These difficulties have its origins, mostly, in the need of finding a conceptual core that make the concept able to fulfill all the functions that we attribute to it. When we offer a examination of the theme under the perspective of late Wittgenstein s therapeutical philosophy, we don t have in mind to reach the core of the concept or to find a solution to the innumerous problems, but to reveal that these difficulties stems in a misunderstanding about our language, that we can overcome trough a survey. So, the core of this essay comprises the analysis of the therapeutical philosophy and its possible interactions with the human dignity with two intentions: reveal that the ontological or metaphysical model is not the only one and that exists alternatives; clarify that these alternatives are not easily reached, for there is difficulties, some of them in law, which we must illuminate before we reach them. At the end, we believe that this final intention was reached / O presente estudo tem como premissa o reconhecimento de que se enfrenta, hoje, na temática da dignidade humana, inúmeros desafios no que se refere à sua aplicação no campo da ética quanto do direito. Tais dificuldades originam-se, sobretudo, da necessidade de encontrar-se um núcleo conceitual que o torne apto a desempenhar todas as inúmeras funções que tal idéia, hoje, é chamada a desempenhar. Ao se propôr um exame de tal tema sob a perspectiva da filosofia terapêutica do segundo Wittgenstein, não se objetiva alcançar esse núcleo conceitual perseguido, tampouco encontrar uma solução para as inúmeras dificuldades apontadas, mas antes revelar que tais dificuldades são fruto de um mal-entendido, que pode ser superado através de uma visão clara de nossa gramática. O cerne do trabalho consiste, por conseguinte, em analisar esta filosofia terapêutica e suas possíveis interações com a temática da dignidade com um duplo objetivo: mostrar que o modelo ontológico ou metafísico não é o único possível e que existe alternativa, inclusive com repercussões interessantes dentro do direito; deixar claro que essa alternativa não é facilmente alcançável e iluminar as dificuldades, inclusive dentro do direito, para que seja alcançada essa mudança de perspectiva.
