Veřejnoprávní omezení vlastnického práva k pozemku v ČR / Land ownership right restrictions resulting from public law in the Czech Republic

In the Czech Republic, the same way as it is in other democratic countries, the ownership right is recognized to be one of the fundamental human rights, and it is protected by legislation of a supreme legal force. Along with modern society development and for this reason it becomes more and more restricted. It is a long time ago, when the unlimited legal domain like theory of ownership rights in rem was forsaken. The restrictions are more numerous and intensive in case of land being subject to ownership rights. This results from many differences between land and other subjects of ownership. Limited and definitive land area, the fact that land is not relocatable as well as soil, being one of environmental elements, represent the most important ones. In one line with increasing amount of people on Earth and their increasing requirements on its usage, the land must fill constantly increasing needs for the welfare of increasing amount of people at the same time. The necessity of protection of environmental aspect of land and soil respectively, is still growing. For all those reasons, the restrictions and regulations on land ownership rights are to be put in place. When justified by public interest, the restrictions arise from public law legislation. Cílem této práce je přiblížit čtenářům výkon samosprávy na úrovni obcí a zhodnotit podnikání obcí jako způsob jejich efektivnějšího hospodaření s majetkem. První část řeší právní postavení obcí v České republice a jejich funkce v rámci výkonu veřejné správy. Další část se zaměřuje na hospodářskou činnost obce, tedy na hospodaření dle rozpočtu a nakládání s majetkem. Ve třetí části je teoreticky zhodnocen význam a možnost podnikání obcí a organizační formy, kterých může obec při svém hospodaření využívat. Poslední část přináší zhodnocení hospodaření konkrétní obce (Město Rakovník) s důrazem na formy její hospodářské činnosti.

Práce se zabývá možnostmi využití modelů latentních tříd při segmentaci trhu. Jejím cílem je vysvětlit hlavní myšlenku, na níž jsou modely latentních tříd založeny, podat výklad nejužívanějších metod a algoritmů a především demonstrovat aplikaci latentních modelů na problematiku segmentace trhu. Je členěna do třech částí. První část poskytuje uvedení do problematiky segmentace trhu.Popisuje koncept segmentace trhu a kritéria efektivní segmentace, obsahuje klasifikaci segmentačních proměnných a souhrn nejčastěji používaných metod a technik při segmentaci trhu. Druhá část se zabývá teoretickými východisky modelů latentních tříd. Vysvětlena je podstata latentních modelů, jejich matematická formulace a způsob odhadu parametrů modelu. Třetí část obsahuje výsledky použití modelu latentních tříd na konkrétní segmentační studii. Studie se týká trhu finančních služeb a jejím cílem bylo identifikovat a následně charakterizovat segmenty homogenní z hlediska vlastnického profilu finančních produktů.

This thesis is aiming on the use of public transport in Europe. Objective of this work is by using correlation analysis determine whether the amount of subsidies to public transport and the ownership structure as the decisive criterion for the number of passengers, as an additional variable to assess the impact of fleet composition. Secondary data obtained from study of the University of Dublin has served to analyze. Calculation of the dependence didn't confirm or disclaim it. This gives space for further exploration. After analyzing the more comprehensive data set should be followed by analyzing the nature of subsidies, the choice of carriers, contractual conditions and other factors affecting the use of public transport.

This diploma thesis evaluates the effects caused by the changes made to taxation of real estate in 2014. It describes the impact of the tax burden on both the taxpayers and on public budgets. Specifically, the thesis focuses on the calculation of the reference value for the purposes of determining the base of the real estate acquisition tax. The effects on the taxpayer tax burden were evaluated through a comparison of the old and the new law on specific examples. The effect on public budgets was calculated using the revenue figures for the relevant taxes in the years 2013 and 2014. An analysis of the individual changes helped identify the factors which have affected the final tax and tax revenue the most.

The Diploma thesis named Trends of the Estate Prices in the Czech Republic is concerned with the analysis of the development of the real estate prices especially apartments and family houses. The main goal is to thoroughly analyse the evolution of property prices within 10 years (2004-2014). Other goals include the impact of selected macroeconomic indicators on real estate prices, the impact of the financial crisis and the view on the current situation in the real estate market. The most important terms and definitions related to actual real estate, ownership, Cadastre of Real Estate and real estate market are explained in the theoretical part. The practical part is divided into two sections. The first section includes a look at the development of the construction industry and housing construction , development of prices of residential property and the development of prices compared with GDP, inflation, unemployment, income population, demographic development and abroad. Development of housing prices is analysed by means of time series analysis and explained with expected development of the real estate prices. The main goal of second section is analysis of the questionnaire, which focuses on the actual inhabitant. The aim of the questionnaire is to obtain and comparison of indicators related to housing.

Expropriation of buildings and land Abstract The represented thesis aims to completely analyse the institute of exproriation of buildings and land as it is governed by the Expropriaton Act. Expropriation as a traditional institute of Czech law is considered as the most severe interference with the property right and, as a result, the property right or right corresponding to the easement to the land or the building is deprived or limited. The diploma thesis starts with a general treatise on expropriation, especially by including this institute in the Constitution and related property right and its protection. The basic legal acts governing expropriaton are described. The definition of the term expropriation and the analysis of the objects and subjects of expropriation are also included in this part of the thesis. The second chapter deals with the individual conditions of expropriation that must be cumulatively fulfilled in order to expropriate. The conditions under the Expropriation Act are, among others, the public interest in achieving the puprose of expropriation, subsidiarity and proportionality of expropriaton, and compliance with the objectives and tasks of spatial planning. This thesis is focused on the records in the land register. This topic still has its relevance in the contemporary world and can appear in any person's life. That was one of the factors why the author had chosen this area for analysis. The other was her overall interest in property law and registration. The thesis is divided into two parts. The first is focused on the land register by itself and its role as an important source of information. In the beginning of the first part some typical concepts related to the land register are introduced. The next section is dedicated to the brief history of the property registration which is considered to be useful for the better understanding of the contemporary legal regulations. Those are discussed in the next chapter together with the position of the land register by itself, its purposes, content and structure. The special attention is paid to the objects in question - concretely the properties registered by this institution.
