Crime related to the use of new media by children Mgr. et Mgr. Kateřina Kudrlová Abstract: The thesis confirms two hypotheses: young people online are put at risk of crime and commit crime as well. It is based mostly on the study of documents and scientific literature and analyzing of statistical data. The predominantly criminological perspective sets out the specifics of cyberspace and mentions some of its technological, sociological, psychological and at last but not least legal aspects. Furthermore, the thesis demonstrates the use of cyberspace by young people and the risks that users face. The main aim of this thesis is to find out which attacks on information systems pose a threat to the state and whether new technological trends represent a challenge for the current Czech legislation in the field of criminal law. The methodology varies across this thesis. The analytical method together with the synthesis is used to fulfil the aim. In some parts, an empirical approach is used. The introductory part of the thesis explains the key institutes in the field of cybercrime and international instruments for combating cybercrime. The most important document is the Council of Europe Convention on Cybercrime. The main part of the thesis is devoted to the difficulties of current Czech legislation in connection with cyberattacks. This trend can be also observed in the healthcare sector which has recently experienced massive electronization. However, along with electronization, respective criminal law aspects are developing as well. Relevancy of this issue can be clearly demonstrated on the recent cyber-attacks on healthcare providers, which seriously jeopardize valuable data in healthcare. Criminological and criminal law aspects of the ransomware spread Abstract This diploma thesis examines different aspects of criminology and criminal law with the issue of the malware spread in the form of ransomware. This text is divided into two main parts. First, the theoretical part consists of the chapters about cybercrime, malware and criminological and criminal law aspects of ransomware spread. It uses the substantive law and also procedural law perspective. All chapters are divided into subchapters dealing with the questions of offenders and victims, criminal law qualification of the ransomware phenomena and with related concepts used for the broader understanding of this kind of cybercrime. Second, the analytical part follows. This thesis combines different criminological research methods and tries to verify the main hypothesis regarding the increase in the number of ransomware attacks in the Czech Republic. Criminal and criminological aspects of ransomware spreading Abstract This diploma thesis deals with issues of ransomware spreading and examines certain criminal and criminological aspects of this cybercrime phenomenon. Ransomware is malware that encrypts, blocks or prevents access to the computer system or data in a computer system. In connection to this, it demands monetary or other ransom. This diploma thesis firstly describes ransomware from the point of view of its function and technical aspects, including its history, categorization of its variations and description of several notable infection examples, namely WannaCry, Petya, DoubleLocker and Vir Policie. Criminal and criminological aspects of cybercrime with a focus on denial of service attacks Abstract The aim of this master thesis is to analyze the criminal law assessment of denial of service (DoS) cyber-attacks and related criminological aspects. The author deals with the technical characteristics and typology of this type of attack. He analyzes its individual variants, as the way of performing the attack, that is reflected in its criminal assessment. The thesis also describes the facts concerning the largest series of DoS attacks that occurred in the Czech Republic in 2013. Next, the author deals with the criminological aspects of cybercrime, namely its expansion and latency, the perpetrators and victims of the denial of service attack and related prevention, including techniques and methods of defense against this attack. 1 Latent criminality Abstract This submitted diploma thesis deals with the phenomenon of latent criminality. Latent criminality is the part of criminality that is for some reason not registered by the law enforcement authorities. The thesis itself consists of four consecutive chapters. The first chapter deals with the concept of crime. It discusses the different approaches to concept of crime in criminology and the indicators that are used to describe it. Furthermore, this chapter is dedicated to the division of crime into latent and registered crime and the sources of information about registered crime. In particular, it focuses on official crime statistics. In the second chapter, the issue of latent crime is discussed in more detail. It defines the concept of latency, in which cases it is considered being latent criminality and what its types are. Furthermore, the ratio of latent and registered crime, the rate and extent of latency are described. At the end the possible causes of its existence are presented, one of the main reasons being the failure to report the crime by its victims. The master thesis is divided into five separate chapters. The first chapter deals with the general definition of cyberbullying as a new phenomenon and its comparison with the traditional form of bullying, defines other key terms and defines the victim and perpetrators of this behavior, including these types and typology. Violation of Authors' Rights Using Cyberspace Abstract This diploma thesis describes violation of authors' rights in cyberspace, especially the most common ways of committing this crime. The thesis is divided into five parts. The first chapter contains a general introduction to the topic, it defines the basic concepts (such as computer and related terms of hardware and software, internet, cyberspace and cybercrime), which serve as a basis for other parts of the work. The second chapter deals with copyright as such. It explains the concept of copyright work and describes the individual rights of the author.
