Ochrana zaměstnance při převodu zaměstnavatele / Protection of employees in the event of transfer of employer

Koubková, Barbora January 2021 (has links)
Protection of employees in the event of transfer of employer The master's theses deals with the topic of the transfer of rights and obligations from employment relationships and related institutes of protection of the employees affected by the transfer. The topic is regulated at the European Union tier by Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses, which has been transposed into national law as Section XV of Part Thirteen of Act No. 262/2006 Coll., the Labour Code. The thesis introduces both tiers of legislation, the relevant case law of the Court of Justice of the European Union and the Supreme Court of the Czech Republic and evaluates the implementation of the Directive 2001/23/EC into the national system. The first part of the work is an explanatory one as it describes the meaning of some of the fundamental labour law terms and contexts for the purposes of the following text. The second part introduces the transfer of an undertaking, business or part thereof under the Directive 2001/23/EC and formation of the rules by the Court of Justice of the European Union, in particular the development of the...

Přechod práv a povinností z pracovněprávních vztahů / Transfer of rights and obligations from the employment relationships

Nerad, Miroslav January 2021 (has links)
In his thesis, the author deals with the transfer of rights and obligations arising from employment relationships. In the Czech law, the regulation of transfer of rights and obligations is governed in substantial part by the Act No. 262/2006 Coll., the Labour Code, as amended, and in other statutes. The Czech legislation is based on harmonised regulation in the law of the European Union, which is provided for in the Council Directive 2001/23/EC of 12 March 2001 on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses. In his thesis, the author examines the current regulation in the Czech law and the decision- making practice of the Czech courts and compares it with the decision-making practice of the Court of Justice of the European Union. The author also deals with the amendment of transfer of rights and obligations implemented by the Act No. 285/2020 Coll., amending the Act No. 262/2006 Coll., the Labour Code, as amended, and several other related acts, and compares the applicable law with the preceding. The thesis also deals with the history of regulation of transfer of rights and obligations in the Czech Republic, then it deals with the general definition...

Harmonický posun výšky tónu / Harmonic pitch shifting

Cihelková, Tereza January 2011 (has links)
This thesis describes the design and implementation of audio effect for pitch shifting of monophonic singing signals. The effect can generate two pitch shifted voices from input signal in real-time, while preserving formants. Amount of the shift can be controlled via MIDI controller. The effect is implemented as VST module in the form of dynamic-link library. This work also includes theoretical introduction to related DSP techniques.

Modifikace zisku v klasických bilančních teoriích / Modifications of Profit in Classical Balance Theories

Balek, Luboš January 2011 (has links)
The master's thesis focuses on the accounting concept of profit or loss. In the first part, the contemporary approach to the issue from both theoretical and practical point of view is described with the main focus on the determination of the distributable profit. The capital maintenance and value measurement are also dealt with for this purpose. Following the theoretical basics laid down in the previous part, the main approaches of classical balance theories are explained and their advantages and disadvantages pointed out in relation to their possible use in practice. The thesis contains illustrative examples and ends with a draft of a usable methodology based on the various concepts described in the text.

Počítačová simulace a numerická analýza problémů stlačitelného proudění / Computer simulation and numerical analysis of compressible flow problems

Kubera, Petr January 2011 (has links)
The thesis deals with the construction of an adaptive 1D and 2D mesh in the framework of the cell- centered finite volume scheme. The adaptive strategy is applied to the numerical solution of problems governed by the Euler equations, which is a hyperbolic system of PDE's. The used algorithm is applicable to nonstationary problems and consists of three independent parts, which are cyclically repeated. These steps are PDE evolution, then mesh adaptation and recovery of numerical solution from the old mesh to the newly adapted mesh. Owing to this the algorithm can be used also for other hyperbolic systems. The thesis is focused on the development of our mesh adaptation strategy, based on the anisotropic mesh adaptation, which preserves the geometric mass conservation law in each computational step. The proposed method is suitable to solve problems with moving discontinuities. Several test problems with moving discontinuity are computed to compare our algorithm with Moving Mesh algorithms.

Zdvořilostní strategie v písemných žádostech zahraničních studentů / Politeness strategies in foreign students' written requests

Hermanová, Andrea January 2018 (has links)
i Abstract The MA thesis examines the politeness strategies which native speakers and non-native speakers of English employ in written English requests addressed to the faculty. The requests represent by nature the category of Face threatening acts and require a certain level of politeness. The account of politeness is based on the Face management theoretical framework by Brown and Levinson (1987). The empirical part compares on-record (positive and negative) and o↵-record politeness strategies and the level of directness (Blum-Kulka, 1987) comprised in two hundred email messages sent by students of British and Irish, German, and French nationality. The analysis discovered that the nationality/native language is to some extent a determinative feature in the choice of politeness strategies, while the gender of the student influences the level of directness of the request. The Appendix contains the full sample of examined emails. Keywords politeness theory, face management, request, on- record politeness (negative and positive), o↵-record politeness, directness of request

Tropické deštné pralesy v moderní civilizaci / Tropical rainforests in modern civilization

Suchanová, Veronika January 2009 (has links)
This thesis deals with the selected issues regarding tropical rainforests in modern civilization. It explains what the tropical rainforest is and where it is located. The thesis points at the importance of the tropical rain forestry, and warns of increasing threats primarily due to deforestation. The thesis also shows possible approaches to deal with the issue and presents a practical example of a functional project in real life.

Zásada flexijistoty v právní úpravě přechodu práv a povinností z pracovněprávních vztahů / Principle of flexicurity in legal regulation of transfer of rightsand obligations from the employment-law relations

Jouzová, Lada January 2018 (has links)
1 Principle of flexicurity in legal regulation of transfer of rights and obligations from the employment-law relations Abstract In her PhD thesis, the author deals with the legal regulation of transfer of rights and obligations arising from employment-law relations in the Czech Republic, in the context of the European union law, from the point of view of the concept of flexicurity in the employment-law relations. This concept includes, on the one hand, elements of flexibility in the realization of employment-law relations, and, on the other hand, security (protection) of employees in these relations which is manifested in particular by the transfer of rights and obligations from their employment-law relations to the new employer itself. At present, when changes in the employers' organizational structure, transfers of activities or tasks, mergers, the purchase of a business or a business lease, but also so called outsourcing, insourcing, and change of suppliers are becoming more and more common in companies, the issue of change of the employer, and consequently, safeguarding and protection of the rights of employees, in particular safeguarding of their employment-law relations, is becoming more up to date. Protection of employees' rights during the transfers of undertakings and businesses is one of the...
