Disentangling the relationship between corruption and shadow economy / Rozuzlení vztahu korupce a šedé ekonomiky

This paper analyses the relationship between corruption and shadow economy. Synthesis of existing theoretical models and the empirical findings in this paper show that different types of corrupt behavior interact with shadow economy differently. Therefore, the relationship between contexts differs. Overall, it seems that the mechanisms leading to the complementary relationship are more prevalent. The results also imply that the quality of public goods available in the official economy influences where the different types of corrupt behavior manifest. When the quality of the public goods is high, corruption and shadow economy appear to be substitutes and when the quality is low, they are complements. However, the relationship is not robust and depends upon the measures used to assess the public goods quality. Furthermore, corruption and shadow economy seem to be complements in decentralized countries and countries with high taxes.

Objective of this diploma thesis is to identify risks and barriers connected with expansion of using the Public-Private Partnership concept, fractional objective is to identify limiting factors which affect still not very developed PPP projects in the Czech Republic. The theoretical part of the thesis is dedicated to definition of PPP concept and explanation of its specific characteristics in providing of public goods. The practical part is focused on chosen projects. On this sample are limits of expansion of using PPPs identified and analysed using the method of partial generalization. On the basis of analysis of available literature and qualitative research made there are suggested possible solutions.

Analýza účinnosti partnerství veřejného a soukromého sektoru / Public Private Partnership

This thesis is dedicated to a partnership of public and private sectors and to its usage at the sphere of providing public goods. Introductory chapter is oriented on characteristics, classification and possible backup of public goods. Next chapter is focused on PPP method - history of PPP projects, their characteristics, pros and cons. Legal aspect of PPP projects, their institutional backup and their comparison with public tenders are also included in the thesis. Analytical part shows various ways of implementation of PPP projects in the Czech Republic -- e.g. Accomodation capacities and parking of The Central Military Hospital in Prague and Aquapark in Olomouc, as representatives of local autonomies. Questionnaire research of locally autonomous units with the objective of finding out the level of knowledge and access to PPP projects, is another important part of this thesis. The objective of the thesis is the evaluation of a partnership of public and private sectors, as one of possible solutions of providing public goods.

Vybrané právní formy podnikání zahraničního subjektu v ČR / Selected legal forms of business of foreign entities in the Czech Republic

The work deals with the topic of entry of foreign entrepreneurs to the Czech market on the background of two different forms of business - franchising and a limited liability company. The main topic concentrates on the comparison of legislation and contractual framework of these two business forms, primarily focusing on intellectual property and the protection of intangible assets. The work presents general legal provisions related to contracts in the field of intellectual property rights, including licensing agreements. The work is further devoted to franchising and limited liability companies. The business of foreign entrepreneurs is related to the internationality of the contractual process. Contractual cooperation of more entrepreneurs also requires the existence of statutory regulation of competition law, with a special focus on franchising in this work. The application part of the thesis is dedicated to the protection of intellectual property rights, rendering an example of a particular foreign entrepreneur doing business gradually through franchising, and then through a limited liability company founded as a subsidiary of a foreign parent company. Access of entrepreneurs to intellectual property protection during the expansion of their business is analyzed by individual types of intangible assets, such as trademark or know-how. The aim of the work is to highlight the specifics of each business forms and identify problems associated with the provision of intellectual property rights.

The thesis is focused on an overall assessment of the appropriateness of the provision of public goods in the Czech Republic in the form of Public Private Partnership (PPP). The theoretical part of the thesis deals with the general issue of providing public goods and characteristics of PPP as an alternative to the institute of public contracts. This theme is further developed by analysis of the possible forms of PPP projects with financial assistance from the Structural Funds. The practical part is devoted to analysis of the implemented municipal PPP project of construction and operation of parking house. For the project effectiveness evaluation are used outputs from the calculated financial model which are supplemented by the application of theoretically possible co-financing from EU funds.

Kritické zhodnocení koncepce PPP / The PPP Concept: A Critical Evaluation

Diploma thesis deals with the implementation of the public private partnership concept in Czech Republic. Its primary aim is to highlight risks of the PPP concept. Thesis describes theoretical and practical risks of the concept and concludes that the threat of risks is much more significant when the PPP concept is implemented in insufficiently suitable environment. In the practical part the thesis finds an answer to the question whether the PPP concept is suitable for implementation in the Czech Republic. By analyzing the legal and institutional environment and factors such as public procurement, corruption, transparency and public finances, the thesis demonstrates that under current conditions the implementation of the PPP concept is not suitable in Czech Republic. Conclusions are confirmed by analysis of PPP concept implementation. Finally, the thesis pronounces recommendations about the future application of the PPP concept in Czech Republic.

In this thesis I look at economic statecraft and try to examine why sanctions continue when they are failing, and why countries continue to use them despite debatable claims for success. For example, Hufbauer et. al.'s 2009 analysis shows sanctions only work 34% of the time, Pape (1997) estimates only 5%. Despite this economic statecraft is having a resurgence under the name "geoeconomics". This thesis builds off Kaempfer and Lowenberg's 1988 "Public Choice" theory of international economic sanctions. It hypothesises that in certain cases the domestic interests will be the primary goal of sanctions and therefore should be the primary focus of judging the success or failure of sanctions. Russia's 2014 food import ban is analysed to show that, despite failure to achieve any international goals, it is being successful at achieving the domestic goal of supporting Russian agriculture. The implications being that all current quantitative analysis of economic sanctions have potentially incorrectly measured sanctions as failures by not measuring them against the actual goals of the policies. The main topic of this diploma thesis is the historical-sociological analysis of spa forests in the surroundings of Carlsbad. More and more people exploit the nature, especially near human settlements. Therefore, there is a question if suburban, or in our case spa forests, wouldn't have according to the law other rights and obligations than other types of forests. The subject of the research is the analysis of the development of Carlsbad spa forests (Lázeňské lesy Karlovy Vary) during their historical development and related social development, which was reflected on the form of the spa forests. The main research initiative is human access to forests in terms of sustainable forestry and ecological balance depending on the natural and social contexts of the area around the city of Carlsbad. The diploma thesis is divided into two main parts - theoretical and empirical. In the theoretical part, through a careful analysis of the literature and research of sources, there is a historical development of forests with respect to the spa area of the city of Carlsbad. Convergence of Copyright and Trademark Protection Key Words: Copyright, Trademark, Protection, Convergence Abstract: The thesis analyzes the concept of copyright and trademark protection in Czech law and the consequences of their simultaneous operation. The aim is to determine whether the existing legislation responds the current trends and demands in our society, where business and arts are becoming interconnected and where the boundaries between those disciplines are blurred. Both protections are initially assigned to theoretical context of legal branches of intellectual property and intangible property. The author also deals with current conception of ownership in Civil Code. Following chapters are based on the principles of civil (continental) law concepts of copyright law and industrial property law established in this part. Subsequently the regulation of copyright protection and trademark protection is discussed in two separate chapters. Those chapters are divided into identical sub-chapters to highlight similarities and differences of both legal institutes. The purpose of this work is to summarize and explain the context around the licenses, license agreements and protection of intangible goods, with the main focus on industrial property, in particular, inventions, designs, utility models and trademarks. The first part is about clasiffication of intangible goods and characteristics of industrial property. Next part deals with the protection of intangible goods, particularly from the international point of view, i.e. international conventions and organizations. It also includes comparison of protection in the three major economic centers - Europe, USA and Japan. Next part deals with the license agreement. From the explanation of the concept of a license, through the reasons leading to such relations, to the procedure of negotiating about the license agreement and its content, including a model of patent licensing agreements.
