Poder judiciário : crise e reforma

O objetivo da pesquisa é a análise da instalada e crescente crise do Poder Judiciário no Brasil e da reforma que pretende solucioná-la. Diante do exame perfunctório se verifica que a crise não é somente operacional, ocasionada pelo desaparelhamento do Judiciário, pelo processo, suas excessivas formalidades e por outros motivos apontados pelo meio jurídico. Embora presentes, a principal causa é de ordem institucional, pois trata do exercício de um dos três Poderes de Estado, que já não se apresenta em sintonia com a teoria clássica da separação dos poderes do século XVIII, em face da nova sociedade e da decorrente alteração dos fins do Estado. O Poder Judiciário vem evoluindo no sentido de administrar a Justiça e prestar a jurisdição de forma substancial, com base na concretização da Constituição, especialmente dos Direitos Fundamentais, o que leva, pelo menos aparentemente, a ditar o Direito e imiscuir-se na atividade política, em contradição à teoria clássica da separação dos poderes. De outro lado, nosso sistema de governo presidencialista, com a hegemonia do Poder Executivo, depõe contra a independência do Judiciário ao centralizar a cooptação dos componentes da mais Alta Corte e ingerir na formação dos Tribunais Superiores. Agora com a adoção do controle externo do Poder Judiciário, aumenta a concentração de poderes no Executivo, fazendo frente à pletora de competência que a Constituição atribuiu ao Poder Judiciário. A conclusão é de que a perda é da sociedade, com a subversão do regime democrático. A história dos países mais desenvolvidos está a indicar o caminho do consenso, como sendo o de um novo agenciamento de poderes, adotando-se o sistema parlamentarista e um Tribunal Constitucional independente. / The objective of the research is the analysis of the installed and crescent crisis of the Judicial Power in Brazil and the reform that intend to solve it. In front of the perfunctory we verify that the crisis is not just operational, caused by the lack of apparatus of the Judicial, by the process, its excessive formalities or other reasons pointed by the judicial environment. Although present, the main cause is from institutional order, because it’s about the prosecution of one of the three Powers of the State, which already is not shown in sintony with the classic theory of the separation of the powers from the XVII century, in regard to the new society and the current alteration of the finality of the State. The Judicial Power has been developing in the sense of managing the Justice and render the jurisdiction in a substantional way, based on the realization of the Constitution, specially the Fundamental Rights, that takes us, at least apparently, to dictate the Law and insert itself in the political activity, in contradiction to the classic theory of the separation of the Powers. On the other hand, our presidential government system, with the hegemony of the Executive Power, deposes against the independence of the Judicial centralizing the political choice of the components of the Highest Court and ingests the formation of the Superior Courts. Now with the adoption of the external control of the Judicial Power, raises the concentration of the powers in the Executive, initiating the exuberance of competence that the Constitution attributed to the Judicial Power. The conclusion is that the lost is of the society, with the subversion of the democratic regime. The history of the well developed countries is pointing the way of consensus, as been the way of a new placement of the powers, adopting the parliamentary system and a independent Constitutional Court.

The Effect of Hormone Replacement Therapy on Cardiac Autonomic Response to Laboratory Stressors

abstract: The objective of this study was to examine the potential effects of long term hormone replacement therapy on cardiovascular autonomic nervous system responses to laboratory social stressors. The participants were 38 postmenopausal women, 18 using estrogen and progesterone hormone replacement therapy for at least 2 years and 20 control participants without hormone replacement therapy. All women completed orthostasis (standing and sitting), then speech and math tasks (speech and math were counterbalanced). Cardiovascular measures of sympathetic nervous system (pre-ejection period, PEP) and parasympathetic nervous system (respiratory sinus arrhythmia, RSA) along with heart rate were collected throughout all periods (baseline, orthostasis, and stressors). For orthostasis, results of mixed analyses of variance (ANOVAs) showed expected period effects for heart rate, RSA and PEP, but no group or group by period interaction was significant. For the psychological stressors, period main effects were significant for all three variables, suggesting that the tasks were effective at inducing stress. Also, there was a significant interaction between group and period for RSA, demonstrated by greater decrease during the psychological stressor period in the group using HRT. The interactions between group and period for heart rate and PEP were non-significant. These findings support the notion that HRT may slow age-related decreases in parasympathetic responsiveness. Furthermore, changes in vagal reactivity in relation to use of HRT appear to occur within mechanisms involving response and coping with psychological stressors, rather than mechanisms that accommodate basic physiological task such as orthostasis. / Dissertation/Thesis / M.S. The effect of the homoeopathic similimum, using the Grant Bentley method, on climacteric symptoms

M.Tech. (Homoeopathy) / Menopause is the natural or iatrogenic termination of menstrual periods as a result of decreasing ovarian function. Natural menopause begins when menstrual periods have been absent for one year (Beers et al., 2006). The Climacteric is the period which encompasses the transition from the reproductive state to the non-reproductive state. Menopause, therefore, is a specific event that takes place during the climacteric (Collins et al., 2010). The symptoms are usually treated conventionally with Hormonal Replacement Therapy (HRT), but a large number of adverse side-effects are associated with its use (Harvey and Champe., 2009). De Schepper (2001) states that the true Homoeopathic Similimum strengthens a person’s vital force which results in the improvement of disease symptoms. Barton (2008) states that it is very difficult to accurately find the Homoeopathic Similimum for each case; therefore, Grant Bentley and his team have worked to develop a system of analysis, to facilitate the identification of the Similimum for each case. The Grant Bentley Method requires photography of the face and analysis of the facial features necessary to ascertain the miasmatic category into which the participant falls (Barton, 2008). There is no research verifying the effectiveness of this method in the treatment of climacteric symptoms. The aim of the study is to evaluate the effect of the Homoeopathic Similimum, using the Grant Bentley-method, on Climacteric symptoms. The study was carried out in the form of case studies over a twelve week period. Eleven females, between the ages of forty and sixty-five years, who were experiencing climacteric symptoms and who met the inclusion and exclusion criteria were recruited, using purposive sampling, by placing advertisements (Appendix A) in local newspapers, pharmacies and medical practices in the Vanderbijlpark area and at the Doornfontein Campus of the University of Johannesburg. The process of the study was explained to the participants and consent forms were signed (Appendix C and D). Participants, with the researcher’s help, completed a Suitability Criteria Questionnaire (Appendix B). During the first consultation the Menopause Rating Scale (MRS) (Appendix E and F) was completed and evaluated (Appendix G). The Homoeopathic case studies took the form of one-on-one conversations in order to complete a Case Taking Form (Appendix I) and incorporated a relevant physical examination and a Grant Bentley Evaluation of each participant’s facial features from which their miasmatic categories were determined (Appendix H). The participant’s case information was examined in accordance with the principles of homoeopathic classical prescribing, based on the entirety of symptoms. Hybridization Associated with Cycles of Ecological Succession in a Passerine Bird

Identifying the diversity of contexts that can lead to hybridization is important for understanding its prevalence and dynamics in natural populations. Despite the potential of ecological succession to dramatically alter species co-occurrence and abundances, it is unknown whether it directly promotes hybridization and, if so, has long-lasting consequences. Here, we summarize 30 years of survey data across 10 populations to show that in western and mountain bluebirds, heterospecific pairing occurs during repeatable and transient colonization events at the early stages of species turnover. Despite mixed pairing occurring only during early succession, genetic data showed presence of hybrids at both early and late successional stages. Moreover, hybrids showed novel patterns of variation in morphology and behavior, emphasizing that even ephemeral contexts for hybridization can have important evolutionary consequences. Our results suggest that because ecological succession often brings together closely related competitors in disparate numbers but lasts for only a brief period of time, it may be a widespread but underappreciated context for hybridization.

Beef replacement heifer decision tool

Pendell / Sachse Family Angus is both a commercial and registered Angus cow-calf operation in Northeast Kansas and has been in operation since 1935. The end goal in mind is to provide quality female breeding seedstock to other beef producers with the hopes of improving their herds. Successful selection and development of beef replacement heifers have major long term effects on stayability in any herd and can even have a positive impact on the whole herd. The objective of this study is to create a decision tool to determine best heifer selection strategies. Specifically, taking a look at the cost of heifer development under a range of scenarios as it applies to more traditional heifer development. The depth of literature addressing the issue of buying or raising replacement heifers is vast, providing various degrees of analysis to help a producer make the best informed decision. Some economists would argue that no single aspect of beef production management is as complicated, or has such an economic impact as cow culling and replacement heifer decisions (Melton, 1980). Procedures and methods were created to analyze whether a producer should raise or develop their own replacement heifers. One method used in creating a decision tool is an enterprise budget. Enterprise budgeting is the systematic determination and listing of expected outputs, revenues, and costs due to the production processes required to produce one unit of an enterprise for a specified time period. To take this one step further, it is assumed a producer makes choices with respect to the combinations of productive factors and products. Partial budgets include an analysis of net returns from small changes or refinement to a ranch. It focuses on parts that change while building upon an enterprise budget. In essence, it fine tunes current operations while holding all else constant. The benefits of partial budgeting take a look at what will be the new or added revenue if a change is implemented on the ranch and what costs will be reduced or eliminated if taken place. What will be the new or added costs and what revenues will be reduced if a change takes place are also things to keep in mind. Therefore, the result will show a producer the net benefit of the change. In turn, Sachse Family Angus will use this information to build their registered and commercial replacement heifers either by developing their own or purchasing from other breeders. Overtime, this decision will be critical as it will impact their herd for years to come. In conclusion, maintaining a good sound, high functioning beef cow herd means selecting and developing quality replacement heifers to retain in the herd each year. An estimated 20% of heifers born each year at Sachse Family Angus are kept as replacement heifers. When managing home raised heifers or purchased heifers, maintaining costs and keeping them in check is crucial because they represent a large up-front investment. The bottom line of this research is to give the managers at Sachse Family Angus and other operations across the country a decision tool that can be used to analyze their current resources and the resources it will take to develop their own heifers successfully and in the most cost effective way or help them analyze if purchasing their heifers makes the most financial sense.

Mechanisms Governing the Eyewall Replacement Cycle in Numerical Simulations of Tropical Cyclones

Eyewall replacement cycle (ERC) is frequently observed during the evolution of intensifying Tropical Cyclones (TCs). Although intensely studied in recent years, the underlying mechanisms of ERC are still poorly understood, and the forecast of ERC remains a great challenge. To advance our understanding of ERC and provide insights in improvement of numerical forecast of ERC, a series of numerical simulations is performed to investigate ERCs in TC-like vortices on a f-plane. The simulated ERCs possess key features similar to those observed in real TCs including the formation of a secondary tangential wind maximum associated with the outer eyewall. The Sawyer-Eliassen equation and tangential momentum budget analyses are performed to diagnose the mechanisms underlying the secondary eyewall formation (SEF) and ERC. Our diagnoses reveal crucial roles of outer rainband heating in governing the formation and development of the secondary tangential wind maximum and demonstrate that the outer rainband convection must reach a critical strength relative to the eyewall before SEF and the subsequent ERC can occur. A positive feedback among low-level convection, acceleration of tangential winds in the boundary layer, and surface evaporation that leads to the development of ERC and a mechanism for the demise of inner eyewall that involves interaction between the transverse circulations induced by eyewall and outer rainband convection are proposed. The tangential momentum budget indicates that the net tendency of tangential wind is a small residual resultant from a large cancellation between tendencies induced by the resolved and sub-grid scale (SGS) processes. The large SGS contribution to the tangential wind budget explains different characteristics of ERC shown in previous numerical studies and poses a great challenge for a timely correct forecast of ERC. The sensitivity experiments show that ERCs are strongly subjected to model physics, vortex radial structure and background wind. The impact of model physics on ERC can be well understood with the interaction among eyewall/outer rainband heating, radilal inflow in the boundary layer, surface layer turbulent processes, and shallow convection in the moat. However, further investigations are needed to fully understand the exhibited sensitivities of ERC to vortex radial structure and background wind.

"Uso de caches na Web - Influência das políticas de substituição de objetos" / The influence of objects replacement policies in web caches

Este trabalho tem como objetivo analisar a influência provocada pelas políticas de substituição de objetos em caches na Web. Isso é feito por meio da investigação das políticas existentes na literatura, considerando um estudo de caracterização de carga, de avaliação de desempenho e de comparação do uso dessas políticas. Para realizar a avaliação das políticas é utilizado um simulador de caches para a Web. Durante a pesquisa, foi desenvolvida uma nova política, denominada MeMoExP. Ela utiliza os conceitos de Média Móvel para otimizar HR e BHR. As simulações realizadas mostraram que a MeMoExP segue a mesma tendência da política FBR, tida como eficiente na literatura. Finalmente, são expostas algumas ponderações sobre as idéias apresentadas nos capítulos componentes desta dissertação, além de serem apresentadas as contribuições provenientes desta pesquisa e alguns trabalhos futuros propostos a partir desta dissertação. / This work aims to analise the influence of the replacement policies on web caches. This is carried out by investigating the policies found at the literature, considering an study of load characterization and performance assessment as well as a comparison between the policies' usage. All the experiments are done using a web cache simulator. During the research, it was developed a new policie, called MeMoExp. It utilizes the concept of Moving Exponencial Average to optimize the HR and BHR metrics. The simulation studies showed that the MeMoExP policie follows the same tendency than the FBR metric, which is considered efficient in the literature. Finally, some considerations about the ideas presented in the dissertation are exposed. The contributions of this research work are presented and some future works are proposed.
