Pessrová, Monika January 2014 (has links)
Contract for work in international construction projects (Summary) The present master thesis analyses the contemporary practice in the field of making contracts for work in international construction projects. The thesis is divided into three chapters, each of them dealing with different aspects of the new trust concept: from construction projects through construction contracts for work to payment conditions. The opening part of Chapter One focuses on construction projects. It defines their characteristic features and describes the main types of their management, organization and contractual relationships. Kritérium obvyklého pobytu v mezinárodním právu soukromém / A Criterion of Habitual Residence in Private International Law

Pfeiffer, Magdalena January 2013 (has links)
This dissertation deals with one of the most significant concepts of contemporary private international law - the concept of habitual residence. The concept of habitual residence was introduced into the field of private international law within the context of the unification work of the Hague Conference of Private International Law in the interest of finding a compromise between the traditional connecting factors of domicile, dominant in the sphere of common law, and nationality, that is historically closely bound to continental legal systems. Thanks to the long and systematic unification work of the Hague Conference of Private International Law, the connecting factor of habitual residence has gained a permanent indisputable position in private international law. The concept of habitual residence has also forcefully made its way through into the rapidly developing sphere of European private international law. The European Union has followed in the footsteps of the Hague Conference of Private International Law: habitual residence is today the central, most frequently adopted connecting factor in the unified conflict-of-laws rules, that determine the applicable law, as well as in the rules that determine the jurisdiction of the forum. Building on the recent intense development in this field of...

Obchodní společnosti a jejich mobilita v evropském kontextu / Companies and their mobility in the European context

Belloňová, Pavla January 2013 (has links)
With regard to the gradual economic globalisation markets of States become more and more interconnected, especially so in the European Union which aims to create a single internal market without internal borders and barriers to the free movement of goods, persons, services and capital. Naturally, it influences behaviour of economic participants on the market. With increase of competition it is necessary to be more innovative, active and to search for new opportunities for expansion not only in one's own State but also abroad which entails entering into relations with foreign entities. In the course of time it might be useful or even necessary to relocate the place of business. Such need might not and, indeed, does not concern only natural person but also legal entities such as companies. However, the status of companies in cross-border relations has some specific features in comparison to the status of natural persons. A company is only an artificial product of law, a mere legal fiction, and therefore, its existence is much more closely linked with a specific legal order. A company has legal personality only insofar as some legal order acknowledges it. Different approaches how to link a company to a certain State have been evolved in different States - either the connecting factor is the statutory...

Budoucnost evropského mezinárodního práva soukromého / Future of the European Private International Law

Johnová, Gabriela January 2009 (has links)
The European international private law has undergone a dynamic development during the last twenty years. It can be assumed that this development will continue con-sidering the increasing need for dealing with the legal relations involving a cross-border element, which arise thanks to the exercise of the freedom of movement of goods, capital, services, and people in the frame of the European Union. The experts in international private law discuss the directions of its future development. Should it continue the same or similar direction as until now, i.e. the unification of individual in-struments and conclusion of international agreements (limited with the EU competen-ces), or should it take the direction of a comprehensive codification of the European conflict of laws? The last considered direction is the adoption of a comprehensive common code on private law, i.e. a code of the private substantive law rules. Neverthe-less, this possibility deals with the diversity of the law cultures and the law orders among the EU member states.

Part of the problematics was the construction of the Parish house and the Community house as a part of the church mentioned above. The plot is situated at the site of the southern slope between Horáková and Molákova Street and in close proximity of the Salesi center. The project is conceived as a progressively graduating spiral rising from the mass of the community house to the sculpture of the cross at the tower of the church. Visually both building are separated from the north side but are partially connected thanks to the underground floor from the south side. The building of the community center shall be a three-story building. The design of the church itself is based on the centralization of space and due to progressive gradation to the center of the building, where all the events associated with the Christian year take place. The complex serves both as a place where the widespread society can fulfill their spiritual needs as well as a sanctuary of the Salesian community, where they can fulfill their mission.

Knihovny a čtenářská recepce v období raného humanismu v Čechách / The Libraries and Reader's Reception in the Early Humanism Period in Bohemia

Neškudla, Bořek January 2014 (has links)
The dissertation looks into the book culture, book production and readership in the kingdom of Bohemia in early humanism. It explores the conditions of rise and reception of book printing in the kingdom of Bohemia. The mind-set of the Utraquist society, resistant to the influence from abroad, international isolation of the Utraquist Bohemia and the previous insignificant manuscript production proved to be the factors which failed to encourage the arrival of book printing in the country. The initial advancement of book printing was hesitant and could not to keep up with the more developed trade abroad. The Czech printing production related to the efforts of reformation to further enhance the moral status of the society soon turned to disseminating literature in the vernacular, yet often they were translated literature. The early Czech printed production however was affected by low quality and quantity of prints and was not of the significance declared by the previous generations of researchers. Personalities of the Catholic society were more inclusive about new ideas from abroad. In the contemporary society the Catholics were therefore the first ones to embrace book printing and also they were quicker in reception of humanism. The early humanist literature in Bohemia is related to the personality of...
