The goals of the dissertation studies were to allow for psychologists and educators to better understand the relationship between non-clinical narcissism and creativity, and to develop two promising creativity measures. The results confirmed the hypothesis that there would be a positive, moderate correlation between non-clinical narcissism and creativity. Consequently, this could allow for researchers to more fully understand the components of creativity, and support the need for creativity measures to better account for non-clinical narcissism. Two measures were introduced to consider creativity in terms of feelings and thoughts, and non-clinical narcissism attributes of past creative individuals. The Creativity Attributes List (CAL) and the Creative Individual Assessment (CIA) differ from previously established creativity measurements, which use the current impressions of the achievements of contemporary people as their criterion. There were 147 participants in a study that examined the two measures and the relationship between non-clinical narcissism and creativity. Additionally, the experimenter attempted to increase short-term creativity by exposing participants to photographs of paintings with unconventional shape designs that depict both the mindsets and art of creative persons; albeit, the results did not indicate a significant difference in the movement of creativity scores for either the experimental or control group. The double-blind experiment with 80 participants was conducted independently from the aforementioned studies. The Appendices include three papers that were based on the data collected from the psychometric studies and experiment. They were submitted to refereed psychology journals. The first paper pertains to emotional arousal and creativity, the second paper pertains to sleep deprivation in graduate school students, and the third paper explores variables that have a significant relationship with creativity in graduate students. There are graphs and tables in the Appendices that explain the MANOVA and correlation results of the CIA attributes that had a significant relationship to either the Khatena Torrance - Creative Perception Inventory Something About Myself measurement (KTCPI-SAM) and/or the Khatena - Morse Multitalent Perception Inventory Creative Imagination scale (KMMPI - CI). Additionally, tables in the Appendices present the results of multiple regression analyses performed on selected attributes from the CAL assessment and factor analyses of the measurements introduced in the studies.

Arbitral provisional measures are of great importance in protecting the rights of the parties to an arbitration agreement. Arbitration as a dispute mechanism is becoming increasingly powerful due to the ability of tribunals and courts to grant and enforce provisional measures which make the final award meaningful. The importance of provisional measures has increased in recent years as more parties are seeking them, and is likely to grow still more in the coming years. This project examines the problems surrounding arbitral provisional measures in England and Wales; as such problems constitute a threat to current and future arbitration. The thesis aims to identify, analyse and offer solutions to those problems that impede arbitral proceedings. This thesis initially examines the roots and the legislative development of the powers of arbitral tribunals to grant provisional measures and the role of the courts in arbitral proceedings in England. The examination highlights the roots of the problems and demonstrates how the approach towards provisional measures in England has shifted in due course from judicial dominance to arbitral competence, and how the role of the courts has become subsidiary. Further, the analysis highlights the problem of arbitrators in the granting and enforcement of provisional measures across borders, due to the inadequacy of the current Arbitration Act 1996, which provides very limited power to tribunals under its S.38,39 and 48. Additionally, the research aims to demonstrate that arbitral tribunals should be given effective and actual authority to grant arbitral provisional measures in order to comply with the arbitration agreement (party autonomy). Since no dispute mechanism can stand alone as an island, the courts should only become involved in support of the process – subject to the arbitral Acts that provide them with exclusive jurisdiction –where this is necessary in order to avoid conflicting decisions. However, the power of the courts to aid arbitration in granting such measures is limited by Council Regulation (EC) 44/2001 of the European Union, of which England is a member. In international arbitration, timely application and enforcement of interim measures have a substantial effect on the possibility of the enforcement of a final arbitration award, especially when issues relating to the protection of assets or evidence arise before or during the course of proceedings. Hence the purpose of this project is to provide a brief analysis of the international practice regarding the enforcement of provisional measures in international arbitration.

Thesis (MBA)--Stellenbosch University, 2015. / ENGLISH ABSTRACT: Manufacturing plants should strive towards achieving and maintaining good safety records. It is however difficult for plants to identify specific safety problem areas that can be improved on. One way to identify specific safety areas that needs improvement is by conducting a safety culture survey. A manufacturing plant within South Africa realised the need to improve on its safety performance. However, it was not clear which aspects of its work and safety related practices were at risk. Management therefore decided to obtain an assessment of the safety culture profile of the plant. The assessment was done by way of a plant-wide safety culture survey. The safety culture questionnaire was developed, as part of this research, through an in-house consultation process. This process resulted in identifying 16 different safety-related themes. With the help of literature, these themes were further explored to design the questionnaire. The identified safety themes were measured during the survey and results obtained for each of the plant’s identified safety practices. The survey also provided an overall mean score of the plant’s safety culture, providing management with a better understanding of where they stand in their safety improvement journey. The plant’s equipment, materials and tools; overall rules and regulations; environment, health and safety suggestions; rewards and reinforcement; and management involvement practices was identified as practices that require an immediate response. The plant’s incident reporting and investigation, discipline and training safety practices were identified as less urgent risks.
