Suverenita parlamentu : podstata, vývoj a důsledky pro soudní přezkum normotvorby / The sovereignty of Parliament: its substance, development and consequences for the judicial review of rule-making

My thesis deals with the legal concept of sovereign Parliament, the very keystone of British constitution according to A. V. Dicey. This model has been challenged both normatively and descriptively. Concerning the normative point of view, concept of unlimited sovereignty is incoherent. Descriptively, courts don't simply take the parliamentary supremacy for granted, even if they say so. Relationship between the Parliament and courts is certainly more complex than Dicey suggested. Goals of this thesis are rather tentative. Since the popularity of this topic among British constitutional lawyers, comprehensive analysis is implausible due to the limited space. This paper aims to gather fundamental theories and disputes regarding the parliamentary sovereignty and its relationship with courts. In other words, it explores connection between the Parliament and courts in contemporary British constitution. First chapter analyses the constitutional conventions, which forms the basics of several other fundamental concepts in UK constitution. It suggests that there are no clear boundaries between law and conventions. Second chapter focuses on the general concept of sovereignty and Diceyan classic theory of Parliamentary sovereignty. The study aims to analyze the reliance in different EU institutions - the Parliament and the Commission - of 25 member countries citizens. The reliance in institutions can be defined as a belief found in society, that institution answers citizens’ expectations. The reliance in the Community and policy it implements differs from the desirable. Citizens expect active, public, transparent Community, in which could be felt tangible results of policy, based on cooperation, compromises and taking into account all interests. In recent years, the reliance in the EU is 48 %, meanwhile 52 % of member countries citizens expressed their reliance in the European Parliament, 47 % - in the European Commission. From the survey a conclusion can be drawn, that younger, better educated, subjectively well ranking their knowledge about the Community respondents, rely more in the EU. The European Parliament is the institution that gains the biggest reliance, because it is the best known. The presumption can be done, that citizens tend to rely in the Parliament, because it is the only elective institution in the EU or because of its power to control direct and indirect work of the European Council, the Commission and other institutions of the EU. The European Commission gains its trust, because it has more and various powers in comparison with other EU institutions. Vliv politického cyklu na deficity státního rozpočtu

This diploma thesis is focused on issues with political cycles which are in close relation to a short-term fiscal imbalance. The political cycle is defined as inten-tional abuse of fiscal policy by a government with intention of reelection. Its effect can be seen in a pre-election period as a decrease of tax income and a growth of government spending. The framework of empirical analysis is a peri-od of 1993-2013 where occurrence of political-budget cycle in the Czech Repub-lic is researched. Another goal of the thesis is to identify which government actions are used by politicians to influence the electorate in their choice of poli-tical party for the Chamber of Deputies of the Parliament of the Czech Republic.

Media as a Factor of Electoral Apathy in the Czech Republic

The purpose of this thesis is to explore whether the drop in voter turnout between the 2009 and 2014 European Parliament elections, as well as the general apathy toward the politics of the European Union, in the Czech Republic was contributed to by the mass media. Specifically, this thesis will examine the two most read daily newspapers of both 2009 and 2014, Blesk and Mladá Fronta Dnes, and analyze its articles with the use of search words in order to assess whether any change occurred in the way the European Union, its policies and institutions, were presented immediately prior to the 2009 and 2014 European Parliament elections. This will be achieved through the use of content analysis, both quantitative and qualitative, while evaluating the articles in comparative fashion. The thesis will argue that, given the essential role of the media as intermediary between the world of politics and the electorate, the portrayal, or lack thereof, of the European Union is a factor in explaining the electoral dynamics of the country. Temporary agency work - it's legislation as well as its practise is the main topic of this thesis. It aims not only legal, but also economical and some other aspects. The issue is becoming more and more important in relation with unexpected changes at employment market. Number of temporary agency workers is expected to rise in near future. This is resulting from expectations for high-standard legislation providing efficient protection especially for temporary agency workers. The first aim is to summarize contemporary legislation in the Czech Republic, European Union and International Labour Organization. Next purpose is to point out its main problems and interpretation difficulties. Selected chapters illustrate the approach of temporary work agencies to some disputable provisions of a statute. The thesis is composed of fourteen chapters, each of them dealing with different aspects of temporary agency work. Chapter One is introductory and defines concept of temporary agency work, focuses on situation on employment market and describes the development of legislation. This PhD. thesis is dedicated to the legal regulation of instruments presenting guarantees of the independence of the member of parliament during the performance of his/her functions. The aim of this thesis is in particular to present a comprehensive picture of the topic concerning protection of independent performance of the parliamentary mandate, evaluate the Czech legal regulation in force and, last but not the least, to find an answer to the question to what extent is the Czech legal regulation in force complete and effective as well as present possible alternatives de lege ferenda. Member of parliament must be independent with regard to all aspects of the exercise of his/her mandate. Independency of the member of parliament is necessary precondition for his/her ability to exercise the mandate in such a way, which will enable him/her to face external pressures, not only from the state bodies, but also from other subjects or phenomenons. This diploma thesis characterizes a specified field of the civil law that deals with the judicial proceedings of inheritance through the analysis of professional literature and relevant case law. The attention is especially devoted to development of the legislation, the proceedings in the beginning of this judicial proceedings and its parties, the minor included, possible discretions of the decedent with his belongings, the conflicts appeared in this judicial proceedings, the settlement of the estate in entirety, the question of the overextended asset and the selected issues of judicial proceedings of inheritance with the international aspect (Regulation (EU) No 650/2012 of the European Parliament and of the Council).The thesis points out the main amendments which have been brought to the judicial proceedings of inheritance by the recodification of the private law that has been in effect in Czech Republic since 01. 01. 2014. The thesis was composed by the method of description with elements of analysis and synthesis. The individual legal institutes are described, analytically examined and evaluated. There are presented their mutual connections and the view of the problematic as a whole. The comparative method was used as well by evaluating the present legislation with the former one that was in effect in the Czech Republic until 31. 12. 2013.

Passengers claims in air transport under the Regulation (EC) of the European Parliament and of the Council No. 261/2004 Abstract The subject of this diploma thesis is the claims of air passengers, especially those arising from Regulation (EC) 261/2004 of the European Parliament and of the Council, but also according to other regulations of private international law. The thesis is divided into four parts, which, with regard to the nature of the topic, combine both theoretical and practical aspects. The first part provides an introduction to the issue by setting it in the historical context of civil aviation regulations and then discusses important documents in the field of air passenger rights. The diploma thesis focuses on the examination of political elites with the field of focus being the members of the government of the Czech Republic, the leadership of the Chamber of Deputies of the Parliament of the Czech Republic. And selected political groups with selected members. The people in question are the chairman of the political groups. The oldest and youngest men and the oldest and youngest women. This is applied to three selected periods, which are being the years of 1995, 2005 and 2015. First of all, every period will be examined separately, then the periods will be compared. The comparisons will be as follows: 1995-2005, 2005-2015 and 1995-2015. The diploma thesis is divided into five chapters. The first chapter focuses on the theory of elites, where are described chosen theories. Thesis title: Contemporary populism in Europe This thesis maps the development of populism across Europe and investigates its manifestations and core elements in its complexity, which is the groundwork for analysis of populist party, movement or individual. Populism is not considered solely as the relieving strategy meant to maximize the voter's votes by comprehensible, straightforward and hardly feasible promises. Without this attitude in mind, we would hardly be able to put some reason behind the populist boom, which we had chance to witness during the last decade. Therefore this thesis considers populism as the ideological construct, the way politicians present themselves, the rhetorics, the mastered political style or the structure, which provides the foundations of programme documents of political movements and parties. It would be a mistake to a priori consider it as some kind of purely negative phenomenon, but more of as the reflection of various and continuously changing demands of European electorates.
