Law is focused as a social phenomenon and development is based on the fundamental objectives set forth in the Federal Constitution of 1988. It’s undeniable that technological innovation is essential in the new development matrix and in the new cycles. In this way, it underpins the economic development, being essential for the advancement of humanity, using Joseph Schumpeter’s economic theory: the creative destruction. In this sense, it presents itself as the structuring axis of the guarantee of economic development, which includes the construction of a free, just and solidary society, reducing social inequalities, promoting the benefit of all, based on the dignity of the human person, sovereignty, citizenship and social values of work, achieving an economic development built on free competition, consumer protection and the pursuit of full employment, and rescuing development in countries of late modernity. / Esta tese estuda a atuação do Estado, com o intuito de investigar e analisar como o Direito influencia o desenvolvimento econômico. O Direito é enfocado enquanto fenômeno social e o desenvolvimento encontra-se assentado nos objetivos fundamentais previstos na Constituição Federal de 1988. Não se pode negar que a inovação tecnológica é essencial na nova matriz de desenvolvimento e nos novos ciclos. Desse modo, ela alicerça o desenvolvimento econômico, sendo essencial para o avanço da humanidade, utilizando a teoria econômica de Joseph Schumpeter: a destruição criativa. Nesse sentido, apresenta-se como eixo estruturante da garantia do desenvolvimento econômico, que inclui a construção de uma sociedade livre, justa e solidária, reduzindo as desigualdades sociais, promovendo o bem de todos, com base na dignidade da pessoa humana, na soberania, na cidadania e nos valores sociais do trabalho, alcançando um desenvolvimento econômico construído na livre concorrência, na defesa do consumidor e na busca do pleno emprego, e resgatando o desenvolvimento em países de modernidade tardia.
