This thesis deals with the topic of international mediation. It starts with its theoretical concept and analyzes the individual elements of the definition of mediation, which it divides into essential and additional. It then covers the history of the mediation procedure in the ancient times and the modern approach. It also attempts to solve the confusing terminology of mediation and conciliation. In chapter two it moves on to the description of other hybrid forms such as MEDALOA, med-arb or arb-med. The third chapter describes the individual forms of mediation with focus on court mediation in particular. First, its implementation possibilities are explored, which are followed by practical examples of judicial mediation in different countries. Chapter four is devoted to the regulatory framework starting with international documents. It compares mediation rules of several mediation institutions across the world. Then it investigates the pros and cons of the European mediation directive 2008/52/ES and two codices of behavior for mediators. Finally, the last part of chapter four is concerned with Czech mediation law. It provides an outline of the Law No. 202/2012 Coll. and the newest soft law document - Codex of attorney-mediator. Mediation as a method of alternative dispute resolution The purpose of this thesis is to introduce mediation as a method of alternative dispute resolution and point out its potential. The thesis is divided into five chapters. The first chapter presents various methods of ADR including so-called hybrid forms. There is also a summary of advantages and disadvantages that are associated with these forms of dispute resolution. The second chapter starts with the historical development of the institute of mediation and continues with the presentation of various forms of mediation. This chapter also discusses a mediator, his role and aspects that should be taken into account when parties want to choose a suitable person. Then particular phases of the mediation process are analysed. The third chapter is concerned with the international regulation of mediation. It is divided into two parts. The first part focuses on mediation regulation contained in the mediation rules of particular international institutions. En ratifiant la Convention pour la sauvegarde du patrimoine culturel immatériel proposée par lUNESCO , chaque Etat signataire sest engagé à prendre des mesures destinées à assurer la viabilité des traditions orales (légendes, musique, chansons, etc.), des rituels festifs, des croyances, des savoir-faire et tout ce qui constitue un patrimoine, transmissible en soi ou comme valeur ajoutée aux patrimoines naturel, mobilier et immobilier, présents sur son territoire. Définies dans le texte de la convention, comme « lidentification, la documentation, la recherche, la préservation, la protection, la promotion, la mise en valeur, la transmission et la revitalisation des différents aspects de ce patrimoine », ces mesures nécessitent au préalable létablissement dun ou de plusieurs inventaires nationaux, régulièrement mis à jour. Le présent travail était destiné, à lorigine, à mettre au point une base de données du patrimoine immatériel en Belgique romane, mais, comme aucune étude théorique globale ne sétait encore penchée sur le bien-fondé de linventorisation, pas plus dailleurs que sur celui de la « sauvegarde », il a évolué au cours de sa rédaction en une réflexion sur les enjeux, les conditions et les pratiques de la transmission et ce, dans une approche interdisciplinaire mêlant lanthropologie, lhistoire, la sociologie, léthique, les sciences politiques, et faisant même ponctuellement appel à la linguistique, à la musicologie, voire à la neurologie ou au droit international. Ma recherche est à la fois théorique et pragmatique ; elle intervient après une trentaine dannées passées sur le terrain à observer, enregistrer, filmer, photographier, les traditions orales et gestuelles de petites communautés inscrites dans le cadre géographique restreint de la Wallonie, tout en ne négligeant pas lapport dexpériences extérieures à cet espace. Mon hypothèse de base est quil existe un patrimoine culturel immatériel propre à chaque communauté socioculturelle (de taille et de composition variable), qui permet, face à une menace de mondialisation culturelle, de fonder une « ethnicité positive », apte à sociabiliser davantage quà isoler. La mise en valeur de ce patrimoine ne constitue pas un repli sur soi et sur le passé mais une ouverture vers une diversité culturelle, exempte de toute hiérarchisation. La thèse ne prétend pas, en quelques centaines de pages, résoudre tous les problèmes théoriques que posent la transmission et la sauvegarde du patrimoine immatériel, mais propose une première réflexion sur les contenus, les finalités, les modes de transmission et les médiateurs utiles ou nécessaires, puisque telle est bien linterrogation que nous pose aujourdhui le maintien de cette « diversité culturelle ». The purpose of this thesis is to present the main features of out-of-court dispute resolution (alternative dispute resolution) with mediation in civil and commercial issues under Directive No. 2008/52/EC, Act No. 202/2012 Coll., on Mediation and Change Some Laws ("Medition Act"), and Spanish Act No. 5/2012 on Mediation in Civil and Commercial Matters. The thesis purpose is definition of ADR and types of ADR, mediation and its relationship with international law and legislation in the Czech Republic and Spain. The thesis is divided into five basic chapters. The first chapter explains the term ADR and its advantages and disadvantages, its methods, such as mediation, arbitration, early neutral evaluation, conciliation, minitrial, expert determination and ombudsman. The thesis also explains some hybrid methods of ADR, such as med-arb and arb-med. The second chapter is devoted to the mediation. Alternative dispute resolution in medical malpractice in south Africa

Magister Legum - LLM / South Africa has seen a spike in medical malpractice litigation, including the number and size of claims instituted against healthcare practitioners. This has led to a backlog in medical malpractice court cases throughout South Africa and a strain on both the public and private healthcare sectors, affecting an already burdened healthcare system. The surge in medical malpractice litigation is not a new phenomenon in developed countries. Most have curbed this through alternative dispute resolution (ADR). This has been facilitated by effectively introducing efficient legal frameworks that promote ADR. Unfortunately, this is not the case in a developing country such as South Africa. To date, much research and literature has attributed blame for the large-scale increase in medical malpractice litigation to legal practitioners. This has been aided by comments made by the former Minister of Health, Dr Aaron Motsoaledi (Dr Motsoaledi). In as much as this may be the common perception, there appears, to the contrary, to be systematic problems in the South African healthcare system. The legal profession is only a minor contributing factor to the increase in medical malpractice litigation. The strained financial resources and shortage of healthcare staff in public hospitals contributes to the increased risk of medical malpractice cases. Furthermore, when considering the South African legal system, contingency fee arrangements have, in certain circumstances, increased vexatious litigation and, as such, it is on this basis that medical malpractice litigation has been on the increase in South African courts. This study seeks to analyse the current state of the South African healthcare system, and in light of the increasing number of medical practice claims and litigation, propose ADR mechanisms that offer efficient, cost effective, and expeditious channels to resolving these issues and to ensure that parties recognise the full benefits of ADR. This study proposes legal reform in medical malpractice litigation in South Africa. This thesis compares the experiences, legislative and policy frameworks in Australia and the United States of America (USA), in order to learn lessons that could assist South Africa in framing legislation and best practices for ADR. It contends that, in order to effectively develop and implement ADR to address medical malpractice litigation, it requires the involvement of the government, legislature, judiciary, legal profession and the public. It has identified court- iv annexed mediation as the appropriate ADR mechanism in addressing medical malpractice litigation.

This thesis discusses the alternative dispute resolution methods in trade relations. The main objective of this thesis is to describe and analyze ADR as a group of methods used to resolute disputes with focus on two main methods - mediation and arbitration. My objective is to describe the main principles of ADR, to compare their main advantages and disadvantages and to analyse the process of resoluting disputes by these methods. Another objective is to evaluate and analyze the development of ADR in the Czech Republic, their legal regulation and its current status. A short part of the thesis concerns about regulation of mediation in the EU and the analysis of implementation of the European Parliament and Council Directive 2008/52/EC dated May 21, 2008 to national legislation. Thesis is divided into five separate chapters. The first, introductory chapter only briefly discusses about dispute and conflict and ways they can be solved. The second chapter already characterizes ADR as a group methods of dispute resolution, its main principles, advantages and disadvantages and finally briefly describes some of the ADR. The third and fourth chapter focuses on the mediation, its principles, advantages, disadvantages, the mediation process and mediator. It monitors the development of mediation in the Czech republic and the current situation in the legal regulation of mediation in the country. The last chapter deals with arbitration. It describes its basic principles, advantages and disadvantages again. The conclusion discusses the czech Arbitration law and the forthcoming amendment.

EUROPEAN TRENDS IN JUDICIAL MEDIATION AND THEIR USE IN THE CZECH REPUBLIC Abstract This dissertation deals with the phenomenon of judicial mediation. In the first part, it defines the term of mediation as such and determines its essential and additional elements. Further, the text looks into the wide spectrum of cases in which this method of alternative dispute resolution can be applied. The author specifically points out that limiting its use to family matters is rather inappropriate. The following section systematically identifies the individual types, forms and methods of mediation so that each mediation can be customized for the respective case. Finally, the first part ends with a reflection on the current issues connected to criticism of mediation. These are the enforcement of international mediated settlement agreements, the potential conflict with access to justice and the binding nature as well as enforceability of mediation clauses including their stipulation in general terms and conditions. The second part is an analysis of the use of judicial mediation in selected European countries - Italy, Germany, the Netherlands, Poland, Slovenia and Spain.
