Towards a new bankruptcy regime for Oman : lessons taken from the experience of both England and the US

The main aims of this thesis are to assess the efficiency of the current bankruptcy system in Oman and to offer specific proposals for bankruptcy reform to be adopted by the Omani legislator. Where appropriate, in proposing solutions for various issues lessons will be taken from the experience of both England and the US. This thesis consists of six chapters. The first chapter is a general introduction to the thesis which outlines the structure and scope of the study. Chapter Two critically explores the main theories underpinning bankruptcy law across the world. The aim of this exploration is to provide a general understanding of the policies underpinning bankruptcy laws and to establish the view of this thesis. Chapter Three discusses the experience of England and the US by identifying the main differences and similarities between bankruptcy proceedings in these jurisdictions; such discussion is necessary as a basis for determining the possibility of taking lessons from these developed bankruptcy regimes. Chapter Four provides a critical analysis of the current bankruptcy regime in Oman and outlines the key features of this regime. This chapter also discusses in detail the main issues with the current bankruptcy regime. This discussion includes: (1) the definition of bankruptcy; (2) the qualification of persons administering bankruptcy processes (3) ranking of creditors; (4) position of employees; (5) available alternatives under the current regime; and (6) the effect of declaration of bankruptcy on existing contracts. Chapter Five outlines the possibility of legal transplants and why it is desirable for Oman to adopt some of the bankruptcy principles that are found in England and the US. However, to avoid the risk of rejection of such transplants, this thesis will highlight the necessity of assessing the functionality and workability of western bankruptcy principles before transplanting them. This chapter also offers a proposal for future bankruptcy reform in Oman. Such reforms include having a clear statutory mandate, making bankruptcy law certain and predictable, and establishing a bankruptcy regime that encourage the rehabilitation of viable enterprises instead of liquidating them. Chapter Six is the overall conclusion of this thesis which explains the main ideas discussed and highlights the main contributions made by this study.

Title: Analysis of Air Rescue Services interventions Objectives: The main aim of the thesis is to analyze and create a comprehensive overview of interventions of Air Rescue Services in the period between 2009 and 2011 in the Czech Republic. This work aims to comprehensively describe the historical development of Air Rescue Services in the Czech Republic, their current status and provide information about equipment used by Air Rescue Services. Method: In the thesis methods of collecting data from available sources, data analysis and data comparison are used. Collected data are presented in different tables and graphs together with their description, evaluation and analysis of outcomes. Results: The result of the thesis is the comprehensive description of the air medical service in the past and nowadays. The thesis provides mapping of ARS centres located in the Czech Republic. The results are supported by the graphical demonstration of ARS interventions to urgent life- threatening events and subsequent comparison of these interventions during the period from 2009 to 2011. Urban Search and Rescue (USAR) is the emergency response function that deals with the collapse of man-made structures. USAR environments contain concrete rubble, dust and debris, and provide poor lighting conditions. Due to the dangers that USAR rescue workers and their canines face, robots have become of interest in aiding rescue workers in searching. Experiences with robots in USAR missions have shown that a compact 3D sensor for 3D mapping of the environment is beneficial in providing the robot and identified victims’ locations within the structurally unstable environment. This thesis presents the developments of a novel 3D sensory system that provides both 3D and 2D texture information for mapping of cluttered unknown USAR environments. The sensor has been integrated into a robot platform, and experiments conducted to validate its usability in such applications. The experimental results show the potential for using this sensor in USAR robot mission.

Daily Calls Volume Forecasting

A massive amount has been written about forecasting but few articles are written about the development of time series models of call volumes for emergency services. In this study, we use different techniques for forecasting and make the comparison of the techniques for the call volume of the emergency service Rescue 1122 Lahore, Pakistan. For the purpose of this study data is taken from emergency calls of Rescue 1122 from 1st January 2008 to 31 December 2009 and 731 observations are used. Our goal is to develop a simple model that could be used for forecasting the daily call volume. Two different approaches are used for forecasting the daily call volume Box and Jenkins (ARIMA) methodology and Smoothing methodology. We generate the models for forecasting of call volume and present a comparison of the two different techniques.

The Study of Kaohsiung County's Disaster Rescue and Prevention System

Taiwan is located on west pacific typhoon and circum-pacific seismic zone. So the frequency which natural disasters, such as typhoon, earthquake, flood, and mudflows and landslide, occur is much higher than other countries. The natural disasters keep threatening our living environment, which is highly concerned by the public. In recent years, the government promulgated Disaster Prevention and Response Act and undertook a series of plans for disaster prevention and rescue and policy implementation. However, the development of science and technology, rapid social changes and increasing density of population make the work of disaster prevention and rescue more complicated. In addition, when a serious disaster occurs, most mayors of the local government still do not have any concept for the task of disaster rescue. Their not taking it seriously results in that the related departments can not be effectively integrated to deal with a contingency, which is blamed and queried by the public. This reveals the problem: Taiwan¡¦s disaster prevention and rescue mechanism is in chaos and operates slowly when the disaster just occurs. This research selected the disaster prevention and rescue system in the Hsiang level of Kaohsiung County as the case for study and focused on the organizational and functional aspects of this system. By the means of literature review, case study and questionnaire, this paper discussed the case how the government of Kaohsiung County handled the disasters caused by Mindulle typhoon and 0702 flood. It also examined the disaster prevention and rescue system in the Hsiang level of Kaohsiung County and identified which parts should be improved. From the conclusion of case study, this research also attempted to provide suggestions to the central and local government on the disaster prevention and rescue mechanism.

This dissertation clarifies a challenge present in Peter Singer's famine-relief argument and offers a new account of our moral duties of rescue. The challenge, in essence, is to differentiate two classes of idealized rescue scenarios where one faces the opportunity to rescue someone from serious peril, and to differentiate them in way that both avoids a shockingly demanding conclusion and effectively counteracts the suspicion that one is maintaining and merely rationalizing a self-serving position. To meet this challenge I provide an account whereby both the extent and the limits of our rescue duties are determined in ways that are plausibly continuous with moral and practical norms more generally. / Philosophy
