e-Government / e-Government

The aim of this work is to study the theoretical definition of e-Government in the Czech Republic and its subsequent comparison with the actual functioning in practice. The purpose was not only to describe the theoretical concepts and approaches to e-Government, but to show the real problems that are associated with the development of e-Government, and which are not, in my opinion, described in any scientific literature. In the first part, the general definition and different views on eGovernment was described. Also its development in the Czech Republic was briefly mentioned, together with its current legislative and institutional background. The second part describes the actual individual elements of e-Government. The third part of the work was based on the knowledge that I gained during my work at the court and Ministry of Justice. It was motivated by an effort to describe the actual practice and the consequences of the introduction of e-Government. The aim was to describe how are the basic, legislatively modified, parts of eGovernment used in the judiciary, and what has the judiciary made, or is making, beyond the legal obligations, and also to describe interdependence of the various elements of e-Government. Elektronizace civilního řízení / Electronization of civil procedure

The diploma thesis Electronization of civil procedure is devoted to the implementation of the information technologies and institutes of the electronic justice to the Czech civil procedure, mainly to the discovery, executive and arbitrage proceedings. It provides an objective and complex overview of the evolution of these institutes, relations between them, practical problems in the daily use and possible future development. The largest chapter concerns the institutes common to all kinds of civil proceedings, such as acts executed by court (e.g. logging, pleadings, and delivery), acts made by parties (e.g. submissions), evidence and judgment. The course of the discovery proceeding taking into account the electronization is explained in the second chapter. The third one does the same for the executive proceeding. The penultimate chapter is devoted to the arbitrage and mainly to the Online Dispute Resolution. The thesis is ended with the conclusion which summarises the findings (uncoordinated process of adoption, defects in the everyday use, disunited and unlinked user environments) and gives a possible solution to the defects and the disunited user experience of the institutes of electronic justice that has been adopted during the last decade.

The thesis analyzes the e-Justice projects in the Czech Republic. It describes possibilities of application of individual projects, evaluates the status of their development and their potential future evolution. The thesis also analyzes the economic aspects of selected projects as well as discusses the technological aspects of some technologically advanced projects. On the basis of the analysis of present situation and description of e-Justice issues the contribution of this process for the Czech judiciary system as well as the public government or private persons will be described. The main contribution of this thesis is to objectively evaluate the effects of judiciary digitization for the Czech public administration information systems and related areas.

Elektronizace justice v České republice / Electronification of the judiciary in Czech Republic

This thesis deals with questions connected with the electronification of the judiciary in the Czech Republic majoring in the civil judicial proceeding. The first part focuses on the description of the background of electronization of judiciary in the Czech Republic, benefits and barriers associated with computerization. The author describes the conditions to implement e-justice (which are reform of judiciary, development of information society or technical readiness). Process of electronification of the judiciary is illustrated by introduction of eJustice project. There are disscused three basic elements of e-justice in the main part of thesis. These are the electronic judicial record, electronic filing and electronic delivery. Author describes the conditions to implement these features, ascertains the current situation and identifies assets and imperfections of actual solution. Main goal of this thesis is to provide reader with the view of the electronification of the judiciary in the Czech Republic and sum up the most importatnt parts of electonical civil judicial proceeding.
