of the owner and the contractor can prevent the disputes at the time of making contract.¡@ In most of the real case, the owners normally transfer the risks they should have taken to the contractors. This way of distributing risks may not either bring efficiency or benefits to the contract; instead it brings more losses to both sides. There are no many clauses in the section Hire of Work in Civil Code regarding distribution of risks. Those clauses leave incomplete resolution of various risks likely to happen in the contract. Therefore it is necessary to emphasize the principles of risk distribution in the construction contract¡Gmainly the just and reasonable principle, principle of change of circumstances, and principle of good faith, etc. The construction conventions can be referred too, such as convention of project fact, and the commom law which ie formed of the opiom by the court¡Barbitration judgment¡Bmediation¡C

Principal Leadership in Building a Culture of Disciplinary Literacy

This study investigated principal leadership in building a culture of disciplinary literacy. Previous studies investigated and validated the uniqueness of disciplinary literacy (Moje, 2015; Shanahan and Shanahan, 2008; Spires et al., 2018). Case studies on individual schools looked at literacy within the context of a specific school community (Faulkner, 2012; Francois, 2014; Gilrane et al., 2008). These studies, although they touched on teacher and principal leadership, did not focus on leadership at the core of creating a community of literacy. This study focused on the essential actions and dispositions of principals who successfully built and maintained a culture of disciplinary literacy. Eight principals from a large, suburban Northeastern school district were interviewed to ascertain their actions. Open coding with constant comparative analysis yielded common themes, dispositions, and actions of principals. Common leadership themes emerged as principals discussed leading disciplinary literacy: demonstrate why change is needed, recognize that leading literacy requires a plan, link the district priorities to disciplinary literacy, distribute leadership, provide targeted professional development, and utilize established resources. What emerged from this study was that one person alone could not build a culture of literacy within a school. Rather, changing instructional practices to put literacy at the center of learning requires the community to embrace literacy. As school leaders look to improve equitable outcomes for all students, they must look at the variation in instructional practices across the disciplines and ensure that literacy research-based practices are being used across all content areas. Change of this magnitude is a multiyear shift with student learning at the center of all instructional decisions. The complex task of leading instructional change requires a principal to learn about disciplinary literacy. If schools want equitable education for all students, principals must understand and place priority on disciplinary literacy. / 5 / This study investigated principal leadership in building a culture of disciplinary literacy. Disciplinary literacy is the ability to read, write, think, and discuss like an expert in the field. For example, classes with disciplinary literacy at the core would ask students to read like a scientist or write an original score like a musician. Tem como objetivo desvelar como vem se constituindo a formação continuada para o coordenador pedagógico da Rede Municipal de Ensino de Ponta Grossa, Paraná e como objetivos decorrentes identificar o movimento realizado para a formação continuada do coordenador pedagógico e analisar as possibilidades e os limites da formação continuada para a realização do trabalho pedagógico. Parte-se de questões emergentes da prática, ao se considerar a complexidade do trabalho do coordenador pedagógico e a necessidade de formação continuada. O eixo epistemológico que norteia a pesquisa é a teoria como expressão da prática (MARTINS, 1998) e os conceitos de produção e distribuição do conhecimento, discutidos por Santos (1984), questionando-se se a formação tem como ponto de partida a prática dos coordenadores e se ela se define no campo da produção ou distribuição do conhecimento. A pesquisa é de natureza qualitativa e a coleta de dados contou com a utilização de documentos e entrevista semiestruturada. Os sujeitos de pesquisa são 10 coordenadores pedagógicos que atuam nas escolas e 8 profissionais da educação, sendo eles formadores e sujeitos que fizeram parte da Secretaria Municipal de Educação. Autores como Pinto (2011), Kuenzer (2007), Placco (2012), Orsolon (2002) e outros foram utilizados para embasar a formação inicial e o papel do coordenador pedagógico; e para fundamentar o conceito de formação continuada, Camilo Cunha (2015), Marcelo (1999), Mizukami et al. (2002), Nóvoa (1995), Demailly (1995), Formosinho (2009), Imbernón (2011), com destaque a Martins (2006), que define, de acordo com o eixo epistemológico da teoria como expressão da prática, quatro momentos para a formação continuada, iniciando com a descrição da prática no plano empírico; a explicação da prática mediatizada pelas tendências da educação; a compreensão da prática pedagógica no nível da totalidade; e a elaboração coletiva de propostas alternativas. Os resultados apontam o movimento da formação continuada relacionado aos acontecimentos de âmbito nacional e às perspectivas presentes, e que a concepção da formação reflete no trabalho do coordenador pedagógico. Identificaram-se as possibilidades e os limites referentes à formação para o coordenador pedagógico iniciante na função; para a definição do papel do coordenador para atuar como formador no interior da escola; nas diferentes áreas do conhecimento; para a troca de experiência; para a realização do planejamento; para resultados; e, por fim, para as necessidades da escola. Identificou-se que as formações não privilegiam a produção e sistematização do conhecimento, mas estão voltadas a interesses particulares de sujeitos que pensam para a escola e não com a escola. / It has been taken for study in the current research the continuing education of pedagogical coordinators. It aims at unveiling how this continuing education has been occurring to pedagogical coordinators in the Municipal Elementary School from Ponta Grossa, Paraná. As the objectives it is possible to mention: identifying the actions taken concerning the continuing education of pedagogical coordinators; analyzing the possibilities and limits of continuing education regarding the achievement of the pedagogical work. The research starts from questions that emerge from practical work, taking into account the complexity of such work and the necessity for a continuing education, thus, the main question is to know how the continuing education has been happening in the Municipal Elementary School from Ponta Grossa concerning the pedagogical coordinator. The epistemological axis taken to guide this search is theory as practical expression (MARTINS, 1998) and the concepts of producing and distributing knowledge, expatiated on by Santos (1984). Accordingly, it has been asked whether the education starts from the coordinators practices and whether the formation is defined in the producing and distributing knowledge field. This is a qualitative research and the data has been collect by documents and semi-structured interview. The interviewed were ten pedagogical coordinators and eight education professionals, which worked for the Municipal Department of Education. Authors such as Pinto (2011), Kuenzer (2007), Placco (2012), Osolon (2002) and others have been used to base the initial formation and the role of the pedagogical coordinator. The concept of continuing education was substantiated by author such as Camilo Cunha (2015), Marcelo (1999), Mizukami (et al., 2002), Nóvoa (1995), Demailly (1995), Formosinho (2009), Imbernón (2011), with higher relevance for Martins (2006) that defines four moments for the continuing education, starting with the description of the practical work; the explanation of the practical work mediated by education trends; the comprehension of the pedagogical practice in totality and the collective elaboration of alternative suggestions (MARTINS, 2006). The results point that continuing education is related to events that occur in a national scale, and related to current perspectives, showing that the conception of formation reflects on pedagogical work. It has been identified the limits regarding the formation of coordinators beginning in their work; to defining the role of the coordinator, acting as a trainer; in different areas of knowledge; to exchanging experiences; to planning; to results; to the school necessities. It has been identified that the continuing education serves more for particular interests and not the production and systematization of knowledge.

The importance of communication is vital in wartime. The capability of having all the position information of the allied and enemy forces in a single Tactical Information Display System (TIDS), maintains a great advantage for deciding what to do before the enemy reacts. A Naval Information Distributing System (NIDS) is developed for building an effective communication infrastructure between the war ships. In the designed network, besides the mobile platforms (ships), some fixed platforms (land stations) are used to transfer the information coming from these mobile platforms to all the other platforms. To demonstrate the performance and effectiveness of the Naval Information Distribution System, a discrete event simulation model is developed on a Geographic Information System. The goal of this thesis is to describe and experimentally evaluate an effective and feasible information sharing and routing system for Navy.

Applications of game theory to distributed routing and delay tolerant networking / Applications de la théorie des jeux au routage distribué et aux réseaux tolérants aux délais

Deux situations de comportement égoïste des agents dans les réseaux de communication sont considérées dans le cadre de la théorie des jeux.La première situation concerne les réseaux de communication utilisant un routage décentralisé basé sur des agents autonomes. Nous étudions les propriétés de convergence des dynamiques de meilleures réponses dans un jeu de routage sur des liens parallèles. Le jeu implique un nombre fini d'agents, chacun décidant comment son trafic est routé sur les liens de manière à minimiser son propre coût. Nous proposons l'utilisation du rayon spectral généralisé des matrices Jacobiennes de l'opérateur de meilleure réponse pour démontrer la convergence.La seconde situation apparaît dans les réseaux tolérants aux délais dont l'objectif est de permettre la communication dans des environnements où la connectivité n'est qu'intermittente et où les délais de communication peuvent être très longs. Nous proposons tout d'abord un mécanisme d'incitation basé sur une récompense pour convaincre les noeuds mobiles de relayer les messages, et analysons l'influence de l'information donnée par la source (nombre de copies du message, âge de ces copies) aux relais sur le prix à payer pour transmettre le message. Nous considérons ensuite un modèle dans lequel la source propose une récompense fixe. Les noeuds mobiles peuvent alors décider d'accepter ou non le message, et s'ils l'acceptent, peuvent ensuite à tout moment décider de l'abandonner. Nous modélisons l'interaction entre les noeuds mobiles sous la forme d'un jeu stochastique partiellement observable et analysons les politiques optimales pour les relais. / This thesis focuses on the issues related to the selfish behavior of the agents in the communication networks. We are particularly interested in two situations in which these issues arise and we address game-theoretical framework to study them.The first situation relates to communication networks using a distributed routing based on autonomous agents. Compared to a centralized routing, this type of routing offers significant advantages in terms of scalability, ease of deployment or robustness to failures and environmental disturbances. We investigate the convergence properties of the sequential best-response dynamics in a routing game over parallel links. The game involves a finite number of routing agents each of which decides how much flow to route on each of the links with the objective of minimizing its own costs. For some particular cases (e.g., two players), the convergence of the best-response dynamics can be proved by showing that this game has a potential function. For other cases, a potential function has remained elusive. We propose the use of non-linear spectral radius of the Jacobian of the best-response dynamics as an alternative approach to proving its convergence.The second situation occurs in Delay Tolerant Networks (DTNs) that have been the subject of intensive research over the past decade. DTN has an idea to support communication in environments where connectivity is intermittent and where communication delays can be very long. We focus on game-theoretic models for DTNs. First, we propose an incentive mechanism to persuade selfish mobile nodes to participate in relaying messages, and investigate the influence of the information given by the source (number of existing copies of the message, age of these copies) to the relays on the rewards proposed. For static information polices, that is the same type of information given to all the relays, it is shown that the expected reward paid by the source is independent of the policy. However, the source can reduce the reward by dynamically adapting the type of information based on the meeting times with the relays. For the particular cases, we give some structural results of the optimal adaptive policy. Next, we consider the model where the source proposes a fixed reward. The mobile relays can decide to accept or not the packet and then to drop the packet in the future. This game can be modelled as a partially-observable stochastic game. For two relays, we have shown that the optimal policies for the relays relates to the threshold type.

В заключении обозначены рекомендации по совершенствованию методики распределения субвенций, направленных из бюджета Федерального фонда обязательного медицинского страхования бюджетным территориальным фондам обязательного медицинского страхования на осуществление переданных органам государственной власти субъектов РФ полномочий Российской Федерации в сфере обязательного медицинского страхования. / Final qualifying work (master's thesis) is devoted to the study of financial and organizational innovations in the system of compulsory health insurance. The subject of the research is the analysis of interrelations and interdependencies arising in the process of organization and functioning of the system of compulsory medical insurance as a part of the financial system of Russia and to suggest changes in ensuring the adequacy of financing of the health care system. In conclusion, the recommendations on improving the method of distribution of subventions directed from the budget of the Federal compulsory medical insurance Fund to the budget territorial funds of compulsory medical insurance for the implementation of the powers of the Russian Federation in the field of compulsory medical insurance transferred to the state authorities of the subjects of the Russian Federation are outlined.
