Toward a Unification of Arts Applications for HealthCameirao, Jacob January 2024 (has links)
Arts applications for health – whether for clinical treatment or its complement in health promotion – tend to be “canalized”: research and practice in one art domain tend to be done in isolation from research and practice in other art domains. As a result, arts applications for health lack a unifying theoretical framework that would allow for the rational selection and inclusion of the arts into programs of health. In this thesis, I present two theoretical articles that address this problem. The first article, Toward a New Science of the Clinical Uses of the Arts, proposes a framework unifying clinical arts applications. It argues for the equivalence of psychotherapies (whether arts-based or not) in treating mental illness because all psychotherapies rely on the same set of common therapeutic factors in producing their clinical effects. In contrast, we argue for the non-equivalence (i.e., the specificity) of physical therapies (whether arts-based or not) in treating physical illness since physical therapies rely on specific therapeutic factors unique to each therapy in producing most of their clinical effects. The second article, Toward a Unification of Arts Applications for Health Promotion, proposes a framework for unifying the arts as leisure activities for health promotion. I propose that all leisure activities (whether arts-based or not) rely on a set of five common health-promoting factors in producing their effects. This results in an equivalence of outcomes when any two leisure activities possess the same health-promoting factors. Arts applications for both clinical treatment and health promotion show similarities in that both operate via “transfer effects,” whereby the arts transfer benefits to non-arts health domains. Advanced Features in Protocol Verification: Theory, Properties, and Efficiency in Maude-NPASantiago Pinazo, Sonia 31 March 2015 (has links)
The area of formal analysis of cryptographic protocols has been an active
one since the mid 80’s. The idea is to verify communication protocols
that use encryption to guarantee secrecy and that use authentication of
data to ensure security. Formal methods are used in protocol analysis to
provide formal proofs of security, and to uncover bugs and security flaws
that in some cases had remained unknown long after the original protocol
publication, such as the case of the well known Needham-Schroeder
Public Key (NSPK) protocol. In this thesis we tackle problems regarding
the three main pillars of protocol verification: modelling capabilities,
verifiable properties, and efficiency.
This thesis is devoted to investigate advanced features in the analysis
of cryptographic protocols tailored to the Maude-NPA tool. This tool
is a model-checker for cryptographic protocol analysis that allows for
the incorporation of different equational theories and operates in the
unbounded session model without the use of data or control abstraction.
An important contribution of this thesis is relative to theoretical aspects
of protocol verification in Maude-NPA. First, we define a forwards
operational semantics, using rewriting logic as the theoretical framework
and the Maude programming language as tool support. This is the first
time that a forwards rewriting-based semantics is given for Maude-NPA.
Second, we also study the problem that arises in cryptographic protocol
analysis when it is necessary to guarantee that certain terms generated
during a state exploration are in normal form with respect to the protocol
equational theory.
We also study techniques to extend Maude-NPA capabilities to support
the verification of a wider class of protocols and security properties.
First, we present a framework to specify and verify sequential protocol
compositions in which one or more child protocols make use of information obtained from running a parent protocol. Second, we present a
theoretical framework to specify and verify protocol indistinguishability
in Maude-NPA. This kind of properties aim to verify that an attacker
cannot distinguish between two versions of a protocol: for example, one
using one secret and one using another, as it happens in electronic voting
protocols.
Finally, this thesis contributes to improve the efficiency of protocol
verification in Maude-NPA. We define several techniques which drastically
reduce the state space, and can often yield a finite state space,
so that whether the desired security property holds or not can in fact
be decided automatically, in spite of the general undecidability of such

The 1980 United Nations Convention on the International Sale of Goods, concluded
under the auspices of UNCITRAL, creates a comprehensive statutory legal framework
for international sales. Through the express incorporation of the principle of freedom of
contract, the convention contains rules which the parties may freely adapt to the
particular circumstances of their transaction, by filling any gaps that may arise with trade
usages and other practices. In addition, the convention recognises the binding force of
international trade usages in certain circumstances, in that it binds parties to usages
which are so widely known and have acquired such regularity of observance in
international trade as to justify an expectation that they will be observed in the particular
transaction. Such acknowledgment of the changing patterns and norms of behaviour
which characterise international trade law allows the CISG to be categorised as a major

Thesis (LLD)--Stellenbosch University, 2012. / Includes bibliography / ENGLISH ABSTRACT: The existential crisis of the international regime of criminal law is arguably a thing of the past. This is confirmed through a growing body of positive law and the existence of various international criminal courts, notably the permanent International Criminal Court which has been in operation since 2002. Moreover, it is significant that international criminal law (“ICL”) is developing towards increased domestic enforcement, in particular as a result of the complementarity regime envisioned by the Rome Statute of the International Criminal Court. States have generally been receptive and cooperative towards international criminal norms as well as the structures of international criminal justice. As a result international criminal laws are increasingly being transformed into national law and enforced by states on the domestic level.
Chapter 2 provides an overview of the abovementioned developments, the characteristics of ICL and certain key concepts. In lieu of the upward trajectory of ICL’s development, the thesis aims to determine whether ICL exerts an influence which holds ‘transformative value’. Chapter 3 unpacks this concept by delineating the different meanings afforded to transformation and identifying the reticent characteristics of transformative change, especially the underlying importance of values during processes of transformation. Transformative value is conceptualised broadly as the product and potential of the type of change that holds some utility for the civitas maxima (or the community of mankind).
In Part II, ICL’s transformative value is investigated from a historical and global perspective with emphasis on the purposes, values and politics of international criminal justice. Chapter 4 focuses on the Nuremberg IMT and the trial of Adolf Eichmann. It is submitted that these trials produced a paradigm shift that represents the transformative foundation of modern ICL. Chapter 5 investigates the purposes and aspirations of modern ICL with reference to its underlying assumptions as well as its objectives, the latter which may be found in positive law and the jurisprudence of international criminal courts. The research suggests that ICL is disposed towards objectives which are unique in comparison to those of domestic criminal law. While it cannot be denied that punishment under ICL is predominantly a backward-looking exercise in the tradition of domestic criminal law retributivism, ICL is somewhat removed from this paradigm due to its purpose- and value-driven nature. ICL is also expressive, normative and forward-looking in various respects. Individual criminal liability is however not universally accepted as an appropriate response to collective violence. This is partly a result of ICL’s endemic political dependency. Chapter 6 addresses the impact of politics on ICL’s transformative value. ICL is closely associated with liberal-legalist ideals which essentially promote the interests of individuals. Although it constitutes an important element of ICL’s transformative value, this political influence exposes ICL to criticism and may exert a disruptive influence on its transformative mandate. In this latter respect it is noted that ICL remains somewhat controversial and subject to the general limitations of the decentralised and state-dominated international legal system.
In Part III, ICL’s transformative value is investigated using South Africa as a case study, with particular reference to its transitional- and post-transitional periods. Chapter 7 provides a domestic perspective of ICL’s transformative value by investigating the interactions of ICL and the South African legal system, particularly the value of the transformation of ICL into national law. In this regard the impact of Constitutional provisions and national legislation pertaining to ICL are considered, as well as a number of cases related to matters of international criminal justice. It is argued that international criminal norms may promote human values over state authority and political interests in the domestic context. Domestic courts may serve as ‘engine rooms’ for transformative change through more effective enforcement of those international criminal norms that have been ‘transformed’ into national law through implementation legislation. The permeation of international criminal norms into the domestic sphere represents a foray of universal values into an area traditionally dominated by sovereign might and holds potential for promoting the interests of individuals as well as for the institutionalisation of human rights. Yet, as illustrated by the current rift between the ICC and the African Union, international and regional political affiliations may influence the ability of a state to meet its obligations towards international criminal justice.
In Part IV (Chapter 8), it is submitted that ICL is historically and ontologically aimed at change that is both backward-looking (repressive) and forward-looking (normative) as well as beneficial in a communitarian sense. ICL’s transformative value derives from the value-and purpose-driven nature of international criminal norms, the political nature of international criminal justice and also from the interaction between international law and domestic legal systems. ICL may be viewed as an authoritative expression of the norms and values of the international community. As such, ICL and its institutions may be viewed not only as a means of punishing the perpetrators of international crime, but also as part of the spearhead towards a desired alternative to the historical and present reality characterised by injustices which have gone unabated under the system of traditional Westphalian sovereignty. As egregious forms of the aforementioned injustices, macro criminality and impunity undermine the protection of internationally recognised individual rights. ICL seeks to remedy this through impacting on those individuals that have not yet acceded to the emergent universal consciousness of the majority in the international community. It is further argued that ICL’s transformative impact is not confined to the “hard” impact of the application of substantive ICL in international and domestic courts. The international criminal justice system as a whole also produces a normative impact through a purpose-driven association with international values and certain political preferences.
This thesis offers a new way of thinking about the value, potential and limitations of the ICL regime, as well as the role of politics in international criminal justice. / AFRIKAANSE OPSOMMING: Die eksistensiële krisis van die internasionale strafregbestel is stellig iets van die verlede. Dít word bevestig deur die toenemende hoeveelheid positieweregsmateriaal en die bestaan van verskeie internasionale strafhowe, in die besonder die permanente Internasionale Strafhof wat sedert 2002 in werking is. Daarbenewens is dit beduidend dat internasionale strafreg (hierna ‘ISR’) na binnelandse toepassing begin verskuif, bepaald as gevolg van die komplementariteitsregime wat die Rome Statuut van die Internasionale Strafhof beoog. State is oor die algemeen ontvanklik vir, en tegemoetkomend jeens, internasionale strafnorme sowel as die strukture van internasionale strafregspleging. Gevolglik word internasionale strafwette al hoe meer tot in nasionale wette getransformeer en binnelands deur state toegepas.
Hoofstuk 2 bied ’n oorsig van bogenoemde ontwikkelings, die kenmerke van ISR en bepaalde kernbegrippe. In die lig van die opwaartse ontwikkelingstrajek van ISR, het dié tesis ten doel om te bepaal of die invloed wat ISR uitoefen, oor ‘transformasiewaarde’ beskik. Hoofstuk 3 ondersoek hierdie begrip deur die verskillende betekenisse van transformasie uiteen te sit en die versweë kenmerke van transformerende verandering, veral die onderliggende belang van waardes in die transformasieproses, te bepaal. Transformasiewaarde word in die breë verstaan as die produk en potensiaal van die soort verandering wat een of ander nut het vir die civitas maxima (of die gemeenskap van die mensdom).
In deel II word die transformasiewaarde van ISR uit ’n historiese en internasionale hoek ondersoek, met die klem op die doel, waardes en politiek van internasionale strafregspleging. Hoewel straf ingevolge ISR onteenseglik ’n hoofsaaklik terugblikkende oefening in die vergeldingstradisie van nasionale strafreg is, is ISR tog ietwat verwyderd van hierdie paradigma vanweë die doel- en waardegedrewe aard daarvan. ISR is in baie opsigte ook ekspressief, normatief en toekomsgerig.
Individuele strafregtelike aanspreeklikheid word egter nie allerweë as ’n toepaslike reaksie op kollektiewe geweld aanvaar nie. Dít is deels ’n gevolg van die endemiese politieke afhanklikheid van ISR. Hoofstuk 6 handel derhalwe oor die impak van politiek op die transformasiewaarde van ISR. ISR hou ten nouste verband met liberaal-legalistiese ideale wat in wese individue se belange bevorder. Hoewel dit ’n belangrike element van die ISR-transformasiewaarde uitmaak, stel hierdie politieke invloed ISR ook bloot aan kritiek, en kan dit ’n ontwrigtende uitwerking op die transformasiemandaat daarvan hê. In dié verband word daarop gelet dat ISR ietwat omstrede bly, sowel as onderworpe aan die algemene beperkinge van die gedesentraliseerde en staatsoorheerste internasionale regstelsel.
In deel III word die transformasiewaarde van ISR aan die hand van Suid-Afrika as gevallestudie ondersoek, met bepaalde verwysing na die oorgangs- en na-oorgangstydperke van die land. Hoofstuk 7 bied ’n binnelandse beskouing van die transformasiewaarde van ISR deur ondersoek in te stel na die wisselwerking tussen ISR en die Suid-Afrikaanse regstelsel, veral die waarde van die transformasie van ISR tot in die nasionale reg. In hierdie verband word daar besin oor die impak van grondwetlike bepalings en nasionale wetgewing met betrekking tot ISR, sowel as ’n aantal hofsake in verband met aangeleenthede van internasionale strafregspleging. Daar word aangevoer dat internasionale strafnorme in binnelandse verband straks mensewaardes bo staatsgesag en politieke belange bevorder. Binnelandse howe dien moontlik as ‘enjinkamers’ vir transformerende verandering, deur daardie internasionale strafnorme wat deur inwerkingstellingswetgewing tot in die nasionale reg ‘getransformeer’ is, doeltreffender toe te pas. Die deurdringing van internasionale strafnorme tot in die binnelandse sfeer stel ’n verskeidenheid universele waardes bekend op ’n gebied wat tradisioneel deur soewereine mag oorheers is, en hou potensiaal in vir die bevordering van individuele belange sowel as vir die institusionalisering van menseregte. Soos die huidige skeuring tussen die Internasionale Strafhof en die Afrika-unie egter toon, kan internasionale en streek- politieke bande ’n invloed hê op ’n staat se vermoë om sy verpligtinge teenoor internasionale strafregspleging na te kom.
In deel IV (hoofstuk 8) word aangevoer dat ISR histories en ontologies afgestem is op terugblikkende (onderdrukkende) én toekomsgerigte (normatiewe) verandering, sowel as verandering wat een of ander gemeenskapsvoordeel inhou. Die transformasiewaarde van ISR spruit uit die waarde- en doelgedrewe aard van internasionale strafnorme, die politieke aard van internasionale strafregspleging, sowel as die wisselwerking tussen internasionale reg en binnelandse regstelsels. ISR kan as ’n gesaghebbende openbaring van die internasionale gemeenskap se norme en waardes beskou word. As sodanig, is ISR en die instellings daarvan nie net ’n middel om die plegers van internasionale misdaad te straf nie, maar ook deel van die strewe na ’n wenslike alternatief vir die historiese én huidige realiteit, wat gekenmerk word deur onregte wat ongebreideld onder die stelsel van tradisionele Wesfaalse soewereiniteit voortduur. Makrokriminaliteit en strafloosheid, synde uiterste vorme van voormelde onregte, ondermyn die beskerming van internasionaal erkende individuele regte. ISR beoog om dít reg te stel deur ’n invloed uit te oefen op daardie individue wat nóg nie die ontluikende universele bewustheid van die meerderheid in die internasionale gemeenskap openbaar nie. Daar word voorts betoog dat die transformerende impak van ISR nie tot die ‘harde’ impak van die toepassing van substantiewe ISR in internasionale en binnelandse howe beperk is nie. Die stelsel van internasionale strafregspleging in die geheel het ook ’n normatiewe impak deur middel van ’n doelgedrewe verbondenheid aan internasionale waardes en bepaalde politieke voorkeure.

Hybrid Constitutionalism to Mainstream Human Rights in a Unified KoreaMoon, DAVID 02 October 2013 (has links)
Amidst the global wave of democratization, modernization, and economic engagement during the 1980s and 1990s, the traditional tenets of constitutionalism have proven to be unwieldy dogma for States undergoing periods of rapid transition. In order to retain the administrative capacity to steer – rather than merely adapt to – political and social change, numerous transitioning States have adopted a new paradigm of constitutionalism, namely transitional constitutionalism, characterized by a centralized and streamlined structure of governance. However, in many instances, including Korea’s post-division transitional history, this model has demonstrably undermined fundamental human rights protections. In this thesis, I propose a hybrid constitutional paradigm for unification in Korea (another form of State transition) which seeks to balance the dual objectives of effective governance and human rights protection. I do so by examining and critiquing the core principles of traditional and transitional constitutionalism, outlining the human rights issues that the unified Korea will likely confront in its constitutional trajectory based on an analysis of Korea’s political, social, cultural, and constitutional history, and finally proposing a hybrid model of constitutionalism that utilizes an institutional approach to prevent violations of human rights in the unified Korea while allowing the State to retain governmental efficiency during transition. / Thesis (Master, Law) -- Queen's University, 2013-09-30 11:35:33.362

The present thesis compares geografical education in Argentina, Ecuador, Honduras, Mexico and Spain. The main subject is the concept of the geografical education of level ISCED 2, presented in binding curriculum of the foremntioned countries. Content analysis of the curriculum aims to find out whether general geographical education is being unified or not. This thesis seeks to verify or falsify the hypothesis of bases of the elementary general geographical education being consistent in globalised world. This hypothesis is justified by the fact that educational potential of geography (certain basis of maternal discipline) is very similar across the world, as are main educational needs of today's society. Undoubtedly, the needs determine the goals, topics and content structure of geographical education. The structure of the thesis is congruent with the forementioned goals. The first part gives broader background of the subject. The second part is the research, its methodology and results. The concept of geographical education in curriculum was assessed through quantitaive and qualitative content analysis. Quantitative analysis focused on the frequency of key words (indicators of content unification) in educational goals and main topics. Na presente tese utiliza-se o método dedutivo-comparativo para desenvolver um estudo do factoring, principalmente no Brasil e na Argentina, e uma análise da Convenção de Ottawa do UNIDROIT, que dispõe sobre o contrato de factoring internacional. Este estudo inicia-se com uma breve análise histórica do factoring e suas características gerais na Europa, nos Estados Unidos e na América Latina, sendo investigada ainda a etimologia da palavra factoring, o seu enquadramento como instituto e a sua estrutura e função. Em seguida, passa-se a analisar o factoring no Brasil em seus mais variados aspectos, tais como o processo histórico, a terminologia adotada, a legislação interna, enfatizando-se o contrato internacional e as figuras contratuais afins, como também abordando as sociedades de factoring e os seus volumes de operações. Por envolver um estudo comparativo, a pesquisa volta-se, em seguida, à análise desses variados aspectos do factoring em relação à Argentina. Analisa-se, também, a referida Convenção de Ottawa do UNIDROIT, as suas características, a influência de outras convenções internacionais, a participação do Brasil e da Argentina e, especialmente, o que dispõem os seus artigos. Em seguida são identificados os aspectos do contrato de factoring internacional que seriam harmonizados se o Brasil e a Argentina adotassem essa convenção, especialmente os seguintes: (a) adoção do termo factoring em vez de qualquer outro em língua portuguesa ou espanhola; (b) reconhecimento mútuo e expresso de que o factoring é importante para o desenvolvimento do comércio internacional; (c) adoção de uma moldura legal mínima dos direitos e obrigações das partes envolvidas na relação contratual, já que esses dois Estados não possuem lei específica regulamentando o contrato de factoring internacional; (d) consolidação das duas principais atividades do factoring internacional (cessão de créditos e prestação de serviços diversos); (e) consolidação do entendimento de que a cláusula pro soluto (sem direito de regresso contra o cliente faturizado) no contrato de factoring internacional é facultativa e não obrigatória; (f) flexibilização das formalidades do ato de notificação ao devedor impostas pelos artigos dos Códigos Civis brasileiro e argentino, que tratam da cessão de direitos; (g) indubitabilidade quanto à internacionalidade do contrato de factoring; (h) reconhecimento da cláusula de cessão global de créditos futuros no contrato de factoring internacional; (i) proibição da cláusula de não cessão (pactum de no cedendo); (j) consolidação do sistema de dois agentes (two factors system) no factoring internacional. Ao final, é demonstrado que se mostra necessário que Brasil e Argentina adiram à Convenção de Ottawa do UNIDROIT, como forma de se ter um direito uniforme aplicável ao contrato de factoring internacional e, por conseqüência, maior segurança jurídica na relação contratual, que poderá incentivar os pequenos e microempresários a se utilizarem desse instrumento para fomentar suas exportações. / In this thesis, it is used the deductive-comparative method to develop a study of factoring, mainly in Brazil and Argentina, and an analysis of the Ottawa Convention of UNIDROIT, that regulates the contract of international factoring. This study begins with a brief historical analysis of factoring and its general characteristics in Europe, the United States and Latin America, and even an investigation of the etymology of the word factoring, its framework as the institute and its structure and function. Then, factoring in Brazil in its most varied aspects, such as its historic process, the terminology adopted, the law are examined, emphasizing to the contract and international figures related contract, but also addressing companies, factoring and their volumes of transactions. By involving a comparative study, the search then back up the analysis of various aspects of factoring in reaction to Argentina. It is also analyzed the referred Ottawa Convention of UNIDROIT, its characteristics, the influence of other international conventions, the participation of Brazil and Argentina and, especially, their articles. Then aspects of the contract of international factoring that would be harmonized if Brazil and Argentina adopt this convention are identified, especially the following: (a) adoption of the term factoring instead any other in Portuguese or Spanish languages; (b) mutual recognition and expression that factoring is important for the development of international trade; (c) adoption of a minimum legal framework of rights and obligations of the parties involved in the contractual relationship since the two states have no specific law regulating the contract of international factoring; (d) consolidation of the two main activities of international factoring (assignment of receivables and provision of other services); (e) consolidation of understanding that the clause pro soluto (without right of recourse against the customer faturizado) in the international factoring is voluntary and not mandatory; (f) easing the formalities of the act of notification to the debtor imposed by the articles of the Brazilian and Argentinean Civil Codes, which deal with the assignment of rights; (g) leaving no doubts about the internationality of the factoring; (h) recognition of the clause of global assignment of future receivables in the international factoring; (i) ban of the non-assignment clause (pactum de no cedendo); (j) consolidation of the system of two agents (two factors system) in international factoring . In the end, it is shown that it is necessary the accession of Brazil and Argentina to the Ottawa Convention of UNIDROIT, as a way of having a uniform law applicable to the contract for international factoring and, consequently, greater legal security in the contractual relationship, which could encourage small and microentrepreneurs to use this instrument to promote their exports.

Die Haftungsbelastung des Arbeitnehmers bei Schädigung DritterSchelp, Ira 26 November 2004 (has links)
Die vorgelegte Arbeit behandelt die Haftungsbelastung des Arbeitnehmers, wenn dieser im Rahmen seiner Arbeitstätigkeit einen Dritten schädigt. Es handelt sich um eine rechtsvergleichende Betrachtung, die sich die Erstellung eines europäischen Regelungsentwurfes zum Ziel gemacht hat. Rechtsvergleichend konnte festgestellt werden, dass im europäischen Rechtsraum teils gravierende Unterschiede bei der Haftungsinanspruchnahme des Arbeitnehmers zu verzeichnen sind. Diese Unterschiede beruhen auf divergierenden Wertungen der Frage ob eine Haftungsaufteilung zwischen Arbeitgeber und Arbeitnehmer geboten ist. Von den untersuchten Argumenten für und wider einer Haftungsentlastung des Arbeitnehmers haben sich die Fürsorgepflicht des Arbeitgebers und das Betriebsrisiko als tragende Argumente für eine Haftungsverlagerung erwiesen. Es wird daher die Haftung des Arbeitnehmers nur für vorsätzliches Verhalten vorgeschlagen. Im übrigen wird das Haftungsrisiko dem Arbeitgeber zugewiesen. Für den europäischen Rechtsraum wird eine Versicherungspflicht empfohlen. Die Pflichtversicherung tritt hierbei für den entstehenden Schaden ein. Nur im Falle der Vorsatzhandlung durch den Arbeitnehmer kann diesem gegenüber Regress genommen werden. Die Versicherung wird nach diesem Modell durch den Arbeitgeber abgeschlossen. Eine Mindestversicherungssumme soll festgelegt werden. Im Einzelfall wird bei hinreichend nachgewiesener Liquidität eine Befreiung von der Versicherungspflicht ermöglicht. Die Beitragsgestaltung richtet sich nach der Gefahrgeneigtheit der im Betrieb durchgeführten Arbeiten sowie nach der Häufigkeit von Haftungsfällen, so dass das individuelle Schadensrisiko des Unternehmens berücksichtigt wird. Eine zuverlässige Kontrolle des Versicherungsabschlusses soll von staatlicher Seite aus gewährleistet werden. Eine Vereinheitlichung dieser Haftungsfrage im europäischen Rechtsraum sollte nur im Rahmen eines europäischen Zivilrechtsbuches erfolgen. Es wurden die bestehenden Harmonisierungsmöglichkeiten untersucht. Eine Privatrechtsvereinheitlichung kann nach Autorenauffassung am besten über den Weg eines Modellgesetzes umgesetzt werden. / The present dissertation deals with the liability an employee bears in case he injures a third person in course of employment. It’s a comparative study which aims to draft an outline for a unified European rule. There were apparent differences between the compared European laws regarding the topic of vicarious liability. The variations in how liability is shared between employee and employer are created by dissimilar morals and values. Of the studied arguments for or against the principle of vicarious liability have two persuaded in favour of a shared liability between the parties of employment. The first is the employers obligation to care for the welfare of his employees and the second the inherent risk of the business itself which puts an obligation on the employer to share the liability for damage done to third parties in course of employment. In detail this study suggests to keep the employee liable for intended acts only. Apart the liability is to be carried by the employer. The concept proposes further a compulsory insurance which is to be paid for by the employer. The insurance however is obliged to step in for all the damage done in course of the employment by the employee. Only in case of intention there is the right of the insurance to take regress at the employee. Part of the concept is a minimum sum to be insured. State enterprises and comparable solvent companies shall have the opportunity to apply for an exception of the requirement to insure. Insurance rate should connect to the individual risk of the business, considering the risk-level in course of the operation of the particular business and the quantity of actual damages done. A reliable control by officials is necessary to ensure that the employer cared for the insurance. A unification of the matter should only take place in a European context of a unified civil law. A study of the existing possibilities to harmonise private law in Europe led to the conclusion that the subject of vicarious liability within a new European civil code should be drawn in the shape of a model law.

Es werden verschiedene Aspekte interner magnetischer Hintergrundfelder in Theorien offener Strings diskutiert. Phaenomenologisch und konzeptionell interessante Eigenschaften solcher Vakua, die Brechung von Supersymmetrie, Eichsymmetrie und chiraler Symmetrie, werden auf ganz generische Weise behandelt. Dann wird eine Spezialisierung auf Typ I Modelle, kompaktifiziert auf Tori und Bahnfaltigkeiten, durchgefuehrt. Daraus wird eine Methode gewonnen zur Konstruktion von Typ I Vakua mit attraktiven effektiven Feldtheorien als Niederenergienaeherungen, sowohl supersymmetrische wie nicht supersymmetrische Modelle mit chiralen Fermionspektren und Eichgruppen aehnlich dem Standardmodell oder einer vereinheitlichenden Verallgemeinerung desselben. Die am weitesten entwickelten Beispiele kombinieren magnetische Felder mit NSNS B-Feldern auf Bahnfaltigkeiten. Zuletzt wird noch eine verwandte Klasse von Modellen besprochen, die zwar eher weniger vielversprechende phaenomenologische Perspektiven bietet, aber einige konzeptionelle Spezialitaeten aufweist. In diesen Kompaktifizierungen werden asymmetrische Rotationen geeicht, so dass D-branen mit unterschiedlichen Werten fuer die magnetischen Felder auf ihrem Weltvolumen identifiziert werden, womit die Unterscheidung von kommutativen und nicht kommutativen Geometrien verlorengeht. / We discuss various aspects of internal magnetic background fields in open string theories. Phenomenologically and conceptually interesting properties of such string theory backgrounds, supersymmetry and gauge symmetry breaking, chiral fermion spectra and noncommutativity of the internal compactification manifolds, are treated in a rather generic framework. We then specialize to type I compactifications on tori and toroidal orbifolds with magnetic fields on the internal space. This allows to develop a strategy for constructing type I vacua with attractive low energy field theories which may either be supersymmetric or not and contain chiral spectra and gauge groups close to the Standard Model or some grand unified generalization thereof. The most sophisticated version uses magnetic fields and NSNS B-fields on orbifold spaces giving rise to a plethora of promising examples for semi-realistic string compactifications. We finally also present a related class of asymmetric orbifolds of type I which are of little phenomenological interest but still display certain interesting features. The asymmetric rotations which are gauged in these models identify D-branes with different values for the magnetic field on their world volume, such that the distinction of commutative and noncommutative internal geometries is lost.
