Investigate the relationship between I and other as driven and universalized conducts. After this theoretical definition, based upon the dialectical study on Jürgen Habermas e Michel Foucault, the work searches differentiate public and political in the democratic and constitutional context, exploring the institutional formation of State as enterprise of Law and whose interests are elevated in the construction of the later. From the logical of separation of powers, analyses the space of political domain. Finally, it intends to question about delegations of responsibilities to the Public Power: a society that inserted itself in an age of delegations of responsibilities of private matters which charges to the scope of Public Power taking actions about responsibilities and decisions of individual imprint, whose direction is given by devices (laws, sentences etc.) that creates a legitimate discourse about the theme which wants to debate, setting, at the end of a chain of relations of power, socials and normative, the Judiciary. / A dissertação que segue é a procura do entendimento sobre as noções modernas de subjetividade e pensamento jurídico, bem como o reflexo institucional que isso acarreta. Investiga a relação entre eu e outro enquanto condutas dirigidas e universalizadas. Após essa definição teórica, baseada principalmente no estudo dialético de textos de Jürgen Habermas e Michel Foucault, busca diferenciar público e político no contexto democrático e constitucional, explorando a formação institucional do Estado como criador do Direito e quais interesses são elevados na construção deste último. A partir da lógica da separação dos poderes, analisa o espaço de domínio político. Finalmente, pretende perquirir sobre a delegação de responsabilidades aos âmbitos do Poder Público: uma sociedade que se inseriu em uma era de delegação das responsabilidades de assuntos privados a qual encarrega aos âmbitos do Poder Público a tomada de providências sobre responsabilidades e decisões de cunho individual, cuja direção passa a ser dada por expedientes (leis, decisões judiciais etc.) criadores de um discurso legitimador acerca do tema que se quer debater, acionando, ao final de uma cadeia de relações de poder, sociais e normativas, o Poder Judiciário
