The aim of this thesis is to provide a comprehensive analysis of the issue of the concluding of public procurement contracts. The thesis provides both an analysis on the conclusion of public procurement contract by itself, so the comprehensive overview and analysis of the acts required to the conclusion of public procurement contract. The thesis is divided into chapters. The first chapter provides the general definition of the public contracts. Next chapters chronologically describe the different phases of procurement procedure as follows: the phase before start of procurement procedure, the phase of procurement procedure, the phase of conclusion of public contract in the strict sense and the phase after the conclusion of contract. Separate chapter concerns the means of defense against the conclusion of public contract in breach of the applicable law.

The aim of this Master's thesis is to define the particular modes of public tenders in the Czech republic. The awarding of the public tenders represents special mean of concluding the public contracts governed by the Act N. 137/2006 Coll. This thesis concentrates mainly on the description of the particular methods of awarding the public tenders, the conditions required for their use as well as on the procurement procedure itself. The awarding procedure is characterized in accordance with the European judicial decisions, Czech case law and also the decisions of the Office for Protection of Competition. In relation to the newly adopted European directives the thesis analyses also the changes that are brought by these directives to the subject matter.

The status of persons placing public contracts in specific sectors Abstract The topic of the thesis is the position of the utilities contracting authority. Although the new regulation, ie Act No. 134/2016 Coll., On Public Procurement, as amended (the "Act") does not explicitly include the term "utilities contracting authority", the concept of public procurement regarding utilities has remained de facto preserved. To emphasize not only this but also some other vital facts, the thesis compares the contemporary legislation with the previous legal regulation of the matter. At the same time, the thesis attempts to take a comprehensive approach to the area of public sector (utilities) procurement and its specifics, in particular through comparisons of legislation affecting the award of utilities public procurement and oteher public procurement in general. In the first part of the thesis I define concepts that are fundamental to the subject of this thesis, ie terms such as "contracting authority", "public contract", "dominant influence", "special or exclusive rights"or "relevant activity. Possible remedies for incorrect procedure used by contracting authority in public procurement Abstract The aim of the diploma thesis is to provide analysis of incorrect procedures of contracting authority in public procurement and possible remedies. Particularly from the position of the contracting authority itself and partially from the position of the economic operator, who is able to initiate corrective measures through the institutes of protection against irregular practices of contracting authority. The submitted thesis also deals with certain interpretative problems of the contemporary legislation of public procurement, which may be directly related to the mistakes of the contracting authorities. The first chapter discusses basic concepts of public procurement law and delineates exemplary conduct of one of the typical types of procurement procedure, namely open procedure. The second chapter deals with frequent mistakes and possible remedies of those mistakes by the contracting authority within the time limit for the submission of tenders. The focus of this chapter is on the procurement documents, its explanation and alteration or supplementation. The construction industry is a complex sector that places high demands on project management, planning, and implementation. Significant progress has been made in recent decades regarding the delivery of extensive construction projects, including the adoption of new building techniques, improved risk management systems, and enhanced safety measures. However, a lack of efficiency persists in the construction industry in many countries. This is due to issues within projects, such as time and cost overruns, conflicts among stakeholders, limitations in productivity improvement, quality development, and inadequate customer satisfaction. Following this, many researchers and society at large have called for a change in attitudes, behavior, and practices to increase the chances of successful construction projects to improve the result of the final products. With increased complexity, uncertainty, and time constraints in construction projects, there has been a growing need for collaboration among various project stakeholders. The purpose of this study is to describe and explain the choices made by clients in the procurement process and what contractors prefer. Based on other studies finding that collaborative procurement procedures enhance project performance, this thesis wants to analyze clients’ and contractors’ views regarding collaborative procurement procedures. Additionally, moral-hazard is a component of procurement strategies and contracts, particularly in more complex transactions that involve interaction, which significantly affects the construction industry. Therefore, it is an important aspect to look at how the construction industry works to prevent the emergence of moral-hazard. Based on semi-structured interviews conducted with nine respondents, comprising of five respondents from the contractor side, three from the client side, and one consultant. It has provided insight into how collaboration and moral hazard are perceived. We can conclude that the client's choice of procedure in the procurement process is often closely linked to the selected form of contract. When clients select a form of contract or when contractors submit bids, it appears to be based on the company's expertise, tradition, or what best suits the project. Those who feel skilled or comfortable with partnering tend to choose partnering more frequently. The strategic choices are also shaped by a systematic and thoughtful decision-making process, consciously or unconsciously, to reduce the risk of opportunistic behavior that may occur.

The diploma thesis deals with issues related to the award of public contracts in the field of architecture and design. Due to the scope of the topic, the view is focused on the analysis of public procurement in the field. The diploma thesis describes the types of public contracts and tenders, applicable legislation, control authority in the Czech Republic and design and architectural work.

The author analyses the existing legislation regarding crime related to public procurement, focusing on those that directly relate to public procurement. The primary objective of this thesis is a thorough analysis of sections 248 paragraph 2 alinea 2, section 256 and section 257 of the Czech criminal code. Following a brief historical introduction this thesis describes some of the important legal instruments present in the new law regulating public procurement, emphasising the new ones that may have a strong impact on criminal liability. The main part of the thesis then analyses the three aforementioned crimes, putting emphasis on the recent decisions of the Czech courts in this matter. The author also provides practical examples of criminal conduct related to public procurement. The author also focuses on some other crimes that may not be directly related to public procurement, but are in practice more or less often committed in relation to public procurement or together with the three aforementioned crimes. The author has also carried out a detailed analysis of the available case-law related to the crimes described in sections 248 paragraph 2 alinea 2 and 257 of the Czech criminal code in a time period between its entry into force up to the date of submitting this thesis. The thesis addresses the process of assigning construction contracts and its acquisition from the perspective of the construction company. The task is focused on creating public tender`s price propositions by the contender. These findings are from my own personal experience as I was involved in the creation of this particular price proposition. At the time of publication of this tender I worked in a construction company INSKY spol. s r.o. which is mentioned in this thesis. I described the terms which you may encounter during assignment, the progress and the finalization of the contract of the public tender.

The diploma thesis describes a process of public tender for building contracts from a construction company’s perspective. The theoretical part introduces the basic concepts and procedures encountered during issuance, awarding and completion of public tenders. The necessary procurement rules and guidelines are also included. The practical part defines an actual tender offer from a particular contractor. The tender in question is a construction of leisure centre in Ratiskovice.

The aim of the thesis is the approximation progress public commercial competition in the construction contract for the perspective of the construction undertaking. The theoretical part of the work deals with the concepts and facts of this issue. This section describes, in particular, the legal obligations of the parties involved, and the elements without which you cannot contest.
