My master thesis primary focuses on proceedings in matrimonial cases and its related issues. Precisely, it deals with the marriage itself and it is supported by individual proceedings of marriage authorization and other specific status matrimonial case proceedings. The largest part of my thesis is however dedicated to divorce due to arising negative impacts divorce has on humanity worldwide and it is considered as one of the most recent and most discussed issue nowadays. The goal of my thesis is to provide the overview of law changes in individual matrimonial proceedings and more importantly their characters, supported by both theoretical and practical examples. While exploring above mentioned problematic, at the same time I engage in substantive law as well as in procedural law due to their mutual cohesion. For the sake of the differentiation of proceeding in matrimonial cases, text of this work is divided into four main chapters, where every chapter includes several subchapters to specify the concrete proceeding's character and its process. The first chapter defines general term of proceedings in matrimonial cases and provides an integrated overview of all individual proceedings such as authorization of marriage and status matrimonial cases. Zusammenfassung Als Thema meiner Diplomarbeit habe ich das "Ehescheidungverfahren" ausgewählt. Zur Auswahl dieses Thema haben mich viele Gründe bewegt. Vor allem möchte ich meine Diplomarbeit einem praktischen Thema widmen, das sich mit der Lösung von alltäglichen Lebenssituationen befasst, und diese Kenntnis könnte ich später in meiner Karriere als Rechtsanwältin verwerten. Angesichts der neuesten Statistiken, nach denen so ziemlich jede zweite Ehe geschieden wird, scheint dieses Thema sehr praktisch zu sein. Das Ziel meiner Diplomarbeit ist eines Ehescheidungverfahrens nach dem Gesetz Nr. 292/2013 über besondere Gerichtsverfahren, in der Fassung der späteren Vorschriften, das am 1. Januar 2014 in Kraft trat, zu analysieren. Das Gesetz über besondere Gerichtsverfahren, das in Rahmen der Änderungen des privaten Rechts aufgenommen wurde, brachte in das Scheidungverfahren eine Reihe von Neuerungen, deren Zweck es ist, die Mängels an vorherigen Prozessvorschriften zu beseitigen. Die größte Änderung im Zivilprozessrecht ist die Ausklammerung der außerstreitigen Verfahren aus dem Gesetz Nr. 99/1963 der Zivilprozessordnung, in der Fassung der späteren Vorschriften, in das Gesetz über besondere Gerichtsverfahren. This thesis reviews the housing-related implications of separation and divorce for women. It arges that the housing circumstances must be placed within a broader perspective of the social and economic consequences and ideological environment surrounding divorce. In the same way, operation of the housing system must be placed within a wider context, particularly in relation to the degree of change in its operational environment within the last 20 years. The thesis finds that the circumstances surrounding leaving a marriage are personally traumatic, and lead to a period of economic, housing and personal crisis. Over time, although the tendency is for establishment of re-equlibrium, considerable disadvantages prevail for women. The quickest method of establishing re-equilibrium for women is to repartner.
