Aquesta tesi doctoral té per objectiu analitzar els procediments jurídics utilitzats per les Nacions Unides i els seus Estats membres per a reformar o modificar la Carta de les Nacions Unides amb l'objectiu de contribuir a que l'Organització sigui més eficient i eficaç.
Iniciem l'estudi pels orígens i característiques de les Organitzacions Internacionals en general i de les Nacions Unides en particular, del seu tractat constitutiu, així com dels diferents intents per reformar la Carta. Seguidament, analitzem les modificacions institucionals que han tingut lloc en els principals òrgans de les Nacions Unides i les modificacions materials que han afectat al principal propòsit de l'Organització: el manteniment de la pau i seguretat internacionals i mostrem exemples fefaents de disposicions de la Carta que s'han modificat a través d'una pràctica constant i uniforme, amb la finalitat d'aportar a l'Organització els mecanismes necessaris per complir amb els seus objectius i propòsits perseguits. / This doctoral thesis has as an objective to analyze the legal procedures used by the United Nations and its member states to reform or modify the United Nations chart with the purpose of contributing to the fact that the UN be more efficient and effective.
We began the study by the origin and characteristics of the international organizations in general and the UN in particular, its constitutive treaty, as in the different attempts to reform the Chart.
We analyze the modifications that have taken place in the main bodies of the United Nations and the material modifications that have affected the principal purpose of the organization: peace keeping and international security and we show irrefutable examples of the rulings of the chart that have been modified through a constant and even practice, with the objective of providing the organization with the necessary mechanisms to accomplish the desired purposes.
