Toward a new wills variation act

Most common law and civil law jurisdictions have laws in place to provide a safety net so that those who are unfairly disinherited will be able to claim a share in a deceased's estate. Since 1920, British Columbia has been one of those jurisdictions in which a testator's distribution scheme may be varied at the discretion of the Court. However, the absence of a stated purpose of the legislation, a broad judicial discretion to determine what is adequate provision for a spouse and children and the failure of the Supreme Court of Canada in Tataryn v. Tataryn to bring certainty and predictability to the law point to a need for reform. The goal of this thesis is to complete the sentence "the purpose of legislation restricting testamentary freedom is . . . . " and to make recommendations for legislative change to accomplish this purpose. An overview of the law in British Columbia today and the arguments for reform will be outlined in chapters 1, 2 and 3. Chapters 4 through 8 will examine a number of topics to extract policies which might assist in the formulation of a dependant's relief statute's purpose. Historical concepts, family, intestacy and wrongful death legislation as expressions of values will be reviewed. From the doctrine of unjust enrichment, a cause of action independent of a statute, a contract or a tort, but now widely used in claims between family members, will be extracted principles which recognize compensation for the contribution of services and money between family members. Empirical studies about testators' intentions, family and other private relations will be noted in chapter 9. Lastly, chapter 10 will make a number of recommendations for reform. These include: (a) A statement of the statute's purpose. Persons who have lived together in a relationship of some permanence with financial and emotional interdependence should share equally the assets acquired during their time together and the survivor's need for support should be recognized. Children's support needs should also be met but the testamentary autonomy of persons should be subject only to these two objectives. (b) The broadening of categories of claimants to include cohabitants and stepchildren with the introduction of age and dependency criteria for the latter. (c) Criteria to be used in making reasonable financial provision for spouses and children. (d) A priorities scheme. (e) The right to waive the statutory rights by agreement. The probate inventories were used as the main sources. The author focused on the objects which were linked to sleeping - sleeping rooms, beds and bedding. Then the probate inventories were divided by social, professional and gender stratification. This diploma thesis could be the first step of the systematic study of the sleeping culture in the burgesses environmental.

Práce se zabývá městem Soběslav, které patřilo pánům z Rožmberka a dochoval se v něm soubor testamentů z let 1455-1550. Soubor se skládá celkem z 83 listinných testamentů. Práce nejprve popisuje testamentární praxi (proces vzniku testamentu) a soubor soběslavských testamentů. Samotný výzkum se zabývá nejprve testátory, kteří byli spřízněni nějakým druhem rodinné vazby. Podrobněji se práce zabývá jednou z těchto rodin, rodinou Račmanů. Druhá část výzkumu se věnuje dluhům a pohledávkám uvedených v testamentech. Tato část se zabývá lokalitami, se kterými vedli testátoři své obchody. Klíčová slova: Soběslav, testamenty, rodinné vztahy, dluhy, pohledávky Annotation Object my diploma's work is Soběslav town, which it belonged to lord of Rozumberk. There was still in existence collection of testaments from years 1455-1550. Collection is comprised of 83 testaments. The work discribes proces sof genesis testaments and collection Soběslav's testaments. First part of study pursue testátore, which they were akin to families. The work detailed discribes of family Račman. Second part of study disciribes by analysis debts and outstandings debt in testaments. Cultural Materiality : The correlation between material and cultural capital in the late eighteenth century Stockholm elite burgher home

The eighteenth century saw the slow but steady rise of the middling classes to their nineteenth century social and cultural prominence, reinforced by a changing political landscape and the steadily increasing importance of the market. As the social and cultural power of the city burghers making up the majority of the middling classes grew, so did they start to consume in a manner to reflect to their new status in society. The question that arises then is more exactly how this group consumed, what types of objects that became important and what type of status that became the most paramount. Since status and social groups can differ greatly between both times and places, focus of this investigation is the burgher elite of Stockholm, the social, economical, and cultural centre of Sweden during the whole of the early modern era. By using a combination of Bourdieu's capital theories and Erving Goffman's theories on the presentation of self the inventories of fourteen elite burgher households has been analysed in order to investigate how these individuals constructed their home to present their own perceived social and cultural status. Through a thorough and theoretical investigation of these early modern front regions it can be revealed that the traditional representations of cultural capital, the main form of symbolic status capital, such as paintings and books, albeit important, constituted but a minor part of the capital presentation in the home. Instead it appears as if the most important status capital is presented through sociability, the ability to host social events or, if that option is unavailable, attend social events. Objects with the express function of sociability, such as tea- and dinner-ware, together with chairs, tables, and fashionable interior decoration suggests that sociability indeed stood at the forefront for the presentation of status for the late eighteenth century Stockholm burgher. At the same time, fashionability appears to have been extremely important, with almost all of the investigated households going to great lengths to stay up to date with the most recent trends in both furniture, colours, literature, and china. Much more research is however needed in order to really understand the structures of status and how it was expressed during the early modern times, and especially comparative studies between estate borders is needed in order to understand the status relations between social groups and how this affected status presentations.

The subject of this diploma thesis is inheritance, inheritance procedure and probate proceedings. It reflects the current (new) legal regulations founded by the Law No. 89/2012 Coll., Civil Code, as amended. The aim of the thesis is to analyse and evaluate the current legal regulations of inheritance in such a manner to provide sufficient amount of information about the basic terminology in this area of the law even to a layman. This applies to both substantive and procedural law. The thesis comprises of three parts. The first part focuses on the history of inheritance procedure with special emphasis in institutions introduced into current legal regulations. The second part contains an analysis of substantive law regulations of inheritance procedure. Several controversial points put to practice by the new regulations can also be found there. The third and last part deals with the procedural regulations and the probate proceedings.

Then I discuss the implementation of section 2(3) which empowers the court to legalise a document which does not comply with the formal requirements of a will. The specific problem areas with regard to the interpretation of section 2(3) are highlighted and discussed in detail. Thereafter a recommendation is made that a signature or a mark on a testamentary writing must be a prerequisite before a court can consider condoning it.
