The subject of this thesis is to evaluate the issue of judicial enforcement of claims in legal theory and practice. The first part is devoted to an explanation of key concepts in terms of legislation. The next part shows the possible ways of enforcing judicial claims. The final part evaluates the results in terms of qualitative and quantitative indicators.

The bachelor work aims at the administration and recovery of claims of an entrepreneur in the legal and market environment of the Czech Republic. The text lists an analysis of out-of-court and legal instruments that can be used for managing the life cycle of a claim. It also looks for recommendation for increasing the efficiency of managing business risks in order to minimize creation of uncollectible claims. The target of the work is to define weaknesses of the administration of claims in a company with a high accumulation of business deals, with a high number of customers buying the service with a due date payment. Reduction of such negative influence and thread follows, implementation of individual instruments of claim administration that leads to fast and most importantly efficient recovery of claims.

The diploma thesis deals with insolvency proceedings where the debtor's bankruptcy is solved by discharge of debts by fulfilment of the instalment schedule. The aim of the thesis is to verify three hypotheses expressed in the introduction. The author evaluates bill amending Act no. 182/2006 Coll., On Bankruptcy and Its Resolution (Insolvency Act), as amended, and certain other acts, which should become effective on 1 September 2016, particularly in the context the provision of services in the elaboration of an insolvency petition relating to the proposal to permit debt relief. More attention is paid to the performance of debt relief instalment schedule, especially Deductions from income of the borrower when one income, foreign income and income arising from the donation agreement or contract for retirement. The paper also compared the liquidation of seized property of the debtor in insolvency proceedings and enforcement proceedings. Finally, the work contains several proposals de lege ferenda, opinions of the author and their own approaches to solving problems associated with Discharge of debts by fulfilment of the instalment schedule.

The aim of this thesis is to determine the market value of joint-stock company MSV Metal Studénka for 31. 12. 2015. The thesis is divided into theoretical-methodological and practical part. The former contains the definitions of terms, techniques and methods which relate to not only the problems of company appreciation but also insolvency law focusing on corporate restructuring. In the practical part, the theoretical groundwork is applied. After the initial introduction of the company including a brief description of the course of insolvency proceeding, a strategic and financial analysis is conducted. After the evaluation of the company's financial health and future perspective, a division of assets into operationally necessary and unnecessary, analysis and value generator prognosis, financial plan formulation and the evaluation itself follow. For the final company appreciation, the discounted cash flow method in the variant of free cash flow to the firm (FCFF) is used.

This thesis is focused on the solution of the corporate bankruptcy. Its goal is not only to determine the causes of the bankruptcy of FEREX ŽSO spol. s r.o. after successful completion of the reorganization, but also to assess the suitability of the chosen method of solution in terms of the Insolvency Act. The work is divided into theoretical and practical part. The theoretical part describes the life cycle of an enterprise, important parts of the insolvency law and financial analysis methods. In order to meet the goals there are used financial analysis, analysis of the insolvency proceedings and comparison with results of researches in the field of insolvency.

The thesis is focused on the causes and consequences of default of Saab. The aim of this thesis is to define the long-term factors that contributed to insolvency and describe the process of insolvency proceedings in Sweden compared to Czech Republic. Definition of causes which brought company to default is based on analysis of the industry and car sales. Financial analysis and comprehensive evaluation enterprise models are used to assess the financial health of the company. The thesis contains also description of the expected development of the newly established company, which has become the successor of car manufacturer Saab.

There is a wide range of different algorithms for insolvency prediction. The complex concept of insolvency proceedings from the point of view of both parties (debtor versus creditor) and from the point of view of the macroeconomics in this dissertation is new. It is often very difficult to generate forecasts using numerical quantifiers and traditional statistical methods. The reason is the lack of input data. Therefore, the work uses trend analysis tools based on the least information intensive quantifiers, ie trends, increasing, constant, and decreasing. A trend model solution is a set of scenarios where a set of variables is quantified by these trends. All possible transitions between the scenarios are generated and plotted in transition graphs. The oriented transition graph has as a node a set of scenarios, and as a branch the transitions between the scenarios. The given path through the transition graph describes any possible future and past behavior of the insolvency system being investigated. The Transition graph is a complete list of trend-based forecasts. The heuristics for determination of the payoff values from the insolvency proceedings applicable to the decision tree tools and the generated transition graphs from trend analyzes are also presented and used in the thesis. A nine-dimensional model serves as a case study. Vague variables are used in models that may have a major impact on the entire insolvency process, eg greed level and political situation.

This diploma thesis is devoted to the issue of indebtedness of natural person citizens of the Czech Republic and the follow up solution proposal, which aim is eliminate this problem. Selected theories of human capital and the consumerist society best describe theoretical concept debt issues. Consequently, this chapter is followed by the application of state policy instruments, which can mostly be sort of legislative action, educational activities and information and communication tools. They are a very important component, since all the measures breathe life. An important component of this thesis is to research, which was carried out in several directions, taking could then occur between individual variables to verify hypotheses. The extension of knowledge in the field of theory and research led me to the various proposals on how to solve the problem. In summary, it is a modification of the entire lending process and the subsequent recovery, which would in case of implementation of indebtedness persons decreased while satisfying yield "creditable" lenders. The aim of this work was to analyze complexly the failure of financial market entities, with the accent of a banking institution, comparison with the European legal system, but also with the emphasis on solving the financial crisis of the banking system and its ways of resolving or maintaining the activity, possible insolvency of banking entities. At the end of the thesis, the author also deals with practical aspects of selected banks. From the above point of view, three sub-concepts are key to this work, which deserve a brief explanation as they permeate the work and gradually reveal the basic issues of the subject matter, but also their hypotheses outlining the next direction of research, and at the same time offers some legislative guidance material solution of the given issue. The first term is the "starting point". In this work, there is a detailed survey of research to find answers to the question as to what are the basic points of the financial market entities as well as banking institutions, but above all their failure. The thesis is focused on questions of natural persons' recovery of debts according to the legal order of the Czech Republic. The purpose of the thesis was to provide creditors with comprehensive information and insight into the questions of recovery of natural persons' debts according to the legal order of the Czech Republic and to draw creditor's attention to legal possibilities when recovering debts. The outcome of the thesis is creation of diagram that can help creditors to better orientation. Diagram shows separate steps creditors can undergo when recovering debts. Particular possibilities when recovering debts are outlined, practical instruction and remarks are added, economic contexts are analysed, available statistics and development trends are analysed and proposals de lege ferenda are presented.
