El presente informe analiza los actos administrativos y su vinculación con las reglas del procedimiento para el otorgamiento del título de concesión minera en el Perú. El análisis se realiza a partir del petitorio minero “Dos Amigos II”, el cual fue cancelado por la Presidencia del Consejo Directivo del INGEMMET, en base al informe técnico emitido por el INRENA (actualmente, “SERNANP”). En ese sentido, partir de un análisis normativo y doctrinario, se sustentan las posturas respecto a la naturaleza jurídica y validez de la opinión vinculante del INRENA; asimismo, la validez del acto administrativo de última instancia, mediante el cual el Consejo de Minería declara la nulidad de oficio de la resolución que canceló el petitorio minero; finalmente, la relevancia y falencias de la Compatibilidad y Viabilidad Ambiental para el destrabe del procedimiento administrativo objeto de estudio. / This report analyzes the administrative acts and their relationship with the procedural rules for the granting of the mining concession title in Peru. The analysis is carried out based on the mining request "Dos Amigos II", which was canceled by the Presidency of the Board of Directors of INGEMMET, based on the technical report issued by INRENA (currently, "SERNANP"). In this sense, based on a normative and doctrinal analysis, the positions regarding the legal nature and validity of the binding opinion of INRENA are supported; likewise, the validity of the administrative act of last resort, through which the Mining Council declares the nullity ex officio of the resolution that canceled the mining petition; finally, the relevance and shortcomings of the Compatibility and Environmental Viability for the unblocking of the administrative procedure under study.
