Způsoby ochrany vlastnického práva v platném právním řádu / Ways of protection of property right in valid rule of law

This diploma thesis deals with problems of the property right and its protection. The protection of property is a law of eminent importance, enjoying considerable public interest, particularly because it is one of the major factors determining the level of individual´s freedom. Legal consciousness among people from general public in the area of the property right was greatly increased after the year 1989. This is demonstrated by the low number of currently solved offences in the administrative procedure. In the civil section of the justice most cases can be traced back to the period of socialism. It is very important to constantly lead an informative and preventive campaign, because for a large number of people the concepts of property rights and its protection pose still a big unknown. In the recent time, bills of new civil and criminal code are being prepared. These standards will have a profound influence on the definite interpretation of property right and reinforcement of its protection. With regard to protection of the property in Austria and Germany, we can say that the level of protection of the property in these countries is comparable to the one in Czech Republic.

Financial Development, Institutions and Economic Growth : An Empirical Evidence

What is the impact of financial development on economic growth and how institutional quality affects the role of financial development on economic growth? This thesis attempts to answer to these questions using a fixed effects estimation and two-step GMM estimator on a panel dataset of 93 countries from 2000-2007. The preposition is that financial sector development increases the availability of extra finance thereby increasing firms investment, which is essential for economic growth. The findings suggest that bank credit has anegative impact on economic growth. However when interacted with protection of property rights, bank credit has a positive impact economic growth. Additionally results further indicate that stock market capitalization is important for economic growth. For Countries that exhibit low levels of protection of property rights, stock market capitalization has a negative impact but countries that exhibit high protection of property rights the impact of stock market capitalization on growth is positive.

The diploma thesis concentrates on legal protection of indigenous peoples in Australia. The topic itself is too wide, therefore it was shortened to predominantly concentrate on analysis of two up-to-date topics. These were, firstly, legal protection of indigenous peoples in relation to media and then, secondly, legal protection of indigenous peoples in relation to intellectual property rights. The paper is divided into three main chapters. The first chapter's goal is to introduce some parts of Australian history that are connected with Aboriginals to Czech readers. The topics discussed are, for example, colonization of Australia, genocide as perceived by international community, policy of assimilation, era of Stolen Generations etc. This chapter highlights a necessity of always dealing with current issues in proper historical context and, as it is found in the second chapter, also with deeper understanding of differences of indigenous culture. The second chapter is an outcome of the author's study stay at University of Queensland where she conducted a research on two topics connected with legal protection of indigenous peoples that were being currently discussed. The first topic was legal protection of indigenous peoples in relation to media connected with a discussion about The Freedom of Speech Bill 2014....

Data Protection And Intellectual Property In The Eu And Turkey

This research had two main purposes. Firstly it aimed at showing the regulatory framework of both data protection and intellectual property in the European Union and thus making the privacy complications of Digital Rights Managements systems clear in the developed world. This research also aimed at disclosing the complications of employment of DRMs systems in developing countries. To that end Turkey&rsquo / s copyright framework has been reviewed. It was found out that DRMs systems employed in Turkey went beyond the scope of Turkish Copyright Legislation and restricted also legitimate acts which fall within the scope of fair use. DRMs also have hindered development since it restricted availability of educational and cultural works. The review of Turkey&rsquo / s Data Protection regime disclosed that the most important reason behind the non adoption of the draft law was related to the legislators&rsquo / confusion of first pillar and third pillar data protection. It was concluded that Turkey lacked a data protection policy and the lack of such a policy led to the surveillance of the people to such a degree that almost no private space is left for them. The main finding of the research was that Turkey has been one of the best markets for the employment of DRMs with its current copyright regime and lack of data protection rules. The research concluded with proposals of action concerning data protection and DRMs.

The tax might be identifiable with a tax-law relationship or make it subject to such a relationship, i.e. it could be definable as a public obligation of a participant in the legal relationship, or might be able to both approaches. The starting point is the economic definition of taxe and precisely the functional definition used in economic theory and financial science, neatly summarized commonly available knowledge about the principles of tax, operand the analysis of the economic construction of the tax in terms of legal doctrine, by the structural elements of the tax, since the legal definition of tax lies on them. Contrary to what is commonly recognized, tax procedural rules in Czech Republic contain a general legal definition of tax. Refuted can be the view that this definition is merely a legislative abbreviation. After a relatively long exploration of the concept tax, forced by an insufficiency of theoretical knowledge on this subject, tax jurisdiction of the state is examined as the ability to impose taxes and at a same time the general requirement of legality on all levels of exercising that power of every sovereign state.
