English smuggling in the eighteenth century

Three main areas are addressed: smuggling as a commercial activity; as a form of social crime; and as a problem of policing. The claim that the violence of the Sussex smugglers in the 1740s was atypical is scrutinised, adopting a comparative approach between regions and over time, and it is argued that force was a rational response adopted by many smugglers when their interests were threatened. The contrabanders extended their penetration of legal markets and distribution networks in the second half of the eighteenth century, but this was accompanied by increasing levels of violence. Studying the confrontations between the smugglers and the preventive forces raises the question of how violent a society England was. The discussion is moved away from the homicide statistics to armed defence and calculated intimidation. The use of violence as a business stratagem raises questions concerning the smugglers' status as 'social criminals.' Illicit importation enjoyed high levels of popular support, but whether contemporaries saw the pursuit of the contraband trade as legitimising murder and mayhem, remains debatable. The adversarial model, in which smugglers are pitted against the forces of the revenue, and represented as the defenders of the local economies against commercial monopolists, is an incomplete picture. Smugglers and revenue officers had to establish a modus vivandi, Collectors and Comptrollers were often leaders in their local communities and active in local politics, and some smugglers were themselves men of standing and influence. The intention is to focus on continuity; in terms of attitudes, methods, and the problems presented to the authorities. The involvement of the continental East India companies indicates that the smuggling trade in the first half of the eighteenth century should be seen as more than a number of locally based, small-scale enterprises The problem for government was that smuggling was more of a business than a form of social protest. Members of the political nation were conscious of the need to compromise for the sake of stability, and the use of the state's coercive machinery against smuggling, the army, navy and the law, is perhaps better seen as an exercise in containment rather than an attempt at repression.

On Random Sampling for Compliance Monitoring in Opportunistic Spectrum Access Networks

In the expanding spectrum marketplace, there has been a long term evolution towards more market€“oriented mechanisms, such as Opportunistic Spectrum Access (OSA), enabled through Cognitive Radio (CR) technology. However, the potential of CR technologies to revolutionize wireless communications, also introduces challenges based upon the potentially non€“deterministic CR behaviour in the Electrospace. While establishing and enforcing compliance to spectrum etiquette rules are essential to realization of successful OSA networks in the future, there has only been recent increased research activity into enforcement. This dissertation presents novel work on the spectrum monitoring aspect, which is crucial to effective enforcement of OSA. An overview of the challenges faced by current compliance monitoring methods is first presented. A framework is then proposed for the use of random spectral sampling techniques to reduce data collection complexity in wideband sensing scenarios. This approach is recommended as an alternative to Compressed Sensing (CS) techniques for wideband spectral occupancy estimation, which may be difficult to utilize in many practical congested scenarios where compliance monitoring is required. Next, a low€“cost computational approach to online randomized temporal sensing deployment is presented for characterization of temporal spectrum occupancy in cognitive radio scenarios. The random sensing approach is demonstrated and its performance is compared to CS€“based approach for occupancy estimation. A novel frame€“based sampling inversion technique is then presented for cases when it is necessary to track the temporal behaviour of individual CRs or CR networks. Parameters from randomly sampled Physical Layer Convergence Protocol (PLCP) data frames are used to reconstruct occupancy statistics, taking account of missed frames due to sampling design, sensor limitations and frame errors. Finally, investigations into the use of distributed and mobile spectrum sensing to collect spatial diversity to improve the above techniques are presented, for several common monitoring tasks in spectrum enforcement. Specifically, focus is upon techniques for achieving consensus in dynamic topologies such as in mobile sensing scenarios.

Collateral effects of securities enforcement in emerging financial markets : evidence from MSCI-LATAM countries

Financial authorities have traditionally relied on fines, suspensions, and bars to discipline misconduct in financial markets and, in that way, protect public investors and promote financial development. In theory, these sanctions should be sufficiently high to internalize the social cost of wrongdoing and deter future misbehavior. In practice, however, public firms are often criticized for being under-punished. This concern has motivated a line of research, especially in the United States, to examine whether enforcement actions initiated by public authorities generate negative indirect effects for the firms accused of misbehavior and, therefore, whether those effects supplement the regulatory sanction. In general, the answer to this question is positive under certain circumstances. Whether or not firms also suffer collateral effects in emerging financial markets, however, is a question that has received little attention in the literature. The purpose of this work is therefore to make a first step to fill this gap. Addressing this gap is important because emerging markets are smaller, less liquid, and more concentrated than the United States' financial market, which might neutralize the side financial effects of enforcement that prior studies have documented. As a result, the policy recommendations proposed in the prior literature are not necessarily applicable to emerging economies. This work focuses on three specific types of collateral effects: the effect of enforcement on (1) the defendant's stock price, (2) the defendant's operating performance, and (3) the cost of external financing. In terms of types of violations and sample countries, this work focuses on enforcement actions triggered by securities regulation violations in the five countries that form the MSCI-EC-LATAM index (Morgan Stanley Capital International Emerging Markets Index - Latin America). The results indicate that the stock price and operating performance of firms whose insiders were sanctioned for insider trading decline significantly after the imposition of the sanction. These results have various implications for the regulation of official penalties as a tool to promote financial development.

An exploratory mixed-methodological analysis of police hostage and crisis negotiation in the United Kingdom

Hostage and crisis negotiators are police officers who have been trained to respond to and resolve hostage and crisis incidents. They are often required to respond to highly-pressurised and emotive incidents that may last for protracted periods of time and are likely to encounter situations whereby their actions could play a role in whether individuals live or die. The first aim of the current thesis was to identify whether negotiators in the United Kingdom (UK) possess certain traits or characteristics that serve to enable them to perform their role effectively and differentiate them from the wider police population. The first phase of the research involved a quantitative cross-sectional comparison of a sample of hostage and crisis negotiators (n = 117) with a sample of non-negotiator police officers (n = 118) from 21 UK forces and a sample of students (n = 203) utilising a psychometric test battery measuring five constructs previously identified within the literature as playing a role in success within occupational settings: Personality, Coping Style, Cognitive Emotion Regulation, Decision-Making Style and Emotional Intelligence. The findings refuted the existence of a “unique hostage and crisis negotiator profile” but confirmed the existence of a unique “police officer profile” by demonstrating significant differences between both police samples and the student sample in relation to all constructs measured. These findings are discussed with reference to the implications for the selection, training and CPD of UK negotiators. Hostage and crisis negotiation is one of many options available to police incident commanders and is well-established as an effective means of resolving hostage and crisis incidents. Whilst there is a plethora of published literature relating to the entity of hostage and crisis negotiation, the majority of this literature has been developed within the United States of America (USA), on the basis of USA negotiator deployments and experiences. The second aim, therefore, was to provide an insight into the discipline of negotiation in the UK by conducting a constructivist grounded theory analysis of the experiences of negotiators as derived from semi-structured interviews with 15 negotiators from nine UK police forces. The findings allowed for the development of five grounded theoretical micro-models: a) The Nature and Characteristics of UK Hostage and Crisis Negotiation, b) The UK Hostage and Crisis Negotiator Journey, c) The UK-Centric D.I.A.M.O.N.D. Procedural Model of Hostage and Crisis Negotiation, d) The UK Hostage and Crisis Negotiator Experience, and e) The Self-Perceived Successful UK Hostage and Crisis Negotiator Profile. These micro-models are discussed with reference to their implications for hostage and crisis negotiation policy and practice in a UK-centric context.

The global problem of sex trafficking in women : a comparative legal analysis of international, European, and national responses

There has been a flurry of legislative action at the international and regional levels to address the global problem of trafficking in persons, which victimises epidemic-proportions of individuals and generates one of the largest proceeds of organised crime. The harmonisation of national legal responses based on minimum standards around prevention, prosecution, and protection as espoused by those international and regional instruments is a prerequisite for effective and wide cooperation among countries of origin, transit, and destination. However, the reluctance of states to lift to the lofty heights of international consensus the contentious policy issues surrounding trafficking, including prostitution, has resulted in the adoption of rather ambiguous anti-trafficking norms and obligations, which allow states to individually determine what constitutes 'trafficking in persons' within their own jurisdictions. The subsequent divergence in national responses reveals that legal harmonisation has not taken place. The mechanisms of enforcement, which attach directly or indirectly to those international and regional instruments, therefore, have the formidable task of assisting states in the implementation of the substantive content of anti-trafficking norms and obligations through their monitoring and reporting mandates. However, their work remains a neglected area of academic research, compared to writings on the ambiguity of the international anti-trafficking framework. The challenge to international regulation of the trafficking problem, as identified in this thesis, relates on a fundamental level to the systemic limitations of the formal processes of law based on state consent and respect for the principles of sovereignty and territorial integrity. Through a comparative legal analysis of international and European legal responses to sex trafficking in women, this thesis illuminates the main systemic challenges to combating trafficking in Belgium, the Czech Republic, Finland, the Netherlands, Romania, and Sweden, and how the work of those enforcement mechanisms remedies some of those challenges.

The Needs of At-Risk Residents and the Design of Community Policing in Detroit

<p> Detroit has high rates of criminal activities and significant numbers of at-risk residents who have challenges with different types of hardship that include economic issues. Although hardships may include various types of challenges, at-risk residents of Detroit are economically challenged because of Detroit&rsquo;s economic downfall. The economic hardships lead to the inability to provide for dependent family members, to battle poverty and addiction, and to possibly other family and societal problems. In larger cities, particularly those economically challenged such as Detroit, because of the inability to hire more patrol officers as the result of insufficient financial resources, police seek the collaboration efforts of community members in the form of community policing to reduce crime. Community policing programs are used to reduce the crime and improve the perception of the police among the residents of Detroit, but they are not effective community policing programs as they do not relate to the needs of economically challenged at-risk citizens. The problem is that ineffective community policing increases the crime in Detroit. The purpose of this study was to investigate and identify the needs of the economically challenged at-risk residents of Detroit as perceived by those at-risk residents of Detroit who are identified through private-public organizations and to compare those needs with those perceived by the police pertaining to community policing programs. This may help in developing effective community policing programs. It was important in this study to identify the needs of the community residents who may perceive that there is no other way to survive but to commit crime that should be considered in developing community policing programs. The study identified education and training as the most significant issues that challenge the economically at-risk residents of Detroit. This study found that the economically at-risk residents of Detroit believe no help is available to them, but the members of the community police officers stated that some help is available for the economically at-risk residents; however, they are unaware of the programs that can benefit them. Police stated that various programs that can feed, clothe, educate, and teach various skills to the economically at-risk residents of Detroit are available and the community policing officers through current neighborhood policing programs can direct the residents to proper resources that they may need. The research instrument consisted of semi-structured interviews of at-risk residents focusing on issues that could identify the people&rsquo;s needs and attempt to understand if the current community policing programs have been addressing these needs of Detroit&rsquo;s at-risk residents. In this study, the results of the interviews and the questionnaires&rsquo; responses were used to identify, code, and categorize patterns found in the improving the community policing in Detroit data.</p><p>

AFTER THE ATTACK: POLICE PERSPECTIVES ON PROMOTING RESILIENCY FOLLOWING THE 2015 SAN BERNARDINO ATTACK

The purpose of this study was to provide an exploration of the experiences and perceptions of law enforcement officers who responded to the December 2nd, 2015 San Bernardino Attacks, specifically addressing what interventions and factors they found helpful in promoting their well-being following the attack. To do this, eight semi-structured interviews were held with officers who either were involved in the scene at the Inland Regional Center or were involved in the shoot-out with the attackers later that day. From these interviews several themes emerged, including: the importance of social support, critique of department responses, unique characteristics of law enforcement culture, and stigma against seeking mental health treatment among law enforcement officers. Recommendations based on these findings for social work practice, law enforcement departments, and further research were discussed.

Toward More Efficient Motion Planning with Differential Constraints

Agents with differential constraints, although common in the real world, pose a particular difficulty for motion planning algorithms. Methods for solving such problems are still relatively slow and inefficient. In particular, current motion planners generally can neither "see" the world around them, nor generalize from experience. That is, their reliance on collision tests as the only means of sensing the environment yields a tactile, myopic perception of the world. Such short-sightedness greatly limits any potential for detection, learning, or reasoning about frequently encountered situations. In result these methods solve each problem in exactly the same way, whether the first or the hundredth time they attempt it, each time none the wiser. The key component of this thesis proposes a general approach for motion planning in which local sensory information, in conjunction with prior accumulated experience, are exploited to improve planner performance. The approach relies on learning viability models for the agent's "perceptual space", and the use thereof to direct planning effort. In addition, a method is presented for improving runtimes of the RRT motion planning algorithm in heavily constrained search-spaces, a common feature for agents with differential constraints. Finally, the thesis explores the use of viability models for maintaing safe operation of user-controlled agents, a related application which could be harnessed to yield additional, more "natural" experience data for further improving motion planning.
