The Phenomenon of Presidential Elections. The development of the elections of Czechslovak and Czech presidents 1918-2008. The topic of this thesis is an analysis of the development of the elections of the president of Czechoslovakia and later the Czech Republic from 1918 to 2008 in the context of a distinctive understanding of the role of the president in the collective memory of the Czech nation. The reason for the connection the analysis of presidential elections in the specified time period with the Czech experience of the perception of the president's role in the political system of the Czech Republic is the inseparable close link between the two topics within which the specific perception of a president in the eyes of Czech public influences the development of the institute of presidential elections and has the potential to successfully interpret it. - anglický jazyk In my thesis I deal with presidential decrees in constitutional and international context. It consists of 5 parts. There are preconditions for the emergence of decrees in the first part. This international-legal recognition of the Czechoslovak government in exile, the theory of legal and political continuity of Czechoslovakia, uninterrupted presidency of dr.Beneš and the withdrawal of the Munich Agreement. The second part talks about the concept of issuing decrees. In the third part is the most important content of constitutional decrees. The fourth section deals specifically about formal-legal, material-legal and political continuity. In the last part I deal with today's issue of the validity of the decrees and decrees of the Czech Republic by accession to the European Union. Zusammenfassung Die Diplomarbeit beschäftigt sich mit der Problematik der Nomination und Registration der Kandidaten für die tschechische Präsidentenwahl. Im Jahre 2012 genehmigte das Parlament eine Änderung der Verfassung, die die Wahl des tschechischen Präsidenten auf die direkte Wahl änderte. Im Zusammenhang damit kamen viele Fragen über die Nomination und Registration der Kandidaten für die Funktion des Präsidenten. Diese Fragen musste man nicht lösen, weil das Recht auf die Nomination des Kandidaten neu die Bürger bekamen, die eine Petition mit den Unterschriften mindestens 50.000 Bürger mit dem Wahlrecht vorlegen. Die Diplomarbeit bemüht sich diese Probleme zu analysieren und ihre Lösung vorzuschlagen. Nach dem Einführungsteil über die Geschichte der Anträge auf die direkte Wahl im tschechischen Verfassungssystem und nach der Rekapitulation der anderen Rechtsvorschriften, laut den man in einigen Fällen (Kandidatur der unabhängigen Kandidaten in den Komunal- oder Senatwahlen, bzw. The dissertation investigates a constitutional amendment to the 2012 legislation of the presidential election. The amendment introduced an election of the president through a popular vote, which was a historical milestone for the Czech legal system. However, the new adjustment was adopted in haste and evinces many deficiencies; that was proven in the 2013 presidential election. Therefore, the aim of the dissertation is to describe problematical parts of the new legal adjustment and find some possible solutions. The main topics are as follows: 1) modification of the basic concepts of the election system, 2) candidate nomination process, 3) election campaign funding and 4) ethical aspects of the election campaign. A comparison of legal adjustments of 14 EU countries with the direct presidential election (the Czech Republic, Bulgaria, Finland, France, Croatia, Ireland, Cyprus, Lithuania, Poland, Portugal, Austria, Romania, Slovakia and Slovenia) was done, in order to find appropriate solutions. Apart from the results of comparison, the dissertation is based on reports by GRECO, OSCE and the corresponding Czech judicature. Theme of directly elected President was present on Czechoslovak and Czech political field regularly since 1989. Different proposals rose discussion in media and between the specialists from Political science. Diploma thesis captures the changes of specialized, political and media discussion during the years. The opinion of the Public is present in Public opinion polls. Diploma thesis also describes the circumstances of adoption of the Amendment to the Constitution and of the Implementing Law. Part of the Diploma thesis is also theoretical introduction concerning the regimes from the point of view of their polity and also a chapter about the institution of the president concerning his constitutional formal and informal powers since 1918 till these days.

Přestože patří Francie mezi země s vysokou mírou politické stability, je členem nejdůležitějších mezinárodních organizací, ve kterých mnohdy zaujímá klíčové postavení (OSN, EU), její politický vývoj byl vždy pestrý a v mnoha ohledech i dynamický. Tato komplexnost francouzského politického systému vedla autora k vymezení podtématu, s jehož pomocí se tento systém pokusil rozebrat. Cílem práce je charakterizovat a na konkrétních příkladech ilustrovat, jakou roli mělo zavedení přímé volby prezidenta republiky v roce 1962 na politický systém V. republiky v teoretických i praktických rysech. V závěru práce autor hodnotí minulé prezidentské volby a pokouší se nastínit možnou budoucí orientaci francouzského politického systému.

The direct election of the president is political, politological and also constitutional-legal topic which has already accompanied for many years. It appears always in connection with the presidential elections, but also as a part of the parliamentary election campaign. February 2012 interrupted the regularity and direct presidential election was approved. The first direct presidential election was held in January 2013. This term preceded by a long election campaign of candidates, persuading voters and several lawsuits. The first direct presidential election won one of the most probable winners - Miloš Zeman.

The subject of this thesis is the presidential system as one of the distinguished alternatives of existing political systems in the present democratic society. This thesis is divided into three parts. The primary aim of the first part is to produce a brief overview of individual political systems and to outline their mutual differences through the description of their characteristics. The second part describes a specific political system in this world - namely the United States of America which became the source of inspiration for all subsequently established systems of this type. This part focusing on the United States is then divided into three separate chapters where each of them provides a view of particular branches of the government which form a constitutional system of the state together. These chapters offer not only the characteristics of these particular government branches and their central government bodies, but they also explain their mutual relationship and the control mechanism and particularly their relation to the President who is the key character of the entire presidential system, also his office and his powers. Diploma thesis seeks to analyze the introduction of the direct election of the President of the Czech Republic as a potential impulse towards semipresidentialism. For this purpose, the work defined theoretical concepts parliamentary, presidential and semi-presidential forms of government. In addition to the anticipated research direct election, as an factor of strengthening the president's legitimacy among others, the work will include analysis of the effects of Miloš Zeman first year in office and its relation to other constitutional institutions.
