Zvláštní případy hoření osob / Special case of burning people

In the Czech Republic, as well as in other countries, there are cases of fires reported, where the thermal destruction of the body of the victim is not a result of thermal effects of a fire of the surrounding space. These fires are typical for the affected area that is limited to the body and the immediate surroundings only. Frequently the bodies show extensive and complete thermal destruction of tissues to high levels of carbonization. Human tissue combustion appears in foreign sources, especially popular science, described with the term "Spontaneous Human Combustion". In the Czech Republic the translation equivalent is "samovolné vzplanutí osob". The motivation for the choice of the topic "Special Cases of Human Combustion" was the lack of adequate fire origin investigation methodology to be used by the members of the Fire and Rescue Service of CR. The other reason for the choice of the topic was the misleading information published in popular science sources and alternative information sources. The first step of the research was the literature research of the available professional texts and specific fire reports. Based on information gathered was designed scope and conditions of a research experiment conducted on samples of the same type of animal tissue, which corresponds to the human tissue. For the samples the tissue of a domestic pig was used and the samples were prepared to contain uniform percentages of muscle, fat and bone, including skin. The experiment was carried out in an accredited laboratory owned by the company PAVÚS, a.s. - fire testing laboratory #1026 in Veselí nad Lužnicí. With each sample the influence of different flammable substances on the level of subsequent damage of the animal tissue was tested. The influence of typical layered clothing, flammable base and cover was evaluated. Different real environment conditions were simulated with each sample. The aim of the thesis was an evaluation of the possibility of a start and the process of combustion of animal tissue. It was confirmed that the combustion of animal tissue, including bone tissue, is possible in a regular fire. The flammable materials in the form of clothing and the presence and the characteristics of a flammable base are crucial for the start and process of the combustion. The experiment revealed the possibility of further independent combustion of the tissue when supplied with a certain amount of initial energy by burning of the surrounding materials. The combustion of animal tissue characterically takes predominantly the form of smouldering lasting several hours, where the maximal measured temperature of the surface of the sample was 644,50 oC. The experiment further revealed the temperatures of the human tissue combustion not to be high enough to cause an ignition of flammable materials within defined distance. The results of the thesis can be used to define the basic guidelines for the members of Fire and Rescue Service of CR and the criminal justice, who can provide support with investigation of the causes of these types of fires of persons.

This diploma thesis is focused on design of methodology for detecting and analyzing pedestrian trajectories, moving in a predefined area, which is recorded by surveillance cameras. Design approach is mainly based on optical flow algorithms. The designed methodology was implemented into a complex software by using framework .NET. The developed application is able to display elementary time-space characteristics using a various tools, which provide sophisticated view on the detected pedestrian trajectories in a predefined area. The designed methodology was verified by performing two complex various tests.

Criminal liability of legal persons Abstract The author of the thesis deals with the issue of criminal liability of legal persons, from the position of her advocate. The purpose of the study is to stress the need to introduce this institute into the legal systems of democratic states, but at the same time to deal with the problems brought by its Czech substantive law. In the first part of the thesis the author discusses the legal aspect of criminal liability of legal persons, summarizes opinions for and against the introduction of criminal liability of legal persons, and examines the criminological aspects of corporate crime. The second part of the thesis focuses on the differences, advantages and disadvantages of three basic models of criminal liability of legal persons - true, false and administrative. The author commends that the Czech Republic has proceeded to introduce true criminal liability of legal persons. The third part explains the term legal person itself. In the pivotal fourth part of the thesis, the author deals critically with the individual substantive provisions of the Czech law implementing the criminal liability of legal persons and proposes a solution de lege ferenda. The aim of this thesis is to describe and evaluate the legal system of the public transport of passengers on railways in legal systems of the Czech Republic and Germany, including the influence of European and international law. A comparison of the both of the legislations will be made, alternatively some of de lege ferenda proposals for the Czech legislator will be draft. This thesis deals with the both of domestic and international transport. The thesis is divided into six chapters including the introduction as a chapter one and conclusion as a chapter six. This thesis discusses cognitive processes theories with special emphasis on those affecting recognition and identification of human faces, introduces the issue of eyewitness testimony and the issue of methods and techniques of criminal identification proven in forensic science and actually in use in police work. The literature and previous empirical studies dealing with the issue of line-up and show-up reliability and accuracy are reviewed afterwards. The effect of selected variables, i.e. retention interval and similarity of suspect clothing, within the show-up and line-up procedures is well mentioned. Experiments in this thesis examine these interrelated goals: determining the effect of two variables on show up accuracy as well as the suggestivity of show up method and exploring carryover effect from show up to line up identification procedure. Carpooling in the light of private and public law Abstract The thesis deals with legal aspects of carpooling across the spectrum of the law of the Czech Republic. Due to carpooling not being a legal term, the thesis itself defines it as a phenomenon when multiple people are traveling simultaneously by one road transport vehicle, under the assumption that the transport is not being provided on a commercial basis. The thesis also describes the differences between carpooling and commercial transport of persons. As far as public law is concerned, the thesis discovers which areas of administrative law apply to carpooling and what consequences arise for the subjects concerned. This involves the regulation of road transport and road traffic in particular. The description of tax implications is also included. Furthermore, the thesis deals with criminal and administrative liability. The focus, however, is on private law. After an exploration of the legal history of transport of persons, the thesis answers the question whether or not contractual obligations arise from carpooling and inspects the elements of the contract along with the rights and duties of the parties.
