Kriminologické aspekty kybernetické kriminality / Criminological aspects of cybercrime

Criminological aspects of cybercrime Abstract (EN) This thesis is a study of specific aspects of cybercrime in regards to banking and non- banking financial institutions in Czech republic. By comparing results of third-party analytical resources and own findings obtained by strategically performed interviews with personnel in leading positions in cyber-security careers, the thesis describes causes and results of cyber-attacks and related preventive measures with emphasis on their respective place and priority in the cybersecurity policy of the organization. The main finding is that the biggest risk to the organization seems to be its own employees. That is why the entity cannot simply trust in the security of its perimeter by protecting only its border, but has to also consider its internal part. An equally important finding is the fact that mechanisms for the prevention of cybercrime take a large number of non-mutually exclusive forms, and in order to maintain the highest possible level of security, it is appropriate to layer these measures into complex units. This thesis is focused on cybercrime, acquisition of evidence and development of a platform for retrieval, analysis and archiving web site data. The goal is to satisfy the investigators and security experts of the Czech police. The aim is to provide an open source platform that will be freely disseminable and in compliance with the requirements of legal institutions. The output of the thesis is two platform versions - full-fledged, fulfilling all the requirements set out in the diploma thesis and a light version for the police investigators of the Czech Republic.

1 Thesis title, keywords and abstract Thesis title: Sexually motivated cybercrime Keywords: cybercrime, virtual child pornography, sexting, pornographic performances, cyber grooming, sexual solicitation of children This master thesis deals with the issue of cybercrime against persons more specifically with sexually motivated crimes. The thesis is divided into five separate chapters. The first chapter deals with cybercrime in general, its taxonomy and the necessary terminology, it also describes some of the criminogenic factors of cybercrime relevant for the issue. The second chapter presents the most important applicable international legal instruments. The third chapter describes the issue of illicit pornography especially child pornography. For the subsequent chapters the author's own taxonomy was used and they overlap in part. The fourth chapter explores the phenomenon of sexting and the use of web cameras for sexual purposes as a consensual activity. In the fifth chapter the misuse of these activities for the purposes of child grooming, extortion and commercial sexual exploitation of children is examined. Právní aspekty boje proti počítačové trestné činnosti / Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.
