Presents a study on the labor market and economic relations both corporate, national and international influence on it, on the role of each social agent, and to what extent, flexibility creates or destroys jobs. Finally, the employment relationship is studying the power to remit the employer and its legal limits, and the limitation of power, especially in the collective aspect, the participation of the judiciary, the scope of their decisions and the importance of strengthening trade unions, as a way to implement democratic and labor relations. / O presente trabalho aborda os direitos trabalhistas como direitos humanos fundamentais, sua vinculação a particulares e efetividade, bem como a impossibilidade de retroceder-se em relação a direitos já conquistados, além da obrigação de avançar. Traz um estudo sobre o mercado de trabalho e como as relações econômicas empresariais, nacionais e internacionais exercem influência sobre o mesmo, sobre o papel de cada agente social, e, em que medida, flexibilizar cria ou destrói empregos. Por fim, trata da relação trabalhista, estudando o poder de dispensa do empregador e seus limites jurídicos, bem como a limitação deste poder, especialmente no aspecto coletivo, a participação do Poder Judiciário, o alcance de suas decisões e a importância do fortalecimento dos sindicatos, como forma de implementar e democratizar as relações trabalhistas.
