Mediace jako alternativní způsob řešení sporů v Evropě / Mediation as a form of alternative dispute resolution in Europe

The aim of this diploma thesis is to explore the term mediation, its principles and its process. Another aim is a comparison of selected mediation rules and last but not least assessing the quality of the implementation of Directive 2008/52/EC of the European Parliament and of the Council of 21 May 2008 on certain aspects of mediation in civil and commercial matters into the legal order of the Czech Republic and the Netherlands. The content of the first chapter is focused on mediation and its place among the alternative dispute resolution methods. The thesis engages in the meaning of this term, its historical grounds, principles, the fundamental classification of mediation approaches, the evaluation of its advantages and disadvantages as well as the analysis of phases of the mediation process. The second chapter deals with the institutionalized mediation. After analyzing this term, the advantages and disadvantages of this approach are explained. The main part of this chapter is the examination and the comparison of the most important provisions of mediation rules of prestigious, Europe-based international institutions such as ICC, VIAC and WIPO as well as the UNCITRAL Conciliation Rules, which are applicable for ad hoc mediation. The aim of this thesis is to introduce the concept of cross-language mediation, which is well established in some countries abroad but is not widely used in the Czech environment, from various points of view. The work tries to show that cross-language mediation is an engaging, effective and interesting activity preparing the learners for real-life mediating situations employing both mother tongue and English. The work is enriching for its battery of mediation activities designed for the Czech context, mediation assessment criteria and a survey among Czech and foreign teachers summarizing their attitude towards mediation and its role in EFL lessons. Mediation and its usage in labour law litigation and in employment issues Abstract This thesis provides an insight into the field of mediation as an alternative method of dispute resolution. This method is approached through the optics of labour law litigation perspective which in the author's point of view offers a huge potential for further development. Even though the key point stands in the field of labour law, the whole thesis has an interdisciplinary design following the design of the method described. The interdisciplinary focus aims to the fields of psychology, sociology and philosophy. The thesis is divided into four main sections. Their composition follows the focus point from concrete to abstract concepts. The first part aims to integrate the field of labour law into the law system. The main focus is given to the dualism of the law system and the relation of the public and private law considering its relation to the labour law. My master thesis deals with the topic of alternatives to unconditional sentence of imprisonment. It is a vast topic, thus I have focused on alternative sentences in the narrower sense of the term, in other words, suspended sentence of imprisonment, suspended sentence of imprisonment with surveillance, community service, financial penalty and house arrest. The goal of this thesis is to discuss lawful legislation of alternative sentences, to evaluate their practical usage and potentially, to suggest changes de lege ferenda, which could lead to higher rate of application of these sentences. The thesis consists of an introduction, seven chapters and a conclusion, where the three initial chapters are written in general sense. The first chapter is concerned about the term and the purpose of sentence. The concept of restorative justice, which provides us another way how to react to the criminal acting, is introduced as a part of this chapter, too. The second chapter focuses on unconditional sentence of imprisonment and issues of the short-term sentence. Furthermore, the term of alternative sentence is explained, including a brief commentary on actions of international organizations in this area, namely Council of Europe and UN. 56 Abstract The purpose of this work is to introduce the concept of Alternative Dispute Resolution as a full alternative to civil judicial proceedings. Emphasis is placed on the utilization of the alternative procedures in the Czech legal environment and on contemporary Czech legislation as well as its possible future development. The thesis was elaborated using primarily domestic professional literature, while a significant portion of the resources was represented by legal enactments including the relevant legislative history. This thesis only deals with foreign approaches to Alternative Dispute Resolution marginally, which is reflected in the choice of resources - foreign resources have been used to a very limited extent. Following the initial overview of the topic and the introduction of the author's relationship to the concept of Alternative Dispute Resolution, this thesis presents the theoretical classification of these methods and collectively enumerates the legal regulations pertaining thereto. My Diploma Thesis themed ``the Crisis centre for children and family in the South Bohemian Region within an intervention care{\crqq} has a research character. This thesis is divided into two large parts and consists of a theory and practice. The theoretical part is divided into five major chapters. The first one describes the Crisis centre for children and family in the South Bohemian Region. The second one is devoted to CAN syndrome. The third one deals with the most important legislation solving breaking of the basic children rights. In the fourth chapter I focus on family and the last one is devoted to divorces, serious child suits, solving of divorce suits in a Crisis centre. The practical part is research oriented. The aim of the thesis was to find out to what extent the intervention care is implemented in the work of the Crisis centre for children and family in the South Bohemian Region during a divorce period and after. In the first hypothesis I supposed that the clients who used the support to families in a difficult life situation in the Crisis centre for children and family in the South Bohemian Region managed to keep their role of parentage also after the divorce and finished conflicts and child manipulation. In the second hypothesis I supposed that clients managed to keep their role of parentage also after the divorce and finished conflicts and child manipulation regardless of being married, divorced or single and whether they care together for own or adopted child. To confirm or disconfirm the defined hypotheses I used the method of a questionnaire. The questionnaires were intended for employees of the Crisis centre for children and family, the clients of the Crisis centre for children and family in the South Bohemian Region and to public. I prepared a different type of questionnaire for each group. In total I handed out 115 questionnaires. All of them were returned to me. The return was 100%. The hypotheses are analysed at the end of the practical part. They were confirmed. In the conclusion of the thesis the knowledge based on the theoretical and practical parts are included. The last part includes annexes referring to the actual matters (e.g. an International co-operation within a child care, casuistry, the leaflet of the Crisis centre for children and family in the South Bohemian Region).

The aim of thesis is to propose specifications of workshop named Profesní navigace, co se životem na prahu dospělosti?, which is organized at the Faculty of Management of University of Economics (FM VŠE) in Jindřichův Hradec. The seminar is aimed at helping students, who are looking for answers to their questions, which are connected with their entry into adulthood. Trained tutors, authors of course, help them with using the method of process-oriented work. In the theoretical part I am writing about personality development and about methods, which are using to conduct these courses. In the practical part I am applying acquired knowledge into concrete recommendations for further development this workshop.

Diploma thesis deals with the possibility of consumer dispute resolution outside the courts and its emphasis on functional approaches in the Czech Republic. Is described the Project of the Ministry of Industry and Trade for Ensuring Out of Court Settlement of Consumer Disputes which presents new opportunities for Czech consumers. The analytical part of the work represents an analysis of the functioning of the two-year pilot phase of Project, an evaluation its results on the basis of statistical data on the number of complaints, on the basis of results of ADR questionnaire and on the basis of results of questionnaire surfy aimed to general awareness about the Project. Obtained data are evaluated and suggested solutions to improve the operation of the Project.

Diploma thesis "Mediation Analysis in Sociology" deals with mediation analysis and possibilities of its application in sociology, depending on the type of the dependent variable that enters the analysis. In the first case the dependent variable is continuous - in this case the SPSS software and its PROCESS add-on are used to directly analyse the mediation. In the second case the dependent variable that enters the analysis is binary - the PROCESS add-on doesn't allow this option; therefore, the analysis is performed in SPSS software by the set of linear and logistic regressions according to the Baron & Kenny method. Two case studies from the field of sociology, GSS (General Social Survey) and ISSP (International Social Survey Programme), are used in the thesis and the consequences of the transition from continuous dependent variable to binary are examined using the secondary analysis of these data.

Transformace konfliktu na lokální úrovni: Ženy mediátorky v Burundi / Transforming conflict at the local level: Women peace mediators in Burundi

Armed conflict affects men and women differently due to their previous roles in the society. For instance, it often crucially changes the status of women and enhances their emancipation. Therefore, women should be included in conflict resolution as well as in peace negotiations and post-conflict reconstruction, to ensure sustainable peace. Examples from many African countries driven by conflict denote that women are not automatically included in these processes. This single intrinsic case study documents the work of women peace mediators in Burundi. At the theoretical level, the study argues for an elicitive endogenous approach to peacebuilding, embedded in the conflict transformation theory by John Paul Lederach. Nevertheless, theoretical concepts are not emphasized because they tend to limit the mediators' agenda which actually involves a wide range of conflict handling mechanisms. The main part of the study is based on semi-formal questionnaires filled out by women peace mediators in Bujumbura. The goal of the research is twofold: First, it is aimed to introduce the mediators and to understand their motivations to mediate.
