Systémy opravných prostředků / The system of remedial measures

Summary: In my master's thesis I focus on remedial measures and appellate proceedings. Special attention is given to explanation of rules and principles of the appellation, cassation and revision correction system and the differences between them. This theoretical definition of the mentioned systems is then followed by their practical application in the Czech civil procedure, including its development in the last ten years and mentioning possible amendments in the future. At the end of the paper there is presented the German legal regulation of remedial measures. The master's thesis is, apart of the introduction and conclusion, composed of five chapters, each of them dealing with remedial measures and correction systems from a different point of view. Chapter one is introductory and outlines the questions of appellate proceedings and legal remedies, it also defines basic terminology that is then used in other chapters. Chapter two introduces various correction systems. The chapter is subdivided into four parts. Part one describes the appellation system and its principles. It explains the differences between the system of full appellation the system of inchoate appellation in detail. Second part focuses on the cassation system and its rules. The main purpose of this paper is to establish an effective framework for a junior professional starting in the role of internal auditor in this corporation. The academic part of the paper lays out the auditing function in general, its scope, the related processes and the consulting function associated with it. The empirical part consists of an audit report based on real life data prepared for Trenkwalder International AG focussing on the findings and savings potential for a subsidiary Trenkwalder Kappa People a.s. in the Czech republic. The conclusions from this analysis underline the need for and the importance of implementing internal audit functions in corporations.

Revize aplikace článku 82 - hledání ztraceného ekonomického smyslu / Review of the application of Article 82 - in search of a sound economics

European competition law originated after the end of the Second World War as a part of treaties instrumental to the European integration process and it evolved through secondary law and jurisprudence of the European Court of Justice from an international trade provision into its modern and truly general form. European Commission in it its endeavor to modernize competition law presents a review of the application of Article 82. The goal of the review is to base the policy on a sound economic framework, to aim on effects of abusive conduct rather than on its form and finally to focus mainly on the most important competition problems. This thesis advocates the necessity of an economic analysis while assessing the possible abuse of dominant position in concrete cases and therefore welcomes proclaimed goals of the review. Conversely it criticizes the insufficient fulfillment of these goals, which is in our view, mainly due to misunderstanding of the operation of market mechanism. Economics is in its most generalized form a complex science of purposeful human action. It is therefore not a toolbox, from which one could ad hoc take models or theories in order to assess the abuse of dominant position in real-world cases. This naive approach often leads authorities to make unsound or paradox rulings. We demonstrate the indispensability of correctly understanding the market mechanism in referencing the famous Microsoft case. Industries of the New Economy are characterized by strong network effects and a high portion of fixed costs, which makes the firms often compete "for the market" instead of "on the market". The corollary high market share is not in our view a manifestation of a monopoly position, which could be exploited using monopoly price. Modern economy explains how potential competition forces these highly efficient firms to continuously invest into new technologies and how it pushes down the price of final products. On the other hand, recourse to ad hoc doctrines or non adequate economic models may lead to erroneous assessment of abuse of dominant position.

Dynamika výskytu orchidejí ve vybraném modelovém území v horských polohách / Dynamics of orchid occurrence in highlands

All species of orchids are sensitive plants and records of their distribution are rare. Their rarity is related to their complex biology and their sensitivity to changes in the environment. It is necessary to pay attention to these threatened species, so that we could preserve them from extinction. For their effective protection we need to know the main causes of extinction of their localities. It is also useful to know the factors, which determine their distribution, so that we could find new localities, where they occur. In this thesis I analyzed some climatic, geographic and ecological factors in the Jeseníky mountains and their surroundings. First, I visited localities of orchids, which were registered in large databases of their presence in the past. The four most numerous species were analyzed using the program MaxEnt. Based on the revisions, existence of 2/3 of the revised localities was confirmed, 8% of the revised localities became extinct because of overgrowth or due to human intervention in the landscape. From the MaxEnt results it is clear, that for all species the most important factor at the 50 × 50 m scale, is the type of biotope and heterogeneity of the countryside. Revize diphyllobothriidních tasemnic plazů (Eucestoda: Solenophoridae) / Revision of tapeworms of family Diphyllobothriidae (Eucestoda: Solenophoridae) from the monitor lizards

Diphyllobothriidean tapeworms are well-known parasites of mammals including man, but species parasiting in reptiles are much less known. These tapeworms belong to three genera (Bothridium, Duthiersia, Scyphocephalus) of the family Solenophoridae and are characterized by their unique scolex morphology. They occur in the intestine of varanid lizards and snakes. All three genera are known from Asia, two from Africa (Bothridium and Duthiersia) and one from Australia and South America (Bothridium). Individual genera are well characterised, but species composition of these genera is not well understood. This study surveyed available literary data on the genera Duthiersia and Scyphocephalus and provides new information based on new collected material from Africa and Southeast Asia and material deposited in helminthological collections.

This master thesis is a follow-up to my bachelor thesis which deals with analysis and design of web application for a company Wedding in Prague Inc. Area of interest for this master thesis is a review of analysis and design of application and its implementation. The main aim of the thesis is to create an online wedding application for this company that organizes and plans weddings. The applications purpose is to provide an optimal informatics support for priority processes of the company. To achieve the aim, it was necessary to review analysis of the application including a review of requirements. And because of the scale of these requirements it was necessary to prioritize these requirements. After that I did a review of original design and then I implemented and tested priority functionality of the application. This topic was chosen because the company needed informatics support of existing processes and needed to provide its customers with wedding pages. These wedding pages will be used for wedding administration and providing wedding participants with information about oncoming wedding. Because no suitable application was found on market it was necessary to develop this application. Firstly, the thesis includes a definition of a destination event management and a description of companys processes. After that there is a review of requirements, use case diagrams and a design of user interface. The next chapter focuses on a review of an application design. This includes class diagram, component diagram and a database design. Chapter after that includes implementation of application using framework ASP.NET and it also includes testing cases for this application. The last chapter includes a user manual which describes the functionality of the applications. Contribution of this thesis is to implement and to test a web application which includes a priority functionality (60% of all functionality). This enables easy administration of all organized weddings. Also, it will help expand reputation of the company.

Po stopách evoluční historie a diverzity koloniálních zlativek / Elucidating the evolution and diversity of colonial chrysophytes

Our current knowledge of chrysophyte diversity is still generally based on traditional morphospecies descriptions. Accordingly, sequence data exist for the minority of all described species. Consequently, several common morphotypes (e.g. Ochromonas-like flagellate) are scattered across the phylogenetic tree of Chrysophytes. It is evident that the postulated taxonomic diversity certainly does not reflect the real species richness in Chrysophytes. Moreover, recent studies on silica scaled chrysophytes (Mallomonas, Paraphysomonas, Synura) clearly demasked common problematics of (pseudo)cryptic species even within this group possessing relatively good species concept based on the ultrastructure of silica scales and bristles. Contrary, most of chrysophytes are naked flagellates forming stomatocysts as the only solid structure in their life cycles. While single-celled Ochromonas and Spumella were recently revisited using molecular genetic techniques, Uroglena-like colonials remained untreated. Therefore, the main objective of this thesis was to provide a modern taxonomic revision of the widespread colonial chrysophytes causing conspicuous seasonal massive population booms, Synura s.l. and Uroglena s.l., by a polyphasic approach encompassing molecular phylogeny, morphology/ultrastructure and ecology....

A plan for maintenance and repairs of the building structures and a plan for revisions and inspections on the dedicated technical equipment will be prepared for the given building. The proposed plan will be designed to spread the funds over the whole period considered.
